TO CITY SECRETARY CONTRACT WHEREAS, the City of Fort Worth (CITY) and Freese and Nichols, Inc. , (ENGINEER) made and entered into City Secretary Contract No. 39090, (the CONTRACT) which was authorized by M&C C-23714 on the 11t' day of August, 2009 in the amount of $840,000.00; and WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 1 in the amount of $49,550 .00 which was administratively authorized on April 5, 2012, Amendment No. 2 in the amount of $343,881 .00 which was authorized by M&C C-26437 on July 24, 2012, Amendement No. 3 in the amount of $262,582.00 which was authorized by M&C C-26437 on September 17, 2013; and WHEREAS, the CONTRACT involves engineering services for the following project: Design of Eastside Pump Station and general construction representation for fifty-four inch Eastside II Water Main; and WHEREAlS, it has become necessary to execute Amendment No. 4 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated April 25, 2014, a m copy of which is attached hereto and incorporated herein. The cost M m to the City for the additional design services to be performed by C rr: Engineer totals $24,603.00 . 2 . c Article II of the CONTRACT is revised to correct an error found tv --I in the original Amendment 4 to now provide, by letter dated June 17, 2014, for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, asEamendeso that the CORDTARY Page -1- ITX total fee paid by the City for all work and services shall be an revised amount of $1,520,616.00. 3. All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. EXECUTED and EFFECTIVE as of the date last written by a signatory, below. Project Manager City of Fort Worth Water Department 311 W. 10th Street Fort Worth,TX 76102-6311 Re: Additional Engineering Services (Amendment No.4)for East Side Pump Station Improvements, Project Number 00369 Dear Mr.Sholola: This letter includes scope and fee for the design of approximately 1,150 feet of new 16" water line along Chicago Avenue from Rosedale Street to Hawlet Street. SCOPE OF SERVICES BASIC SERVICES The summary of work for the design of the new 16" water line includes the following: • Site visit to review survey and existing improvements. • Prepare railroad crossing permit for the City to submit to Union Pacific Railroad. • Prepare design drawings to be issued in a change order. One 60%design level will be sent to the City for review. FNI will meet with the City to review the design. The drawings include: o Revise the Water Location Map Sheet o Revise the Water Abandonment Sheet o Three plan and profile sheets. o Prepare additional detail sheets if needed. SPECIAL SERVICES A. SURVEYING: FNI will retain and monitor the efforts of a surveying firm (Gorrondona & Associates, Inc.)to provide the following services: Mr.Sholola April 25,2014 Page 2 of 2 Provide topographic design survey for approximately 1,200 feet along Chicago Avenue from Rosedale Street to Hawlet Street. The survey width will be the full Right-Of-Way width of Chicago Avenue. FEE COMPENSATION A summary of the additional costs are shown in the table below. Special Services are on a not to exceed basis.
