AMENDMENT No.3 CONYMM�
TO CITY SECRETARY CONTRACT
WHEREAiS, the City of Fort Worth (CITY) and Freese and Nichols,
Inc. , (ENGINEER) made and entered into City Secretary Contract No.
39090, (the CONTRACT) which was authorized by M&C C-23714 on the 11t'
day of August, 2009 in the amount of $840,000 . 00; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment
Number 1 in the amount of $49,550. 00 which was administratively
authorized on April 5, 2012, Amendment No. 2 in the amount of
$343,881 . 00 which was authorized by M&C C-26437 on July 24, 2012 ;
and
WHEREAS, the CONTRACT involves engineering services for the
following project:
Design of Eastside Pump Station and general construction
representation for fifty-four inch Eastside II Water Main; and
WHEREAS, it has become necessary to execute Amendment No. 3
to the CONTRACT to include an increased scope of work and revised
fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and
through their duly authorized representatives, enter into the
following agreement, which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated July 24, 2013, a
copy of which is attached hereto and incorporated herein. The cost
to City for the additional design services to be performed by
Engineer totals $262,582 . 00.
2 .
Article II of the CONTRACT is amended to provide for an
increase in the fee to be paid to Engineer for all work and services
performed under the Contract, as amended, so that the total fee paid
by the City for all work and be an amount of

All other provisions of the Contract, which are not expressly
amended herein, shall remain in full force and effect.

Dear Ms.Schwinger:
This letter describes scope and fee for the remaining and additional engineering services for
preparing the Preliminary Design Report for the East Side Pump Station,Construction
Management Assistance for Phase I and III of the East Side 54" Water Main, design of the water
and sewer lines along Avenue B, and design of the East Side Pump Station Suction Header.
1. East Side Pump Station Preliminary Design Report
In August 2010, FNI provided the City with a Preliminary Design Report for the East Side Pump
Station. The original scope of work was for a technical memo with a preliminary pump station
floor plan and site plan to fit within the existing site. The City had asked FNI to perform a site
study to evaluate using the existing site,the site just west of the existing pump station and the
site just north of the pump station. FNI prepared a draft Preliminary Design Report including
the site study and Electrical and SCADA preliminary design.
2. Construction Phase Management Assistance
The City requested that FNI provide part-time Construction Management Assistance for the
construction of Phase I and III of the East Side 54"Water Main in November 2012.
3. Design of Water and Sewer lines along Avenue 8
During the construction of the East Side Pump Station Discharge Header it was discovered that
the 36"water line in Avenue B does not match the record drawings from 2006. The old cast
iron tees connecting to the existing pump station discharge header were not replaced as shown
on the record drawings. The City asked FNI to design the replacement of these tees and to
realign about 110 feet of 36"water line. The realignment of the 36" water line moved the 36"
water line further away from the proposed 54"water line. In order to realign the 36"water line
the existing sewer line needed to be lowered to meet TCEQ requirements. FNI provided the

