BE IT REMEMBERED that on this date, after due notice to all parties, there came on to
be heard and considered the decision of the Special Commissioners filed on the 2nd day of April,
2013, with the Judge of said Court under the above -styled and numbered cause, which is a
condemnation proceeding in which City of Fort Worth is Plaintiff and Redus Texas Land, LLC,
Petrus Investment, L.P., Southwester Gas Pipeline, Inc., Aperion Communities, LLLP, Eladio
Properties, LLLP, and Drooy Properties, LLLP are the Defendants.
It appears to the Court, and it is so found, that the only objections to said decision were
filed by Condemnees Aperion Convnunities, LLLP, Eladio Properties, LLLP, and Drooy
Properties, LLLP (the "LLLP Condemnees"), on April 8, 2013.
It further appears to the Court, and it is so found, that the LLLP Condenrnees failed to
serve the City of Fort Worth with citation and objections, as required by Texas Property Code
§ 21.018(b), and that no other objection to said decision was filed within the time provided by
law and that said decision and Award has been filed with the Clerk of this Court.
It is, therefore, ORDERED, ADJUDGED an.d DECREED by the Court as follows:

That the objections of LLLP Condemnees are hereby dismissed.
2.
That the Award of said Special Commissioners (a true and accurate copy of which is
attached hereto as Exhibit 1 and made a part hereof) be, and the same is hereby made the
judgment of this Court.
3.
That the Clerk of this Court record said Award in the minutes of this Court.
4.
That by virtue of said Award of Commissioners, the Plaintiff City of Fort worth is
entitled to condemn and does hereby have judgment against the above -named Defendants for the
right-of-way as set out in the property described in the Award of Commissioners, situated in
Denton County, Texas, with the right in Plaintiff City of Fort Worth to exercise all those rights
and powers as are fully described insaid Award of Commissioners.
5.
It further appears that the Plaintiff City of Fort Worth has deposited in the registry of the
Court the amnount of damages awarded by said Special Commissioners and it is therefore,
ORDERED that a writ of possession issue in behalf of Plaintiff City of Fort Worth.
6.
That the costs of said proceeding are to be paid by the Plaintiff City of Fort Worth as
provided in said Award of Commissioners, which costs shall be paid to the County Clerk of
Denton County, Texas.

That the Notice of Lis Pendens filed on April 6, 2012, by Plaintiff and recorded at Doc.
#2012-36541, Official Public Records of Denton County, Texas, is hereby released and
cancelled.
8.
The Award of Commissioners, consisting of $20,159.00, heretofore deposited by Plaintiff
City of Fort worth in the registry of this Court shall be held until farther order of the Court.
9.
That the Clerk of this Court is directed to pay to Defendants, the amount of damages
deposited by Plaintiff in the registry of this Court, subject to the order of Defendants upon the
filing by Defendants of a motion to withdraw that Award amount from the registry of this Court,
all as required by § 21.021(a)(1) of the rilexas Property Code.

S, on the 314 day of April, 2012, City of Fort Worth, hereinafter referred
to as Plaintiff or "City" filed a certain Original Condemnation Petition with the Probate
Court Clerk of Denton County, Texas, and on the I0t day of May, 2012 filed a First
Amended Condemnation Petition, and on the 12th day of September, 2012 filed a Second
Amended Condemnation Petition, and on the 191 day of February, 2013 filed a Third

Amended Condemnation Petition, wherein on the facts alleged it sought condemnation. of
Defendants' interest in, on, over, and across certain land in Denton County as more fully
described in the Third Amended Condemnation Petition (which Thud Amended
Condemnation Petition is attached hereto and made a part hereof for all purposes as
Exhibit "A"); and
WHEREAS, Upon the consideration of such Petition and forthwith upon its filing
on the 3'I day of April, 2012, and subsequent thereto, the Judge of the Denton County
Probate Court appointed the undersigned, three disinterested residents of said County, as

Defendant Redus Texas Land, LLC, is the owner of the property described as a 188.651

acre tract of 'and situated in the G. Cantinas Survey, Abstract No. 214, Denton. County, Texas, as
described in the deed to Redus Texas Land, LIE, recorded in went Number 2010-109774,
Real Property Records of Denton County, Texas.

