HomeMy WebLinkAboutOrdinance 24480-10-2020 Ordinance No. 24480-10-2020 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER IMPACT FEE FUND IN THE AMOUNT OF $972,000.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF TRANSFERRING TO THE WATERMASTEWATER WHOLESALE IMPACT FEES PROJECT (CITY PROJECT NO. B20004) AND THE WATER/WASTEWATER RETAIL IMPACT FEES PROJECT (CITY PROJECT NO. B20005); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2020-2021 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Impact Fee Fund in the amount of$972,000.00,from available funds,for the purpose of transferring to the Water/Wastewater Wholesale Impact Fees Project(City Project No. B20004)and the Water/Wastewater Retail Impact Fees Project(City Project No. B20005). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 24446-09-2020 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. DISCUSSION: The purpose of this Mayor and Council Communication(M&C)is to seek approval to acquire a fee simple land interest and a right-of-way easement interest in property located at 1324 Ranchers Legacy Trail for the Westside III Tank and Trans Main project.The property is needed for system reliability and growth improvements within west Fort Worth and its Extraterratorial Jurisdiction which require the installation of a ground storage tank,water pump station,and transmission mains in order to provide reliable water service to existing and proposed developments.In addition to land cost,the City has agreed to participate in the road construction cost to the water tank site for a total of$382,000.00.As part of the agreement,the property owner will construct the road to City standards and the money will be escrowed until the construction of the road is complete. An appraisal of the property was prepared by an independent fee appraiser,and the property owner has agreed to the appraised price of $575,000.00.The real estate taxes will be pro-rated with the Seller being responsible for taxes due up to the closing date.The mineral estate will not be acquired.The deed will contain a surface waiver for the exploration of the mineral estate. Upon City Council approval,staff will proceed with acquiring the fee simple and easement interests in the property except for the mineral estate.