redesign of 300 feet of 8" Sewer line along Avenue B. In addition to this redesign,the City
requested design to replace 140 feet of sewer line at the apartment complex east of the East
Side Pump Station.
Also during the construction of the East Side Pump Station it was discovered that the water
service lines to the apartments east of the pump station were connected to the discharge
header and not the 36"water line in Avenue B. The City asked FNI to design a new 8"water
main to serve the apartment service lines. The City requested that this proposed 8"water line
connect to two water transmission lines, so that if one transmission line is shut-down for
maintenance the apartment complex would still have water service. FNI designed an additional
360 feet of 8"water line.
4. East Side Pump Station Suction Header.
The City decided to postpone the construction of the new East Side Pump Station for another
10 years or more and is working on the design to rehabilitate the existing pump station. The
City has asked FNI to provide a design to replace the existing suction header with a new 42"
header,pump suction pipe, and to replace approximately 200 feet of 24"water line in Avenue
B. The City will make the electrical and equipment improvements utilizing city forces.
6.Special Services Deductions
There is remaining budget that will not be utilized for the following special services:Subsurface
Utility Engineering(SUE), Public Involvement for the Pump Station, Coordination Meetings with
TRVA, Environmental Permitting,Geotechnical Engineering, Corrosion Engineering,
Environmental Information Document,Surveying(including easement documents), and Plating
the East Side Pump Station Site. Contract fees for these services will be applied to the
additional services and remaining construction phase effort.
SCOPE OF SERVICES
BASIC SERVICES
FNI shall render the following professional services in connection with the development of the
Project:
A. East Side Pump Station Preliminary Design Report: In August 2010 FNI provided the City
with a Preliminary Design Report for the East Side Pump Station. Evaluated two additional
sites for the pump station that were not in the original scope of work. Evaluate
construction sequencing to improve the existing pump station site to allow utilization of one
half of the old and new pump station during construction to allow partial utilization. The
Preliminary Design Report included a site study and Electrical and SCADA preliminary
design.
B. Design of Water and Sewer Lines alone Avenue B: FNI designed an additional 110 feet of 36"
water line along Avenue B. FNI also design an additional 360 feet of 8" water line to provide

a distribution main to serve the apartment complex. FNI provided the redesign of 300 feet
of 8" Sewer line and design to replace 140 feet of sewer line at the apartment complex east
of the East Side Pump Station by pipe-enlargement or cured in place liner.
FNI submitted draft plans on March 18, 2013. The March 18, 2013 submittal included the
design the 8" water line to connect the water transmission mains on Avenue A and Avenue
B. After this submittal the City requested to change the draft design to connect the 8"
water line to the existing 36"water transmission main in Beach Street in-lieu of connection
to the main in Avenue A.
FNI submitted revised draft plans on April 10, 2013 based on comments FNI received at the
meeting on April 4, 2013 including the realignment of the 8"water line.
FNI submitted revised plans on April 18, 2013 per the comments received on April 17, 2013.
FNI met with Fort Worth Water Department on April 30, 2013 to review the plans. At the
meeting FNI was asked to extend the sewer line design to include replacing the sewer line
at the apartment complex by means of pipe enlargement or cured in place liner.
FNI submitted a final draft on May 3, 2013 which included the additional sewer line
replacement at the apartment complex. FNI received comments on May 8, 2013 to remove
the sewer line and to submittal final drawings to the City. FNI submitted final plans on May
9, 2013.
C. Design of East Side Pump Station Suction Header: FNI will provide a design to replace the
existing suction header with a new 42" header, and to replace approximately 200 feet of
24"water line in Avenue B. The Opinion of Probable Construction Cost for these
improvements is$591,400.
a. FNI will provide design submittals at the design points of 60%and 90%. FNI will have
one review meeting with the city for each submittal.
b. FNI will provide construction phase services in accordance with the scope in the
original contract for an additional construction phase for Phase 5 with the exception
that the number of site visits will be limited to 4 site visits for Phase 5.
D. Remaining Construction Phase: Contract fees for these services will be applied to the
additional services and remaining construction phase effort.
SPECIAL SERVICES
A. Construction Management Assistance : FNI shall provide services of Senior Resident Project
Representative(Ted Gay) for 20 hours per week for 11 months during the construction of
Phase I and Phase III of the 54" Water Main Project.

