HomeMy WebLinkAboutOrdinance 17811-10-2007Ordinance No. 17811-10-2007 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE STORM WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $369,575 FROM A STORM WATER UTILITY FUND TRANSFER, FOR THE PURPOSE OF EXECUTING A CONTRACT WITH HUMPHREY & MORTON CONSTRUCTION COMPANY, INC., (CITY PROJECT NO. 00098); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2006- 2007 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Storm Water Capital Projects Fund in the amount of $369,575 from a Storm Water Utility Fund transfer for the purpose of executing a contract with Humphrey & Morton Construction Company, Inc., (City Project No. 00098). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17142 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. No. # 17811-10-2007 DATE: Tuesday, October 02, 2007 LOG NAME: 302MISCULVERT98 REFERENCE NO.: *~C-22421 SUBJECT: Authorize Execution of a Contract with Humphrey & Morton Construction Company, Inc., for Minor Miscellaneous Culvert Improvements, Contract F (Project No. 00098), Authorize Transfer of Funds and Adopt Appropriation Ordinance RECOMMENDATION: It is recommended that the City Council: 1. Authorize the transfer of $369,575.00 from the Storm Water Utility Fund to the Storm Water Capital Projects Fund; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Storm Water Capital Projects Fund in the amount of $369,575.00; and 3. Authorize the City Manager to execute a contract with Humphrey & Marton Construction Company, Inc., in the amount of $392,649.90 for Minor Miscellaneous Culvert Improvements, Contract F. DISCUSSION: The Storrn Water Management Program was established to reduce flooding in Fort Worth, preserve streams, minimize water pollution and to operate the storm water system in a more effective manner to fully comply with state and federal regulatory requirements. This will be accomplished by infrastructure reconstruction and system maintenance, master planning, enhanced development review, and increased public education and outreach. On December 14, 2004, (M&C C-20438) the City Manager executed an engineering agreement with Stream Water Group, Inc., for 2004 CIP Miscellaneous Channel Improvements, Contract F on Glen Garden Drive, Truman Drive and Williams Road. This project was advertised on April 26, 2007 and May 3, 2007. The following bids were received on June 14, 2007: BIDDERS AMOUNT Humphrey &~ Morton Construction Company, Inc. $392,649.90 Tri-Tech Construction, Inc. $436,811.00 TIME OF COMPLETION: 120 Working Days Specified Funding in the amount of $8,050.00 is required for associate water and sewer construction survey, project management, pre-construction, material testing, inspection and project close out (Water $1,440.00 and Sewer $6,610.00). The contingency funds to cover change orders total $7,006.00 (Water $1,006.00 and Logname: 302MiSCULVERT98 Page 1 of 2 Sewer $6,000.00). Funding in the amount of $48,340.00 is required for construction survey, project management, pre- construction, material testing, inspection and project close. The contingency fund for possible change orders for drainage improvements is $15,297.00. Humphrey & Morton Construction Company, Inc., are in compliance with the City's M/VVBE Ordinance by committing to 20 percent M/WBE participation. The City's goal on this project is 17 percent. This project is located in multiple COUNCIL DISTRICTS. FISCAL. INFORMATION/CERTIFICATION: The Finance Director certifies that upon approval of the above recommendations, and adoption of the attached appropriation ordinance, funds will be available in the current capital budgets, as appropriated, of the Water Capital Projects Fund, the Sewer Capital Projects Fund and the Storm Water Capital Projects Fund.
