AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE SPECIAL TRUST FUND IN THE AMOUNT OF
$554,004 FROM AVAILABLE FUNDS FOR THE PURPOSE OF TRANSFERRING
FUNDS TO THE GENERAL FUND FOR FISCAL YEAR 2005-2006 ANNUAL
BUILDING SECURITY COSTS; PROVIDING FOR A SEVERABILITY CLAUSE;
MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2006-
2007 in the Budget of the City Manager, there shall also be increased estimated receipts and
appropriations in the Special Trust Fund in the amount of $554,004 from available funds for the
purpose of transferring funds to the General Fund for the Fiscal Year 2005-2006 annual building
security costs.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid,
inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or
judgment shall in no way impair the remaining portions, sections, or parts of sections of this
ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 17142 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance
are in direct conflict with such other ordinances and appropriations, in which instance said
conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Adopt Appropriation Ordinance and Transfer of Funds from the Municipal Court Building Security
Fund to Reimburse the General Fund for FY2005-2006 Building Security Cost
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Special Trust Fund, Municipal Court Building Security Fund by $554,004 from available funds; and
2. Authorize the City Manager to transfer $554,004 from the Municipal Court Building Security Fund to the
General Fund.
DISCUSSION:
The appropriation reimburses the General Fund for expenses associated with salary and departmental
support requirements for 1 Senior Deputy City Marshal and 8 Deputy City Marshal positions dedicated to
building security functions during FY2005-2006.
The Texas Legislature, during the 1995 regular legislative session, adopted an amendment to Article
102.017 of the Code of Criminal Procedure to allow the governing body of a municipality to create, by
ordinance, a Municipal Court Building Security Fund. Defendants convicted in a trial for a misdemeanor
offense in municipal court are required to pay a $3.00 security fee as a cost of the court. On October 10,
1995, Ordinance No. 12204 was approved by City Council to create the Municipal Court Building Security
Fund.
Security fees collected and deposited to the Municipal Court Building Security Fund may only be used for
purposes of providing security services for buildings housing a municipal court. It may include the purchase
of parcel x-ray machines, hand-held and walk-through metal detectors, security personnel providing security
services, and continuing education on security related issues for court and security personnel.
On June 20, 2000, (M&C G-12942) the City Council authorized implementation of the Municipal Court
Building Security Enhancement Plan. It authorized the use of Municipal Court Building Security Fund funds
for staffing dedicated to building security functions. The staffing level was established at 1 Senior Deputy
City Marshal and 8 Deputy City Marshals. The transfer of $554,004 from the Municipal Court Building
Security Fund reimburses the General Fund for FY2005-2006 building security expenses related to these 9
positions.

FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that upon approval of the above recommendations and adoption of the
attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, of
the Special Trust Fund.
