Home My WebLink AboutOrdinance 24437-09-2020 Ordinance No. 24437-09-2020 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER AND SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF$2,280,074.00, TRANSFERRED FROM AVAILABLE FUNDS IN THE WATER AND SEWER FUND, FOR THE PURPOSE OF FUNDING THE SANITARY SEWER REHABILITATION CONTRACT 90, PART 1 PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2019-2020 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of $2,280,074.00, transferred from available funds in the Water and Sewer Fund, for the purpose of funding the Sanitary Sewer Rehabilitation Contract 90, Part 1 project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 23835-09-2019 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the execution of a contract with William J.Schultz, Inc.dba Circle C Construction,in the amount of$1,897,659.00 for Sanitary Sewer Rehabilitation Contract 90, Part 1;and 2. Adopt the attached Appropriation Ordinance increasing estimated receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of$2,280,074.00 for the Sanitary Sewer Rehabilitation Contract 90,Part 1 (City Project No.CO2382)transferred from available funds within the Water and Sewer Fund. The project was advertised for bid on July 9,2020 and July 16,2020 in the Fort Worth Star-Telegram. M/WBE OFFICE:William J.Schultz,Inc.dba Circle C Construction Company is in compliance with the City's BIDE Ordinance by committing to zero percent MBE participation and documenting good faith effort.William J.Schultz, Inc.dba Circle C Construction Company identified several subcontracting and supplier opportunities.However,the firms contacted in the areas identified did not respond or did not submit the lowest bids. The City's MBE goal on this project is eight percent. The project is located in COUNCIL DISTRICTS 5 and 8. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that funds are currently available in the Water&Sewer Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance,funds will be available in the current capital budget,as appropriated,in the W&S Capital Projects fund for the SS Rehab Contract 90 project.Prior to any expenditure being incurred,the Water Department has the responsibility to validate the availability of funds.
