HomeMy WebLinkAboutOrdinance 17789-09-2007Ordinance No. 17789-09-2007 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE CO SPECIAL PROJECT FUND IN THE AMOUNT OF $40,000 FROM THE GENERAL FUND FOR THE PURPOSE OF EXECUTING THE AMENDMENT NO. 2 TO THE ARCHITECTURAL AGREEMENT WITH PERKINS AND WILL FOR THE DESIGN OF THE NASHVILLE NEIGHBORHOOD POLICE STATION AND TRAFFIC DIVISION FACILITY; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2006-2007 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the CO Special Project Fund in the amount of $40,000 from the General funds for the purpose executing Amendment No. 2 to the architectural agreement with Perkins and Will for the design of the Nashville Neighborhood Police Station and Traffic Division Facility SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17142 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the City Manager to execute Amendment No. 2 to the architectural agreement with Perkins and Will in the amount not to exceed $29,000 to provide the design and certification documents for Leadership in Energy and Environmental Design (LEED) certification for the Neighborhood Police Station and Traffic Division Facility located at 1100 Nashville Avenue for the total contract amount of $672,972.00; and 2. Authorize the City Manager to transfer $40,000 from the Police Department General Fund to the CO Special Project Fund; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the CO Special Project Fund by $40,000. DISCUSSION: On August 30, 2005, (M&C C-20926) the City Council authorized the City Manager to execute an architectural design agreement in the amount of $300,000.00 with Perkins and Will to design the Neighborhood Police Station and Traffic Division facility. Funding in the amount of $332,000 was approved from the Crime Control and Prevention District (CCPD) to support design. Additional funding in the amount of $350,000 was approved from the Critical Capital Needs Certificate of Obligation, Series 2007 to complete the design of the Neighborhood Police Station and Traffic Division facility. On July 31, 2007, (M&C C-22276) the City Council authorized the City Manager to execute Amendment No. 1 in the amount of $343,972.00 to the professional services agreement with Perkins and Will. Funds in the amount of $40,000 are needed for Amendment No. 2 and soil boring cost. This amendment is significant because it will produce the first LEED certified design for a municipal building in the City of Fort Worth. This project will set an example for future sustainable development, not just for municipal facilities, but throughout our construction community. The estimated construction cost could potentially increase approximately 2 percent to meet LEED certification standards. The potential increases will be evaluated by staff during the design phase and any cost increase will be funded from project contingency. The additional $11,000.00 is for soil borings/investigation and staff time. Logname: 20PERKINSWILLA2 Page 1 of 2 Once the design is completed and advertised, staff will request the approval of the remainder of the funds for construction, including funds for the design firm's construction administration services. The remainder of the funds has been planned for inclusion in the next sale of the Certificate of Obligation of the Critical Capital Needs Program. The estimated overall cost of the project is: Design $885,000.00 Construction $8, 900, 000.00 ITS, Geotech, Demolition $480,000.00 Contingency, FF&E, staff administration $1,551,000.00 Total $11,816,000.00 The project is located in COUNCIL DISTRICT 8. The completion of the facility will add 30,074 square feet to the City's facility inventory and add approximately $10,000 per year in the facility maintenance and repair requirements. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of the CO Special Project Fund.
