AN ORDINANCE VACATING, ABANDONING AND
EXTINGUISHING ALL OF A PUBLIC ACCESS EASEMENT AND
A PORTION OF AN ALLEY LOCATED RESPECTIVELY IN THE
S.G. JENNINGS SURVEY, ABSTRACT NO. 844, COOK
CHILDREN'S MEDICAL CENTER AND BLOCK 8, GRANDVIEW
ADDITION, ADDITIONS TO THE CITY OF FORT WORTH,
TARRANT COUNTY, TEXAS, AS RECORDED IN COUNTY
CLERK'S DOCUMENT NO. D220060987 AND VOLUME 63, PAGE
29, REAL PROPERTY RECORDS, TARRANT COUNTY, TEXAS,
AND RESPECTIVELY CONTAINING APPROXIMATELY 3,248
SQUARE FEET OR 0.074 AND 562 SQURE FEET OR 0.012 ACRES
OF LAND; PROVIDING FOR REVERSION OF FEE IN SAID
LAND; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH,TEXAS:
SECTION 1.
1. That all of a public access easement situated in the S.G. Overton Survey,
Abstract No. 844, located in the Cook Children's Medical Center Addition, an
addition to the City of Fort Worth, Tarrant County, Texas, as recorded in
County Clerk's Document No. D220060987, Plat Records, Tarrant County,
Texas, and containing approximately 3,248 square feet or 0.074 acres of land,
and as more specifically described in Exhibits "A -public access easement",
attached hereto and incorporated herein by reference, be and the same is
vacated, abandoned and extinguished.
2. That a portion of a ten foot wide alley situated in the S.G. Overton Survey,
Abstract No. 844, located in Block 8, Grandview Addition, an addition to the
City of Fort Worth, Tarrant County, Texas, as recorded in County Clerk's
Volume 63, Page 29, Plat Records, Tarrant County, Texas, and containing
VA-20-010 and VA-20-015 PAE&Alley Ordinance No.24578-12-2020

approximately 562 square feet or 0.012 acres of land, and as more specifically
described in Exhibits "A —public alley right-of-way easement", attached
hereto and incorporated herein by reference, be and the same is vacated,
abandoned and extinguished.
SECTION 2.
That the easements to the land in the above-described vacated public access
easement and public alley right of way are hereby released and shall revert to the adjacent
owner as provided by law.
SECTION 3.
That all existing utility easements shall be retained by the City until such time all
utilities located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby
repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

BEING a tract of land situated in the S.G. Jennings Survey, Abstract No. 844, City of Fort Worth, Tarrant
County, Texas, being a portion of that variable width Public Access Easement as shown on the plat for Cook
Children's Medical Center Addition, an Addition to the City of Fort Worth, according to the plat recorded in
County Clerk's Document Number D220060987, Plat Records, Tarrant County, Texas, said tract of land being
more particularly described by metes and bounds as follows:
BEGINNING at a point in the in the east right—of—way line of 8th Avenue (a variable width right—of—way),
the new northwest corner of Lot 1, Block 8, Grandview Addition, an Addition to the City of Fort Worth
according to the plat recorded in Volume 63, Page 29, Plat Records, Tarrant County, Texas, and in a west

(CD 9)Adopt Ordinance Vacating a Portion of an Alley in Block 8,Grandview Addition and a Portion of a Public Access Easement in Block 1,
Cook Children's Medical Center Addition to be Replatted with the Adjoining Property for a New Parking Garage and Hospital Expansion
RECOMMENDATION:
It is recommended that the City Council:
1.Adopt the attached ordinance vacating a portion of an alley in Block 8,Grandview Addition and a portion of a public access easement in Block
1,Cook Children's Medical Center Addition to be replatted with the adjoining property for a new parking garage and hospital expansion;and
2.Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Dunaway Associates,on behalf of Cook Children's Medical Center,has requested vacation of a portion of this alley and public access
easement to be replatted with the adjoining property for a new parking garage and hospital expansion.The City Plan Commission recommended
approval of these requests at its meetings on August 26,2020 and October 14,2020.An acceptable final plat(FS-20-201)has been received in
accordance with the Subdivision Ordinance.
The City of Fort Worth(City)originally obtained the above mentioned right-of-way through plat dedication.The City does not own any fee interest in
the rights-of-way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way easement.In
accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6,2007,Mayor and
Council Communication(M&C G-15624),staff recommends waiving the fair market value or any portion thereof of purchase price of this right-of-
way easement for the alley or the public access easement.
This project is located in COUNCIL DISTRICT 9.
A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on City funds.
