AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF
LINDEN AVENUE SITUATED IN THE THOMAS WHITE SURVEY,
ABSTRACT NO. 1636, LOCATED IN THE CITY OF FORT WORTH,
TARRANT COUNTY, TEXAS; AS RECORDED IN VOLUME 1843, PAGE
538, OF THE DEED RECORDS OF TARRANT COUNTY, TEXAS;
CONTAINING APPROXIMATELY 16,865 SQUARE FEET OR 0.3872
ACRES OF LAND, PROVIDING FOR REVERSION OF FEE IN SAID
LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING
UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of Linden Avenue, situated in the Thomas White Survey, Abstract Number
1636, located in the City of Fort Worth, Tarrant County, Texas, as recorded in Volume 1843,
Page 538, of the Deed Records of Tarrant County, Texas, and containing approximately 16,865
square feet or 0.3872 acres of land more or less, and as more specifically described in Exhibits
"A" and `B" attached hereto and incorporated herein by reference be and the same is vacated
and extinguished.
SECTION 2.
That the easement to the land in the above - described vacated street right of way is hereby
released and shall revert to the adjacent owner as provided by law.

SECTION 3.
All existing utility easement be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

LINDEN AVENUE VACATION DESCRIPTION
BEING a 0.3872 acre tract of land situated in the Thomas White Survey, Abstract Number 1636, located in
the City of Fort Worth, Tarrant County, Texas, being part of the tract of land described in dedication of
street, recorded in Volume 1843, Page 538 of the Deed Records of Tarrant County, Texas, (D.R.T.C.T.), said
0.3872 acre tract being more particularly described as follows;
COMMENCING at a found 5/8 —inch iron rod for the most northerly northeast corner of Lot 1R, Block 1 of
the Credit Union Addition, an addition to the City of Fort Worth as recorded in Document Number
D203450608 of the Official Public Records of Tarrant County, Texas (O.P.R.T.C.T.), said corner being on the
south line of a tract of land described in deed to Event Facilities Fort Worth, Inc., recorded in Document
Number D20343188 O.P.R.T.C.T.;
THENCE South 89 degrees 30 minutes 36 seconds West, along the common line between said Event Facilities
tract and said Lot 1R, a distance of 343.80 feet to a found 5/8 —inch iron rod at the common west corner
thereof, said corner being on the east right —of —way line Montgomery Street (variable width);
THENCE North 00 degrees 58 minutes 17 seconds West along the east right —of —way line of Montgomery
Street a distance of 125.00 feet to the POINT OF BEGINNING at the northwest corner of said Event Facilities
tract, said corner being at the intersection of east right —of —way line of Montgomery street and the south
right —of —way line of Linden Avenue (50' width);
THENCE North 00 degrees 29 minutes 24 seconds West continuing along the east right —of —way line of
Montgomery Street a distance of 60.00 feet to a point for corner at the western most southwest corner of
Lot 1 Block 1 of the Rita Gunn Subdivision, a subdivision to the City of Fort Worth as recorded In Document
Number D21 01 6 5 2 30 O.P.R.T.C.T., said corner being at the intersection of the east right —of —way line of
Montgomery Street and the north right —of —way line of Linden Avenue;
THENCE South 45 degrees 29 minutes 24 seconds East along the north right —of —way line of Linden Avenue
a distance of 14.14 feet to a point for corner at the southern most southwest corner of Lot 1;
THENCE North 89 degrees 30 minutes 36 seconds East continuing along the north right —of —way line of
Linden Avenue a distance of 326.31 feet to the southern most southeast corner of Lot 1 and the southwest
corner of Lot 2, Block 1 of said Rita Gunn Subdivision;
THENCE South 00 degrees 29 minutes 24 seconds East departing the north right —of —way line of Linden
Avenue a distance of 50.00 feet to the south right —of —way line of Linden Avenue to a point for corner,
from which a found 5/8 —inch iron rod bears North 89 degrees 30 minutes 36 seconds East a distance of

SUBJECT:
Adopt Ordinance Vacating a Portion of Linden Avenue Between Montgomery Street and Trail Drive Within
the Boundary of the Will Rogers Memorial Center (COUNCIL DISTRICT 7)
RECOMMENDATION:
It is recommended by the City Plan Commission that the City Council:
1. Adopt the attached ordinance vacating a portion of Linden Avenue between Montgomery Street and
Trail Drive within the boundary of the Will Rogers Memorial Center; and
2. Waive any and all purchase fee value of the vacated land in accordance with City Policy, M &C G-
15624.
DISCUSSION:
Dunaway Associates, LP, on behalf of Event Facilities Fort Worth, Inc., has requested the vacation of this
right -of -way to replat it with the adjoining property for a future parking lot. The City Plan Commission
recommended approval of this request at its meeting on February 22, 2012. An acceptable replat (FP -012-
028) has been received. The replat will include a new segment of Linden Avenue that will be dedicated to
the east intersecting with Trail Drive providing public access to the existing cell tower lot platted along
Linden Avenue.
The City of Fort Worth (City) originally obtained the above mentioned right -of -way through the platting
process. The City does not own land under or adjacent to the above referenced street. Since no City funds
have been expended to purchase property or easement rights, collection of the fair market value or any
portion thereof is recommended by Staff to be waived.
This project is located in COUNCIL DISTRICT 7.
