AN ORDINANCE REPEALING DIVISION It PARK AND
RECREATION BOARD, SECTIONS 2-37 THROUGH 2-46,
INCLUSIVE, OF ARTICLE VI, PARK AND RECREATION,
OF THE CODE OF THE CITY OF FORT WORTH (1964),
AS AMENDED, AND AMENDING DIVISION 29 PARK AND
RECREATION DEPARTMENT, SECTIONS 2-47 THROUGH
2-529 INCLUSIVE, OF SAID ARTICLE BY SUBSTITUT-
ING NEW SECTIONS THEREFOR ESTABLISHING AND
REGULATING A PARK AND RECREATION DEPARTMENT,
PROVIDING FOR A DIRECTOR THEREOF TO BE AP-
POINTED BY THE CITY MANAGER AND FIXING IrHE
FUNCTIONS AND DUTIES OF SAID DEPARTMENT AND
ITS DIRECTOR; AND NAMING AN EFFECTIVE DATE.
WHEREAS, on April 8, 1975, a majority of the elec-
torate of the City of Fort Worth voting in a Charter Amend-
ment election found and determined that Section 4, Jurisdic-
tion of the Park Board -- Scope of Activities -- of Chapter
XVIII, Department of Public Parks, and Section 4, Powers
and Duties of Public Recreation Board ***, of Chapter XIX,
Department of Public Recreation, and Section 42 of Chapter
XXV I I I, Miscellaneous, of the Charter of the City of Fort
Worth should be repealed and a new chapter substituted there-
for to read as follows:
"The City Council shall provide by ord i
nance for the establishment and regulation
of a Park and Recreation Department.",
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
SECTION 1.
That Division 1, Park and Recreation Board, Sections
2-37 through 2-46, inclusive, of Article VI, Park and
Recreation, of the Code of the City of Fort Worth {1964},
as amended, be and the same are hereby repealed.

SECTION 2.
That Division 2, Park and Recreation Department,
Sections 2-47 through 2.52, inclusive, of Article V1, Park
and Recreation, of the Code of the City of Port Worth (1964).
as amended, be and the same are hereby amended so that here-
after same shall read and be as follows:
"PARK AND RECREATION DEPARTMENT
"Sec. 2-47. Established. There is hereby
established a Park and Recreation Department,
which department shall be under the super-
vision of the Park and Recreation Director,
who shall be subject to appointment and re-
moval by the City Manager. The salary of the
Park and Recreation Director shall be in ac-
cordance with the compensation plan of the City.
"Sec. 2-48. Park and Recreation Director
-- Appointment; Duties Generally. Subject to
the approval of the City Manager, the Park and
Recreation Director shall be responsible for de-
termining over-all policies, regulations and
programs governing acquisition, improvement,
maintenance and operation of all public parks,
parkways, lakes and other recreational areas,
and the grounds surrounding all municipal build-
ings owned or controlled by the City. The Park
and Recreation Director shall be responsible to
the City Manager for administration and implemen-
tation of the policies established by the City
Council in accordance with the provisions of
this ordinance.
"Sec. 2-49. Same -- Appointment of Employees.
The Park and Recreation Director shall have the
power to appoint, employ and remove such other
officers, assistants, employees and personnel
as he may deem necessary for the efficient ad-
ministration of the affairs of the Park and
Recreation Department, and to prescribe and fix
their duties, scope of authority and qualifica-
tions in accordance with the annual budget of
the Park and Recreation Department as finally
adopted by the City Council and the classifica-
tion and compensation plan established by the
City Council. All officers and employees of the
Park and Recreation Department shall be governed
by the same personnel rules and classification
and compensation plan as is established for all
other employees of the City.
"Sec. 2-50. Limitation of Expenditures.
The Park and Recreation Department shall not
make any expenditure of money or incur any
liability during any fiscal year beyond the
amount of money appropriated or set apart in
the annual budget of the Park and'Recreation
Department as approved by the City Council
for such purpose.
"Sec. 2-51. Forms and Methods of Budget-
ing and Accounting. The Director of Finance
shall prescribe all forms for the keeping of
Park and Recreation fund accounts and vouchers
necessary to be used in the conduct of the
business of the Park and Recreation Department,
which forms and methods of accounting shall
be employed by that department so as to con-
form to the method of accounting instituted
and enforced in the Department of Finance.
The Park and Recreation Department shall con-
form to such rules and regulations regarding
financial affairs as are promulgated by the
Director of Finance, including rules and pro-
cedures governing preparation and review of
the annual budget and control of budgeted ex-
penditures, and rules and procedures regulat-
ing preparation and review of the capital im-
provement program and control of capital ex-
penditures through the bond fund project con-
trol system.
"Sec. 2-52. Annual Audit. At the end of
each fiscal year the Department of Finance shall
cause to have made a full and complete audit of
the accounts and business of the Park and Recrea-
tion Department."
SECTION 3.
That there-is hereby added to Article VI of the Code
of the City of Fort Worth (1964), as amended, a new section
designated as Section 2-52(a), Advisory Board, which new
section shall read and be as follows:
"Sec. 2-52(a)-l. Advisory Board. The City
Council shall appoint an advisory board to be
comprised of nine citizens to act in an ad-
visory capacity to the City Manager and City
Council in conjunction with the Park and Recrea-
tion Department. The members of such advisory
board shall each serve for a two year term,
shall serve without compensation and may be

removed at any time by the City Council
"Sec. 2-52(a)-2. Responsibilities of
Advisory Board. The Advisory Board will be
responsible for providing policy recommendations and
information to the City Manager and the City Council
about citizen needs and requests that will improve
the services of -the department.
"Sec. 2-52(a')-3. Duties of Advisory Board.
The Advisory Board may recommend to the City
Manager and the.City.Counci 1 plans for develop-
ment of facilities and services to meet the
needs of the City. The Board will review and
comment upon the
i ro posed annual operating
budget and ca improvement program requests.
Recommendations made by the Board will be pre-
sented to the City Manager and the City Council
for consideration."
SECTION 4.
That this ordinance shall be in full force and effect
from and after the date of its passage, and it Is so
ordained.

GRAHAM On April 8, 1975, a majority of the electorate of the City of Fort Worth
voted in a Charter Amendment Election to amend the City Charter in
JoHK°RQ Division 1, Park and Recreation Board, Sections 2-37 through 2-46, inclu-
CAMPBELL sive of Article VI, Park and Recreation, of the Code of the City of Fort
Worth (1964), as amended, and amending Division 2, Park and Recreation
Department, Sections 2-47 through 2-52, inclusive.
Such amendment called for the Park and Recreation Board to be regulated by
ordinance. Attached is an ordinance prepared by the City Attorney. There
are no substantive changes from the proposed ordinance which was presented
to the City Council on April 18, 1975.
Recommendation
It is recommended that the City Council approve the ordinance as prepared by
the City Attorney and authorize the City Manager to establish guidelines for
the operational duties and responsibilities of the Advisory Park and Recre-
ation Board.