B. Subsurface Utility Engineering for Pump Station Suction Header: FNI will retain and monitor
efforts of a subsurface utility engineering firm (The Rios Group)to provide Quality Level B
Subsurface Utility Engineering along the 24"water line (approximately 200 feet) and along
the suction header. Using the proposed piping design and utility designation, propose a
plan for(up to six)test holes at critical areas. At these locations, utilize non-destructive
vacuum excavations to locate the horizontal location and vertical depth of the utility.
C. Survey for Pump Station Suction Header: FNI will retain and monitor efforts of a surveying
firm (Pacheco Koch)to provide a topographic survey the area of the pump station site
where the discharge heard will be replaced.
SPECIAL SERVICES DEDUCTIONS
There is remaining budget for the follow special services that are no long required by the
project:
A. Subsurface Utility Engineering: There Is budget remaining in the SUE task for the pipeline
project that will not be used.
B. Public Involvement: Remove the public meeting for the pump station project now that a
new pump station will not be construction in the near future.
C. Coordination Meetings with TRAV: There is budget remaining in this task for the pipeline
project that will not be used.
D. Environmental Permitting: There is budget remaining in in the Environmental Permitting
task for the pipeline project that will not be used.
E. Geotechnical Engineering: There is budget remaining in the Geotechnical Engineering task
for the pipeline project that will not be used.
F. Corrosion Engineering: There is budget remaining in the Corrosion Engineering task for the
pipeline project that will not be used.
G. Environmental Information Documents: This budget remaining in this task for the pipeline
project that will not be used.
H. Survey:There is budget remaining in the surveying task for easements and the survey for
future pump station site and Vickery that will not be used for this project.
I. Platting the ESPS Site: This task item is being removed from the scope of the project.

Representation for Fifty-Four Inch Eastside II Water Main (COUNCIL DISTRICT 8)
RECOMMENDATION:
It is recommended that the City Council authorize the execution of Amendment No. 3 in the amount
of$262,582.00 to City Secretary Contract No. 39090 with Freese and Nichols, Inc., for design of
Eastside Pump Station and general construction representation for fifty-four inch Eastside II Water
Main, thereby increasing the contract amount to $1,496,013.00.
DISCUSSION:
A Water Master Plan prepared by Freese and Nichols, Inc., in May 2005 identified the need to
increase the capacity of the Eastside Pump Station (ESPS) to meet projected future water
demand. A subsequent study determined a 54-inch Eastside II water transmission main should be
constructed to provide supplemental capacity for the existing 42-inch water main. This will satisfy the
projected water demand from wholesale customers and also the northern portion of the Eastside
Pressure Plane.
On August 11, 2009, (M8C C-23714) the City Council authorized an Engineering Agreement with
Freese and Nichols, Inc., in the amount of$840,000.00 to perform preliminary design for the Eastside
Pump Station and preliminary/final design and general construction representation for the 54-inch
Eastside II Water Main.
The Agreement was subsequently revised by two amendments totaling $393,431.00 that are further
described as follows: Amendment No. 1: $49,550.00; administratively approved by the City Manager
on April 5, 2012 and Amendment No. 2: $343,881.00; M8C C-25766, July 24, 2012.
To expedite construction, the project was divided into the following three phases:
Phase 1 - 54-inch water main from Scott Avenue, north to the connection to the existing 36-inch and
42-inch water mains north of the West Fork Trinity River.
Phase 2 - New Eastside Pump Station and associated distribution piping in the vicinity of the pump
station site.
Phase 3 - 54-inch water main from Scott Avenue to the Eastside Pump Station site.
Amendment No. 3 will provide compensation for the following additional services that are necessary
on the project:
East Side Pump Station preliminary design report as requested by the City for site evaluation and
SCADA preliminary design.
Design of water and sanitary sewer mains on Avenue B to replace the deteriorated mains that were
encountered during construction.
Suction header design for the East Side Pump Station to include a new 42-inch header, pump
suction pipe and replacement of a segment of 24-inch water main in Avenue B.

Construction phase management assistance for construction of phases 1 and 3.
Freese and Nichols, Inc., proposes to provide the necessary additional work for a lump sum fee of
$262,582.00. Staff considers this amount to be fair and reasonable.
M/WBE Office -A waiver of the M/WBE goal was granted for this Amendment No. 3 because the
design of the project is 92 percent complete with virtually no subcontracting opportunities available.
This project is located in COUNCIL DISTRICT 8, Mapsco 64W, 78A, and 78E.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that funds are available in the current capital
budget, as appropriated, of the Water Capital Projects fund.
