Home My WebLink AboutContract 46138-R1 CITY SECRETARY CONTRACT NO, FIRST RENEWAL FOR CITY SECRETARY CONTRACT NO.46138 Cif�• -- �- FORT WORTH MEACHAM INTERNATIONAL AIRPORT TANK FARM AND PUBLIC FUELING AGREEMENT This FIRST RENEWAL TO CITY SECRETARY CONTRACT NO. 4613 ("RENEWAL") is made and entered into by and between the CITY OF FORT WOR ("Lessor"), a home rule municipal corporation organized under the laws of the State of Texas an RICHARDSON AVIATION ("Lessee"), an Texas Limited Liability Company, acting by an through THOMAS W. WHITE its duly authorized VICE PRESIDENT, each individuall referred to as a"party"and collectively referred to as the"parties." RECITALS The following statements are true and correct and form the basis of this Agreement. WHEREAS,on or about November 11,2014 Richardson Aviation("Lessee'r) entered into City Secretary Contract("CSC")No.46138,a Tank Farm and Public Fueling Agreement,consisting of approximately 3,600 square feet of ground space for use as a fuel farm;and WHEREAS,the Lease provides for a five(5)year initial term with options for up to thre (3),options to renew for ten(10)years each;and WHEREAS, the initial term of the lease expired on September 30,2020, and the Lesse is currently operating under a holdover provision;and WHEREAS,the Lessor and Lessee have agreed to exercise the first renewal term provide under the Lease,commencing on October 1,2020 and ending on September 30,2030. NOW, THEREFORE, for good and valuable consideration, the receipt and adequacy o which are hereby acknowledged,Lessor and Lessee hereby agree as follows: 1. The Lease is hereby renewed and extended for the first permitted renewal term of ten(10 years,commencing on October 1,2020 and expiring on September 30,2030. 2, In accordance with the established Schedule of Rates and Charges,Lessee shall pay a monthl rental amount of Four Hundred Dollars($400.00)per month for its lease of the Premises. 3. The fuel flowage rate scale is based on the number of gallons of fuel delivered to the Premise annually. Therefore,on the Effective Date,Lessee will pay a fuel flowage fee payment of$0.18 per gallon,and the above calculations will begin anew through the following September 30�';provide Fort Worth Meacham Infernational Airport Richardson Aviation Renewal Option No.1 to CSC No.46138 Page 1 of 6 OFFICIAL e'TY SECRETARY FT. WORTH, 7'X however,that the City Council may,in its discretion,adjust fuel flowage fees and rate scales for providers of FBO services at Meacham,as may be set forth in the Schedule of Rates and Charges, which case the adjusted rates shall be applied. All other terms and conditions of the Lease that are not expressly amended herein or in conflict with the provisions and conditions of this Amendment shall remain in full force an I effect. The statements set forth in the recitals above are true and correct and form the basis which Lessor and Lessee have entered into this Agreement.
