HomeMy WebLinkAboutContract 53150-R1A1 CSC No. 53150-RlA1 FIRST RENEWAL AND FIRST AMENDMENT TO FORT WORTH CITY SECRETARY CONTRACT NO. 53150 This First Renewal and First Amendment to City Secretary Contract No. 53150 ("Amendment") is entered into by and between the City of Fort Worth ("City"), a home rule municipal corporation organized under the laws of the State of Texas, and Washington Lawyers' Committee for Civil Rights and Urban Affairs, Inc., a District of Columbia non-profit corporation ("Consultant"), collectively the "parties." WHEREAS, on December 4, 2019, the parties previously entered into City of Fort Worth City Secretary Contract No. 53150(the"Contract"),for the provision of consultant services related to police interactions with the public; WHEREAS, the parties wish to renew the contract for an additional year and amend certain terms of the Contract concerning compensation. NOW, THEREFORE, Parties, acting herein by the through their duly authorized representatives, enter into the following agreement to renew and amend the Contract: 1. The Parties agree to renew the Contract, under the same terms and conditions unless specifically altered by this Amendment, for an additional one-year term beginning once executed by the parties to this Amendment and ending on September 30, 2021. Section 3, entitled"Compensation", of the Contract is hereby amended to read as follows: City shall pay Consultant$250 per hour for Services rendered under this Agreement. Total compensation under this Agreement may not exceed an aggregate of$120,000.00, including any travel related or other actual expenses. Consultant will submit monthly invoices to the City outlining, on a daily basis, the specific Services provided in the previous month, together with a detailed description of such Services and the amount of time each day spent on such Services. Invoices will be due and payable by the City within 30 calendar days of receipt. Consultant shall not perform any additional services or bill for expenses incurred for City not specified by this Agreement unless City requests and approves in writing the additional costs for such services. The City shall not be liable for any additional expenses of Consultant not specified by this Agreement unless City first approves such expenses in writing. 2. Approve the First Amendment to City Secretary Contract No. 53146 with Del Carmen Consulting, LLC, a Texas limited liability company, for an aggregate total compensation not to exceed $130,000.00; and 2. Approve the First Amendment to City Secretary Contract No. 53150 with Washington Lawyers' Committee for Civil Rights and Urban Affairs, Inc. for an aggregate total compensation not to exceed $120,000.00. DISCUSSION: The City Council approved a resolution on November 19, 2019 authorizing the City Manager to begin a Phase I review of the Fort Worth Police Department to identify patterns and practices related to police interactions with the public during investigative stops, searches, arrests, and use of force incidents. The resolution authorized the City Manager to enter into individual contracts with six national expert consultants with extensive police reform experience. In December 2019, the City Manager finalized the agreements, in an amount not to exceed $100,000.00, with each consulting group or individual. The panel of consultants is in the final stage of its Phase I review. The panel has examined police policies, operational practices, training, documentation, accountability systems, corrective and reporting procedures, and technology applications. The panel had substantial interaction and listening sessions with community members, groups, and police personnel to gain an understanding of the department overall and of the public's perception of the department. A preliminary report was delivered to the city in August and the final report will be completed before the end of the calendar year. To complete the Phase I review and final report, it is necessary to increase the not to exceed amount of the original contracts with two of the consultant groups, Del Carmen Consulting and Washington Lawyers' Committee for Civil Rights and Urban Affairs, Inc. Both contracts will reach the current $100,000.00 limit before completion of the overall work, and any increase in contract spending limits to over$100,000.00 requires City Council approval. Dr. Del Carmen, with Del Carmen Consulting, and Jonathan Smith, with Washington Lawyers' Committee, are the chief scribes for the panel and are instrumental to completing the final report for Phase I. The contract limit with Del Carmen Consulting, LLC will be increased to $130,000.00 and the contract limit with Washington Lawyers' Committee for Civil Rights and Urban Affairs, Inc. will be increased to $120,000.00.
