HomeMy WebLinkAboutOrdinance 17791-09-2007Ordinance No. 17791-09-2007 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE STORM WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $48,116 FROM AVAILABLE FUNDS, FOR THE PURPOSE OF EXECUTING AN ENGINEERING AGREEMENT WITH JAMES DEOTTE ENGINEERING, INC., FOR THE ROLLING HILLS ADDITION DRAINAGE IMPROVEMENTS PROJECT (CITY PROJECT NO. 00704); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2006- 2007 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Storm Water Capital Projects Fund in the amount of $48,116 from available funds,. for the. purpose of executing an_ Engineering Agreement with James DeOtte Engineering, Inc., for the Rolling Hills Addition Drainage Improvements Project (City Project No. 00704). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17142 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the City Manager to execute an engineering agreement with James DeOtte Engineering, Inc., in the amount of $41,840.00 for the Rolling-Hills Addition Drainage Improvements Project; 2. Authorize the transfer of $48,116.00 from the Storm Water Utility Fund to the Storm Water Capital Projects Fund; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Storm Water Capital Projects Fund in the amount of $48,116.00. DISCUSSION: The Storm Water Management Program was established to reduce flooding in Fort Worth, preserve streams, minimize water pollution and to operate the storm water system in a more effective manner to fully comply with state and federal regulatory requirements. This will be accomplished by infrastructure reconstruction and system maintenance, master planning, enhanced development review, and increased public education and outreach. The Rolling Hills Addition has experienced several drainage problems causing home flooding due to undersized storm drainage system and to the layout of the sheets parallel to the hillside contour. The scope of work for this project includes a drainage study that will provide recommendation for the necessary drainage improvements in this area. James DeOtte Engineering, Inc., proposes to perform the necessary work for a lump sum fee of $41,840.00. City Staff considers this to be fair and reasonable for the scope of services proposed. In addition to the contract amount, $6,276.00 is required by the Engineering Department for project management. M/WBE -James DeOtte Engineering, Inc., is in compliance with the City's M/WBE Ordinance by committing to 16 percent M/WBE participation. The City's goal on this project is 15 percent.
