HomeMy WebLinkAboutOrdinance 24496-10-2020 Ordinance No. 24496-10-2020 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE RED LIGHT ENFORCEMENT PROGRAM FUND IN AN AMOUNT UP TO $2,500,000.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF TRANSFERRING TO THE GENERAL CAPITAL PROJECTS FUND AND REDUCING NET POSITION BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2020-2021 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the RED LIGHT ENFORCEMENT PROGRAM FUND in an amount up to$2,500,000.00,from available funds, for the purpose of transferring to the General Capital Projects Fund and reducing Net Position by the same amount. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be incorporated into the ordinance affecting the budget of the municipal government of the City of Fort Worth for the ensuing Fiscal Year beginning October 1, 2020, and ending September 30, 2021, and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached appropriation ordinance adjusting receipts and appropriations in the Red Light Enforcement Program Fund by increasing receipts and appropriations in the amount up to$2,500,000.00 and reducing Fund Balance by the same amount for the purpose of transferring to the General Capital Projects Fund;and 2. Adopt the attached appropriation ordinance increasing receipts and appropriations in the amount up to$2,500,000.00 in the General Capital Projects Fund transferred from the Red Light Enforcement Program Fund for the Traffic System Maintenance programmable project (City Project No. P00021). DISCUSSION: This Mayor and Council Communication(M&C)is intended to appropriate available fund balance(reserves)in the Red Light Enforcement Program Fund to financially close out the fund as a result of the program being terminated effective June 1,2019 per State of Texas Transportation Code 707.020. The available fund balance(reserves)and previously unapplied revenue receipts will be transferred to the General Capital Projects Fund within the Traffic System Maintenance project(City Project No. P00021),for traffic safety programs, including pedestrian safety programs,public safety programs,intersection improvements and traffic enforcement as allowed in the Transportation Code 707.008(a)(2). The action in this M&C is not included in the FY2021-2025 Capital Improvement Plan(CIP)and will update the existing programmable project in FY2021 of the CIP. A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that funds are currently available within the Red Light Enforcement Program Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinances,funds will be available in the General Capital Projects Fund for the Traffic System Maintenance programmable project. Prior to an expenditure being incurred,the Transportation&Public Works Department has the responsibility of verifying the availability of funds.
