AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE STORM WATER CAPITAL PROJECTS FUND IN
THE AMOUNT OF $510,268 FROM AVAILABLE FUNDS, FOR THE PURPOSE
OF EXECUTING A CONTRACT WITH HUMPHREY & MORTON
CONSTRUCTION COMPANY, INC., FOR 2004 CIP MINOR MISCELLANEOUS
CHANNEL IMPROVEMENTS (CITY PROJECT NO. 00096); PROVIDING FOR A
SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2006-
2007 in the Budget of the City Manager, there shall also be increased estimated receipts and
appropriations in the Storm Water Capital Projects Fund in the amount of $510,268 from available
funds, for the purpose of executing a contract with Humphrey & Morton Construction Company,
Inc., for 2004 CIP Miscellaneous Channel Improvements (City Project No. 00096).
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid,
inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or
judgment shall in no way impair the remaining portions, sections, or parts of sections of this
ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 17142 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance
are in 'direct conflict with such other ordinances and appropriations, in which instance said
conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shgl~take effect upon adoption.

Miscellaneous Channel Improvements, Contract D (Project No. 00096) and Adopt Appropriation
Ordinance
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the City Manager to execute a contract with Humphrey & Morton Construction Company, Inc.,
minor miscellaneous channel improvements;
2. Authorize the transfer of $510,268.00 from the Storm Water Utility Fund to the Storm Water Capital
Projects Fund; and
3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Storm Water Capital Projects Fund in the amount of $510,268.00.
DISCUSSION:
The Storm Water Management Program was established to reduce flooding in Fort Worth, preserve
streams, minimize water pollution and to operate the storm water system in a more effective manner to
fully comply with state and federal regulatory requirements. This will be accomplished by infrastructure
reconstruction and system maintenance, master planning, enhanced development review, and increased
public education and outreach.
On November 2, 2004, (M&C C-20373) the City Manager executed an engineering agreement with DeOtte
Inc., for 2004 CIP Miscellaneous Channel Improvements, Contract D on Arrowwood Channel from Debbie
Street to 200 feet northeast, Mercado Channel from Northeast 20th Street to 250 feet northeast and
Cottonwood Creek from Morrison Drive to Cooks Lane. The engineering agreement was funded from 2004
Capital Improvement Program Minor Drainage funds and the construction will be funded from Storm Water
Utility Funds.
This project was advertised on April 26, 2007 and May 3, 2007. The following bids were received on June
14, 2007:

80 Working Days Specified
Funding in the amount of $42,820.00 is required for construction survey, project management, pre-
construction, material testing, inspection and project close. The contingency fund for possible change
orders for drainage improvements is $22,259.00.
Humphrey & Morton Construction Company, Inc., is in compliance with the City's MMBE Ordinance by
committing to 16 percent M/WBE participation. The City's goal on this project is 6 percent.
This project is located in multiple COUNCIL DISTRICTS.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that upon approval of the above recommendations, and adoption of the
attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of
the Storm Water Capital Project Fund.
