HomeMy WebLinkAboutContract 50377-A2 CSC No. 50377-A2 AMENDMENT No.2 TO CITY SECRETARY CONTRACT No. 50377 WHEREAS, the City of Fort Worth (CITY) and Kimley-Horn and Associates, Inc. , (ENGINEER) made and entered into City Secretary Contract No. 50377, (the CONTRACT) , which was administratively executed on the 3rd day of March, 2018 in the amount of $70, 000 . 00; and WHEREAS, the CONTRACT involves engineering services for the following project: Riverside Park Phase I Improvements; and WHEREAS, the Contract was subsequently revised by Amendment No. 1 in the amount of $180, 000 which was authorized by M&C C-28871, on September 25, 2018; and WHEREAS, it has become necessary to execute Amendment No. 2 to the CONTRACT to include an increased scope and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in a scope of services proposal, a copy of which is attached hereto and incorporated herein (Attachment A) . The cost to City for the additional services to be performed by Engineer totals $14, 500 . 00 . (See Attached Funding Breakdown Sheet, page 4) 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the revised fee paid by the City for all work and services shall be an amount of $264, 500 . 00 . 3 . All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. Phase I Pedestrian Survey: A Phase I Pedestrian Cultural Resource Survey for the proposed improvements at Riverside Community Park, will be provided through the use of a subconsultant. The Phase I investigation will be completed in an effort to identify cultural resources in the project area and make recommendations about their significance with regard to eligibility for listing on the National Register of Historic Places (NRHP) and designation as a Texas State Antiquities Landmark (SAL). In the event that a recommendation for NRHP or SAL eligibility cannot be made for a site found during the Phase I survey, Phase II testing may be recommended and subsequently required by the THC, if the site cannot be avoided. This proposal does not include any Phase II testing or Phase III mitigation tasks. The following be provided as part of this scope: 1. Fieldwork: The subconsultant field crew will survey the northern 15 acres of the Riverside Community Park. Survey standards will meet the minimum requirements accepted by the THC (2020). If archaeological sites are found during the survey, ARC is required to record them. The following assumptions have been made in regards to the fieldwork associated with this task. a. The subconsultant will record up to one(1)archaeological site. b. The City will provide access to the site. c. If human remains are found, all activity in the vicinity of the remains will cease. Law enforcement officials, the Engineer and the City will be notified. 2. Deliverables: The subconsultant will produce a technical report, prepared in an effort to meet the current and published standards adopted by the THC(Council of Texas Archeologists 2018)and present a review of the natural environment and cultural history of the project area, a research design and methodology, and the results of the field investigations, along with conclusions and recommendations. 3. Curation: Records and collected artifacts must be curated in perpetuity with an approved curatorial facility, in order to fulfill requirements in the TAP. A City of Fort Worth representative must sign the required curatorial paperwork. If any artifacts are collected on private land, they will be returned to the landowner at their request. 4. Schedule: The Engineer requires written notice to proceed (NTP) in order to begin work. The schedule is subject to change if weather prohibits fieldwork, human remains are found, or an architectural historian must be consulted. a. The TAP Application process will begin within ten (10)working days of NTP. b. Fieldwork will begin within fifteen (15)working days of receiving the TAP, and will be completed within five (5)working days. c. A Preliminary/Draft version of the Cultural Survey Report will report will be submitted to the Engineer and the City within fifteen (15)working days, for review; and submitted to the THC within five(5)working days of City approval. 5. Additional Services: The following items have been excluded from the scope. a. Review of more than (1)archaeological site. b. Review of the site by an architectural historian. c.
