HENDERSON SURVEY, ABSTRACT NO. 596, OF THE CITY OF FORT WORTH, DENTON COUNTY, TEXAS; AS RECORDED IN THE REAL PROPERTY RECORDS OF DENTON COUNTY, TEXAS AND CONTAINING APPROXIMATELY 93,393 SQUARE FEET OR 2.144 ACRES OF LAND ACRE OF LAND MORE OR LESS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That portions of the right-of-way of Elizabethtown Cemetery Road, an apparent prescriptive public street with variable width, situated in the A. Henderson Survey, Abstract No. 596 of the City of Fort Worth, Denton County, Texas; as recorded in Instrument No. 2019- 124236 in the Real Property Records of Denton County, Texas, and containing 2.144 acres or 93,393 square feet more or less, and as more specifically described in Exhibits "A" and "B" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That the easement to the land in the above-described vacated street right of way is hereby released and shall revert to the adjacent owner as provided by law. All existing utility easements be shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. SECTION 4. DISCUSSION: Peloton Land Solutions,on behalf of Alliance Center North No.5 LTD,has requested vacation of this portion of apparent prescriptive right-of-way for Elizabeth Town Cemetery Road to be replatted with the adjoining property for a new industrial warehouse development in the Alliance Aiport Industrial Growth Center.The City Plan Commission recommended approval of this request at its meeting on October 14,2020.An acceptable final plat(FP-20-139)has been received in accordance with the Subdivision Ordinance. The City of Fort Worth(City)originally obtained the above mentioned right-of-way through prescription.The City does not own any fee interest in the rights-of--way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of--way easement.In accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6,2007,Mayor and Council Communication(M&C G-15624),staff recommends waiving the fair market value or any portion thereof of purchase price of this right-of-- way easement for the street. This project is located in COUNCIL DISTRICT 7. A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity.
