HomeMy WebLinkAboutOrdinance 17810-10-2007ORDINANCE NO.17810-10-2007 AN ORDINANCE VACATING AND EXTINGUISHING A TRIANGULAR PORTION OF MANSFIELD AVENUE RIGHT OF WAY, LOCATED IN THE DANTEL DULA,NEY SURVEY, ABSTRACT NO. 410 IN THE CITY OF FORT WORTH AND BEING PART OF THE RIGHT-OF-WAY FOR MANSFIELD AVENUE AS SHOWN ON PLAT FOR THE SECOND FILING OF BELMONT, AN ADDITION TO THE CITY OF FORT WORTH AS RECORDED IN VOLUME 678, PAGES 468 AND 469 OF THE PLAT RECORDS OF TA,ItRA.NT COUNTY, TEXAS, FROM THE NORTHEAST C017:NER OF MULI~EY STREET ANI) SOUTH RIVERSIDE DRIVE TO THE SOUTHERN PROPERTY LINE OF LOT 2, BLOCK 15, BELMONT SECOND FILING ADDITION, CONTAINING 30,421 SQUARE FEET OR 0.698 ACRES OF LAND; PROVIDING FOR THE REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDA][NED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a triangular portion of Mansfield Avenue right of way, located in the Daniel Dulaney Survey, Abstract No. 410, from the northeast corner of Mullcey Street and South Riverside Drive to the southern property line of Lot 2, Block 15, Belmont Second Filing Addition, an addition of the City of Fort Worth, Tarrant County, Texas, as recorded in Volume 678, pages 468 and 469 of the Plat Records of Tarrant County, Texas, containing 30,421 square feet or 0.698 acres of land more or less, and as more specifically described in Exhibit "A" and "B" attached hereto and incorporated herein by reference, be and the same is vacated and extinguished. SECTION 2. That the fee to the land in the above-described street is released and shall revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect upon adoption. No. # 17810-10-2007 - -.- ~ $-- DATE: Tuesday, October 02, 2007 LOG NAME: 06VA-07-004 REFERENCE NO.: **PZ-2754 SUBJECT: Adopt an Ordinance Vacating a Portion of the Variable-Width Triangular Section of Old Mansfield Avenue, located in the Daniel Dulaney Survey, Abstract No. 410, from the Northeast Corner of Mulkey Street and South Riverside Drive to the Southern Property Line of Lot 2, Block 15 Belmont Second Filing, in the City of Fort Worth Totaling 30,421 Square Feet RECOMMENDATION: It is recommended that the City Council adopt an ordinance vacating a portion of the variable-width triangular section of Old Mansfield Avenue, located in the Daniel Dulaney Survey, Abstract No. 410, from the northeast corner of Mulkey Street and South Riverside Drive to the southern property line of Lot 2, Block 15 Belmont Second Filing, consisting of 30,421 square feet of land adjacent to Lot 1A Block 15 Belmont Second Filing, as filed in Volume 678, Pages 468-469, of the Plat Records of Tarrant County, Texas. DISCUSSION: Di Sciullo and Terry, Inc., on behalf of James Austin, request to vacate the above referenced portion of right-of-way to replat and incorporate it within the adjoining property. The City Plan Commission recommended approval of this request at its meeting on May 23, 2007. An acceptable replat (FS-07-101) has been received. Any existing utilities will be relocated at the applicant's expense or retained within a designated easement along with an appropriate plat note that no permanent structures may be constructed or placed thereon. . The Department of Engineering's Real Property Division received a written request by James Austin to purchase the aforementioned right-of-way and a sales price of $15,201 has been agreed upon by both parties. An M&C to authorized the sale of fee owned excess right-of-way has been drafted (see 30Riverside) and will be forthcoming to the City Council. The City of Fort Worth originally obtained the above referenced right-of-way through the platting process and it has been determined by the Department of Engineering's Real Property Division that the City has fee ownership of the right-of-way.
