AN ORDINANCE AMENDING CHAPTER 22 "MOTOR
VEHICLES AND TRAFFIC," ARTICLE III "OPERATION
OF VEHICLES," SECTION 22-86 "SPEEDING,"
SUBSECTION (i) OF THE CODE OF THE CITY OF FORT
WORTH, TEXAS (2015), AS AMENDED, TO CHANGE THE
LOCATIONS, EXTENT,AND SPEED LIMITS OF CERTAIN
SPEED ZONES; PROVIDING THAT THIS ORDINANCE
SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES
AND REPEAL CONFLICTING ORDINANCES;
PROVIDING FOR A SAVINGS CLAUSE; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING A PENALTY
CLAUSE; PROVIDING FOR PUBLICATION; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Fort Worth's Transportation and Public Works (TPW)
Department routinely reviews the speed limits in the Code of the City of Fort Worth,Texas(2015),
as amended, ("City Code") in order to make corrections, additions or amendments, where
appropriate;
WHEREAS, the TPW Department desires to amend the speed zone tables included in the
City Code to provide for adjustments as a result of development and to make text, speed limit, and
block range corrections;
WHEREAS, City staff completed speed surveys (engineering and traffic investigations),
which took into consideration the width and condition of the pavement, other circumstances on
that portion of roadway, and the usual traffic on it, to show that any prima facie speed limit set by
statute is greater or less than is reasonable or safe under the conditions found to exist at any
intersection or on any part of the roadway system under the City's jurisdiction;
WHEREAS,the Texas Transportation Code Section 545.356 specifies the procedures for
a municipality to set speed zones and to post speed limits; and
WHEREAS, this ordinance incorporates the above recommendations and amends the
Speed Zone Tables of Chapter 22 "Motor Vehicles and Traffic," Article III "Operation of
Vehicles," Section 22-86 "Speeding," Subsection (i) of the City Code as recommended by the
TPW Department;
NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH,TEXAS,THAT:

SECTION 1.
Chapter 22"Motor Vehicles and Traffic,"Article III"Operation of Vehicles,"Section 22-86
"Speeding,"Subsection(i)of the Code of the City of Fort Worth,Texas(2015),as amended,is hereby
amended as indicated:

SECTION 2.
This ordinance shall be cumulative of all provisions of ordinances of the Code of the City of
Fort Worth, Texas, (2015), as amended, except where the provisions of this ordinance are in direct
conflict with the provisions of such ordinances and such Code, in which event conflicting provisions
of such ordinances and such Code are herebyrepealed.
SECTION 3.
It is hereby declared to be the intention of the City Council that the phrases,clauses,sentences,
paragraphs and sections of this ordinance are severable,and,if any phrase,clause,sentence,paragraph
or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any
court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases,
clauses,sentences,paragraphs and sections of this ordinance,since the same would have been enacted
by the City Council without the incorporation in this ordinance of any such unconstitutional phrase,
clause, sentence,paragraph or section.
SECTION 4.
All rights and remedies of the City of Fort Worth,Texas,are expressly saved as to any and all
violations of the provisions of the Code of the City of Fort Worth,or any other ordinances of the City,
that have accrued at the time of the effective date of this ordinance;and,as to such accrued violations
and all pending litigation, both civil and criminal, whether pending in court or not, under such
ordinances,same shall not be affected by this ordinance,but may be prosecuted until final disposition
by the courts.

Section 22-86,Subsections (i)Speeding
SECTION 5.
Any person who violates,disobeys,omits, neglects,or refuses to comply with or who resists
the enforcement of any of the provisions of this ordinance shall be fined an amount not exceeding two
hundred dollars($200.00)for each offense.
SECTION 6.
The City Secretary of the City of Fort Worth,Texas is hereby directed to publish the caption,
penalty clause and effective date of this ordinance for two (2) days in the official newspaper of the
City of Fort Worth, Texas,as authorized by Texas Local Government Code,Section 52.013.
SECTION 7.
All other provisions of Chapter 22 of the Code of the City of Fort Worth, Texas, (2015), as
amended,shall remain in full force and effect, save and except as amended by this ordinance.
SECTION 8.
This ordinance shall take effect upon adoption and publication as required by law,and it is so
ordained.

a New Speed Limit of 35 Miles per Hour Along Hemphill Street from West Vickery Boulevard to West Felix Street
RECOMMENDATION:
It is recommended that the City Council adopt the attached ordinance amending Chapter 22 Motor Vehicles and Traffic,Article III Operation of
Vehicles,Section 22-86 Speeding,Subsection(i)of the Code of the City of Fort Worth,Texas(2015),as amended,to add the speed limits of
certain speed zones,specifically a new speed limit of 35 miles per hour along Hemphill Street from West Vickery Boulevard to West Felix
Street.
DISCUSSION:
In collaboration with the Hemphill Corridor Task Force and Near Southside Inc.,the City is working to balance multimodal transportation safety,
better respond to the community needs to calm traffic along Hemphill and make the street more pedestrian and bicycle friendly.
The purpose of this Mayor and Council Communication (M&C)is to amend the City Code of Ordinances to reflect a 35 miles per hour(mph)
posted speed along Hemphill Street from West Vickery Boulevard to West Felix Street.The current posted speed limit is 40 mph.This change is
needed to align the City Ordinance with the 35 mph design speed of the recently implemented Hemphill Complete Streets project. School Zone
speed limits found in Chapter 22 Motor Vehicles and Traffic,Article III Operation of Vehicles,Section 22-86 Speeding,Subsection(h)of the Code
of the City of Fort Worth,Texas(2015),as amended,shall not be affected.
The complete streets project transformed Hemphill from a five-lane roadway to one through lane in each direction with a center left-turn lane,on-
street parking,and bike lanes in both directions.The Transportation and Public Works Department commenced striping on Hemphill May 2020
and the project was completed July 2020.
On November 13,2018,an Informal Report was presented to City Council to inform them of the proposed lane configuration change.
This change to the ordinance serves COUNCIL DISTRICT 9.
A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity.
