CO2505) BY $615,198.37, AND DECREASING RECEIPTS IN THE REVENUE — SERVICE AREA Y—TRANSPORTATION IMPACT FEES PROJECT(CITY PROJECT NO. UN9927) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2020-2021 in the Budget of the City Manager, there shall also be adjusted receipts and appropriations in the Transportation Impact Fee Capital Legacy Fund by increasing receipts and appropriations in the McCart Avenue and McPherson Boulevard Project (City Project No. CO2505) by $615,198.37, and decreasing receipts in the Revenue —Service Area Y —Transportation Impact Fees Project (City Project No. UN9927) by the same amount. SECTION 2. That should any portion,section or part of a section of this ordinance be declared invalid,inoperative or void for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair the remaining portions,sections,or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 24446-09-2020 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations,in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Adopt the attached appropriation ordinance adjusting receipts and appropriations in the Transportation Impact Fee Capital Legacy Fund by increasing receipts and appropriations in the McCart Avenue and McPherson Boulevard project in the amount of $615,198.37 and decreasing receipts in the Revenue-Service Area Y-Transportation Impact Fees project by the same amount; 2. Adopt the attached appropriation ordinance adjusting receipts and appropriations in the Transportation Impact Fee Capital Fund by increasing receipts and appropriations in the McCart Avenue and McPherson Boulevard project in the amount of$3,384,801.63 and decreasing receipts in the Revenue-Service Area Y-Transportation Impact Fees project(City Project No.UN9927)by the same amount; 3. Adopt the attached appropriation ordinance adjusting appropriations by increasing the appropriations in the 2014 Bond Program Fund for the McCart Avenue and McPherson Boulevard project in the amount of$3,600,758.22 and decreasing appropriations in the Fund 34014 Appropriation Only project(City Project No. U34014)by the same amount; 4. Adopt the attached appropriation ordinance adjusting receipts and appropriations by increasing the receipts and appropriations in the 2007 Critical Capital Projects Fund for the McCart Avenue and McPherson Boulevard project(City Project No.CO2505)in the amount of $1,162,196.78 and decreasing receipts and appropriations from available funds in the Unspecified project(City Project No.UNSPEC)by the same amount;and 5. Amend the FY2021-2025 Capital Improvement Program. DISCUSSION: The purpose of this Mayor and Council Communication(M8C)is to adopt the attached appropriation ordinances to supplement existing funding in the McCart Avenue and McPherson Boulevard project(City Project No.CO2505)and to amend the FY2021-2025 Capital Improvement Program (CIP). McCart Avenue and McPherson Boulevard,within this project's limits,are approximately two miles in length and are identified in the City's Master Thoroughfare Plan(MTP)as four-lane neighborhood connectors with sidewalks.The proposed project will extend the existing roads by constructing a four-lane,MTP arterial section.The project includes: roundabouts at McCart Avenue/North Crowley Cleburne Road and McCart Avenue/McPherson Boulevard,and shared-use path, paving,and storm drain improvements. The preliminary cost estimate for the McCart Avenue and McPherson Boulevard project is$28,000,000.00,with 2014 Bond Program funding previously appropriated in the amount of$17,164,511.00. The entire project is located within Transportation Impact Fee Service Area Y(City Project No. UN9927). The roundabout at McCart Avenue and North Crowley Cleburne Road is ineligible for transportation impact fee fund. It is proposed that savings from other completed 2014 bond projects and 2007 critical capital need(CCN)projects be transferred from unspecified projects(City Project No. U34014 and City Project No. UNSPEC)and used for the roundabout,which is within the authorized purpose of both of those debt issuances. NOTE—The CCN residuals were identified during staffs on-going process of cleaning up and closing out of old capital projects. The bulk of the approximately$40,000,000.00 in proceeds from the debt authorized under the 2007 CCN was immediately put to work on eligible projects. The dollars at issue here represent a portion of the$3,984,589.74 in project savings and residual funding that staff identified during its clean-up process. Staff is actively working to program the balance of those savings on other eligible projects. All of the remaining project scope is identified as impact fee eligible in the currently adopted Transportation Impact Fee Study. The requested impact fee funding will be used only to pay for impact fee eligible portions of the project. Upon completion,any remaining impact fee funds will be returned back to the Service Area Y project. Transportation Impact Fee funding for this project was not included in the FY2021-2025 Capital Improvement Program. Due to a mid-year focus to program and spend available and eligible Transportation Impact Fees,the action in this M8C will amend the FY2021-2025 Capital Improvement Program. Additional funding in the amount of$8,762,955.00 is needed due to increased right-of-way and construction costs. The action in this M&C will amend the FY2021- 2025 Capital Improvement Program as approved in connection with Ordinance 24446-09-2020. This project is located in COUNCIL DISTRICT 6. A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION I CERTIFICATION: The Director of Finance certifies that funds are currently available in the Revenue-SA Y-Transp Imp Fees project within the Trans Impact Fee Cap Legacy and Transportation Impact Fee Cap Funds,the Fund 34014 Approp Only project within the 2014 Bond Program Fund,and the UNSPEC project within the 2007 Critical Capital Projects Fund,and upon approval of the above recommendations and adoption of the attached appropriation ordinances,funds will be available in the Trans Impact Fee Cap Legacy Fund,Transportation Impact Fee Cap Fund,2014 Bond Program Fund,and the 2007 Critical Capital Projects Fund for the McCart Ave.&McPherson Blvd project. Prior to an expenditure being incurred, the Transportation&Public Works Department has the responsibility of verifying the availability of funds.
