TO CITY SECRETARY CONTRACT No. 43084 WHEREAS, the City of Fort Worth (CITY) and URS Corporation, (ENGINEER) made and entered into City Secretary Contract No. 43084, (the CONTRACT) which was authorized by M&C. C-25441 on the 21 day of February, 2012 in the amount of $ 143, 680. 00; and • WHEREAS, the CONTRACT involves engineering services for the following project: Carten Street Drainage Improvements; and WHEREAS, it has become necessary to execute Amencment No. 1 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated February 12, 2013, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $59,995. (See Attached Funding Breakdown Sheet, Page -3-) 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $203,675.00. 3. All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. EXECUTED and EFFECTIVE as of the date last written by a signatory, below. DRAINAGE IMPROVEMENTS City Project No. 00673 URS Project No. 25335260 Dear Mr. Perkins: This letter is for requested additional engineering services for the above referenced project. The services for Amendment No. 1 are in addition to or modify our current scope of services. A description of the additional services and associated fees are provided below. A detailed breakdown of the proposed fee for these additional services is also attached. ADDITIONAL ENGINEERING DESIGN SERVICES 1. Project Management - Provide project management services for the preparation of additional storm drain design, water line lowering design, headwall improvements, and oversight of subconsultants. URS Corporation Services = $3,540.00 Subconsultant Mark-up (1O%) _ $ 355.00 Total Additional Management Services = $3,895.00 2. Additional Storm Drain Design Services 7 Per City's direction during the 30% design review meeting held on 12/11/12, the following additional design services will be performed by the URS design team. a. "Phase 2" Storm Drain Design: The proposed storm drain on Janice Lane will be extended to a point approximately 225-ft, south of the intersection with Norma St as shown on the 30% design submittal. This extension involves preliminary and final design of an additional 825 ft. of storm drain and approximately four additional storm inlets. The additional storm drain design includes performing hydraulic calculations, hydraulic gradient line, and inlet computation tables to be included on the construction plans. URS Corporation Services = $44,550.00 EBG Engineering Services = $ 2,300.00 Phase II Storm Drain Design $46,850.00 b. "Phase 2" Water Line Lowering Design: The additional storm drain laterals will conflict with the existing 8" water line in Janice Lane. Four additional water line lowering locations are included in the additional design efforts. EBG Engineering Services = $ 1,25 0.00 "Phase 2" Water Line Lowering Design $ 1,250.00 c. Headwall Improvements: A new vertical headwall will be designed to replace the existing flared wing wall, north of Meadowbrook Drive. Minor grading design will be performed on the channel immediately north of the headwall. The existing 6'X5' box drain will be extended approximately six feet north to accommodate the proposed tangential sidewalk alignment revision along the north side of Meadowbrook Drive. URS Corporation Services = $ 8,000.00 Headwall Improvements $ 8,000.00 Total Additional Design Services = $56,100.00 The proposed fee for the services as described above does not include the following services: 1. Additional topographic survey, as it is assumed that existing Topographic survey is sufficient to. provide the above mentioned design services. 2 Permit preparation services. 3. Any Additional Geo-Technical exploratory borings other than the eight borings included in the original contract. 4. Easement preparation. 5. Paving improvements beyond the normal limits (as defined by the City Standard pavement trench repair details) of the proposed storm drain improvements and water line lowering. 6. Any services not specifically stated above. We therefore request a contract amendment to increase the lump sum fee amount by $59,995. Mr. Michael R. Perkins, P.E. In order to maintain that goal, URS proposes to transfer the Phase 1 design services for preparation of traffic control plans, erosion control plans, and water line lowering to EBG Engineering for an agreed lump sum fee of $7,850.00. This will provide EBG Engineering with a more significant role in the project. The total M/WBE fee participation for this project including Amendment No. 1 and the afore -mentioned transfer of design services to EBG Engineering will be $38,934.00 ($27,534.00 + 3,550.00 + $7,850.00 = $38,934.00) or a total M/WBE percentage of 19.00%. DISCUSSION: The Amendment recommended by this Mayor and Council Communication will provide for the design of additional storm drain, replacement of an existing headwall and relocation of a City waterline outside of the original project limits. The need to expand project limits was identified during preliminary analysis. On January 21, 2012, the City Council authorized an Agreement with URS Corporation, to provide preliminary analysis and engineering (M&C C-25441). URS Corporation, proposes to perform the Amendment design services for a lump sum fee in the amount of $59,995.00. Staff considers the fee to be fair and reasonable for the scope of services provided Funding for this project is being provided from revenue bonds in the Stormwater Capital Projects Bond Fund. M/WBE Office: URS Corporation, agrees to maintain its initial M/WBE commitment of 19 percent that it made on the original Agreement and extend and maintain that same M/WBE commitment of 19 percent to this first Amendment. Therefore, URS Corporation, remains in compliance with the City's M/WBE Ordinance and attests to its commitment by its signature on the Acceptance of Previous M/WBE Commitment form executed by an authorized representative of its company. This project is located in COUNCIL DISTRICTS 4 and 5, Mapsco 80G.
