AN ORDINANCE AMENDING ORDINANCE NO. 17717-08-2007
ORDERING A SPECIAL ELECTION TO BE HELD IN THE CITY
OF FORT WORTH, TEXAS, ON TUESDAY THE 6T" DAY OF
NOVEMBER, 2007, FOR THE PURPOSE OF ELECTING A CITY
COUNCIL MEMBER FOR CITY COUNCIL DISTRICT 9 TO
SERVE THE REMAINDER OF AN UNEXPIRED TERM.
WHEREAS, the City Council adopted Ordinance No. 17717-08-2007 on
August 21, 2007 for the purpose of electing a City Council member for City
Council District 9 to Serve the Remainder of an Unexpired Term; and
WHEREAS, the City desires to change and add early voting locations;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
In compliance with the Charter of the City of Fort Worth and in accordance
with the Constitution and laws of the State of Texas, the City Council hereby
orders that a special election be held on Tuesday, November 6, 2007, at which
all qualified voters of City Council District 9 may vote for the purpose of electing a
council member from District 9 to serve the remainder of an unexpired term until
the regular City Council election in May 2009.
SECTION 2.
Candidates may file an application for a place on the special election
ballot commencing upon August 22, 2007, in the City Secretary's Office, located
in the Municipal Building, 1000 Throckmorton, Fort Worth, Texas. The filing
deadline is 5 p.m. on August 31, 2007.

SECTION 3.
In the event there are two or more candidates for the unexpired term of
Council Member, Place 9, the order in which the names of such candidates are
to be printed on the ballot shall be determined by a drawing to be conducted by
the City Secretary; that three (3) days prior to the date on which the drawing is to
be held, the City Secretary shall post a notice in the City Hall of the time and
place of the drawing and to any candidate who makes written request therefore
and furnishes to the City Secretary aself-addressed stamped envelope; and that
each candidate involved in the drawing or a representative designated by him or
her shall have a right to be present and observe the drawing.
SECTION 4.
(a) Steve Raborn, Tarrant County Elections Administrator, shall serve
as the early voting clerk. Mr. Raborn's official mailing address is:

(b) Marty Hendrix, City Secretary of the City of Fort Worth, shall serve
as chief deputy early voting clerk.
(c) Applications for ballots by mail shall be mailed to Steve Raborn at
the address set out in subsection (a). Applications for ballot by mail
may be submitted beginning September 7, 2007 and must be
received no later than the close of business on October 30, 2007.

SECTION 5.
Early voting by personal appearance of Fort Worth Residents shall be
conducted beginning October 22, 2007, and continuing through November 2,
2007. A voter entitled to vote an early ballot by personal appearance may vote at
any of the following locations:

Section 6.
(a) An electronic voting system, as defined in Chapter 121 of the Texas
Election Code, shall be used for voting at the regular polling places at said
election and for counting the ballots and the tabulation of the results. The
conduct of the election and the use of the electronic voting system shall be
in accordance with the Texas Election Code.

(b) The Office of the Tarrant County Elections Administrator, Tarrant County
Courthouse, 2700 Premier, Fort Worth, Texas, is hereby established as
the Central Counting Station for the ballots cast in said election.
(c) An individual, having knowledge and experience in the conduct of
elections with the electronic voting system for which the Central Counting
Station is established, and being a registered voter of the City of Fort
Worth, shall be appointed by Tarrant County as the Manager of the
Central Counting Station. The Manager shall be in charge of overall
administration of the Central Counting Station and the general supervision
of the personnel working at the Station.
(d) Individuals trained in the operation of the automatic tabulating equipment
installed at the Central Counting Station, shall be appointed by Tarrant
County as Tabulation Supervisors. The Tabulation Supervisors shall be in
charge of the operation of the automatic tabulating equipment.
(e) An individual shall be appointed by Tarrant County as Assistant to the
Tabulation Supervisor. Such assistant shall assist the Tabulation
Supervisor in the operation of the automatic tabulating equipment as
directed by the Tabulation Supervisor.
(f) An individual shall be appointed by Tarrant County as Presiding Judge of
the Central Counting Station. He shall maintain order at the Central
Counting Station and shall have such authority as may be prescribed by
the Texas Election Code.

(g) The election day polling places shall be kept open on November 6, 2007,
from 7:00 a.m. to 7:00 p.m., and that due return shall be made to the City
Council showing the number of votes cast for the office of Fort Worth City
Council, Place 9.
(h) The locations of the polling places for the election, except insofar as they
may be changed by the City Council, are set forth on Exhibit "A" attached
hereto and made a part hereof.
SECTION 7.
That the Tarrant County Elections Administrator shall be responsible for
conducting the election and shall furnish the election officials said ballots and
voting equipment, together with any other forms, blanks or instruction in
accordance with the laws of the State of Texas, insofar as same are applicable,
and with the provisions of this ordinance.
SECTION 8.
Any candidate receiving a majority of all the votes cast for the office for
which he or she is a candidate shall be elected to such office. In the event of a
tie or in the event that no candidate receives a majority of all votes cast for the
office sought, the Mayor, on the first day after the completion of the official
tabulation and canvass of the returns, shall issue a call, proclamation and notice
for a second election, as required by law, to be held on December 8, 2007, to fill
that place, at such second election, the two candidates receiving the highest
number of votes for any such office or offices, as the case may be, in the first
election, at which no one was elected by receiving a majority of all votes cast for

all candidates for such office or offices, shall be printed on the ballot and shall
again be voted for.
SECTION 9.
This ordinance shall constitute the proclamation, call, notice and
ordinance calling and ordering said elections.
SECTION 10.
That notice of said elections shall be given by: (1) publishing a Notice of
Special Election, in English and in Spanish, at least once, not earlier than the 30tH
day or later than the 10th day before election day in a newspaper published in
said City; and (2) not later than the 21St day before election day, posting a Notice
of Special Election, in English and in Spanish, on the City's board used for
posting notices of the meeting of the Fort Worth City Council.
SECTION 11.
That the way and manner of holding said elections, the notice to be given
therefore, the polling places, the personnel and the officers who are to hold
same, and all details connected with the holding of the elections shall be
provided for and arranged by the City Secretary; that the proper notice and
publication of this notice, proclamation and ordinance shall be only cumulative of
and in addition to the statutory notice of said elections as herein provided; and
that any omission or irregularity in this notice or in the publication or posting of
this notice, proclamation and ordinance, or in the signing of same, shall not in
any way affect or invalidate such election.

SECTION 12.
That in all respects, said elections shall be conducted in accordance with
the Texas Election Code and the City Charter of the City of Fort Worth.
SECTION 13.
That it is hereby officially found and determined that the meeting at which
this ordinance was adopted and said elections were called was open to the
public and public notice of the time, place and purpose of said meeting was
given, all as required by Chapter 551 of the Texas Government Code.
SECTION 14.
That this ordinance, election order, proclamation and notice shall take
effect upon adoption.