Defendants Petrels Investment, L.P., Southwestern Gras Pipeline, Inc,, Aperion
Communities, LLLP, Eladio Properties, LLLP and Dio oy Properties, LLLP may own or claim
interests in the property, including easements. Specifically, Pettus Investm.er, L.P. may own or

claim Intel gists in the property, including a Utility Easement accorded in the Denton County dead
records on 3anuary 29, 2004, at went 12004-119I2, and a Road Easement recorded in the
Denton County deed records on January 29, 2004, at Instrument #2004-11911.
It is necessary for Plaintiffto acquire three (3) parcels of Defendant's property, all being
out of the property described in Parataph 4 of this Petition and more particularly described in
Exhibits "A," "B," "C," "-D," " B," and "P," attached hereto and made parts hereof for the public
use described herein.

The City Council of the City of Port Worth, in the exercise of its sound discretion, deems

herein be acquired for the City's public use project to enlarge and extend the Alliance Airport
Runway so the land may be used to rclocae the Main Line of the BNS`P Railway Company and
any adjamat ut iities and easements or other interests as part of the City's Alliance Airport
Runway Extension Project. In compliance with public necessity and on. December 18, 2012,
November 15, 2011, and July 24, 2022, the City Council of the City of Fort Worth approved
Mayor and Council Comomntcations L-15488, T.45283 and L-1540'1, respectively, and
authorized its City Attorney to institute condemnation proccednngs as are necessary to acquire
the land and all legal or equitable interests and property rights for the public use described
herein

Accordingly, Petitioner seeks to acquireibe parcels described in Thcht`bits "A," `B, "C,"
"D," " E,' and "1~' in, on, over, under, across, and through the property for the public purpose of
the relocation, of the Main Line of the BNST Railway Company for the Alliance Airport Runway

condensate, distillate, water or any other substance which can be transported by a pipeline,

Authorize Condemnation by Eminent Domain of an Easement Interest in 1.476 Acres of
Land from Redus Texas Land, L.L.C., for an Access Easement Located in Denton County,
Texas, at the Northwest Corner of State Highway 114 Along the Burlington Northern Santa
Fe Railway Track for the Alliance Airport Runway Extension Project (COUNCIL DISTRICT

RECOMMENDATION:
It is recommended that the City Council:
1. Declare that based upon the Burlington Northern Santa Fe Railroad Relocation Agreement
executed May 17, 2010, M&C C-24205 between the City and the Burlington Northern Santa Fe
Railway Company, the Alliance Airport Runway Extension Project is necessary in order to meet the
City's transportation needs as well as to provide for the public's convenience;
2. Declare that public convenience and necessity to take through condemnation by eminent domain
a variable width access easement interest in 1.476 acres of land on the subject property located in
the G. Cardinas Survey, Abstract No. 214, Denton County, Texas, for the relocation of the Burlington
Northern Santa Fe Main Line Track;
3. Authorize the City Manager and his designee TranSystems to attempt to acquire through eminent -
domain proceedings under Texas law the easement interest for its fair -market value through good -
faith negotiations with Redus Texas Land, L L.C., and if the negotiations are unsuccessful, authorize
the City Attorney to acquire the easement interest without mineral interests in the parcel as well as
any remainder of the Reddus property where the acquisition of the remainder would be economically
prudent;
4. Authorize a payment pursuant to an award of commissioners or upon negotiated settlement in lieu
of condemnation by eminent domain; and
5. Authorize the acceptance and recording of the appropriate instruments.
DISCUSSION:
On April 17, 2007, (M&C G-15687) the City Council approved the acceptance from the Federal
Aviation Administration (FAA) a grant to allow the City to acquire fee -simple title or other property
interests to parcels of land as required for the Alliance Airport Runway Extension Project. On
January 4, 2011, (M&C G-17174) the City Council approved the initial acquisition of parcels needed
for the Alliance Airport Runway Extension Project Additionally, on June 7, 2011 and November 15
2011, Council approved M&C L-15198 and M&C L-15283, respectively, for the acquisition of
additionally identified parcels required for the project.
The subject parcel, owned by Redus Texas Land, L.L.C., is required for the purpose of relocating the
Burlington Northern Santa Fe Main Line Track. The City will seek reimbursement from the FAA for
eligible expenses associated with this property interest acquisition. The majority of these expenses
will consist of the consideration paid for the property interest acquired. In order to be an eligible
expense, the City must offer not less than the appraised value of the property as established by an

independent appraiser and review appraiser, and the offer must be approved by the FAA. Staff
recommends the City Council adopt the declarations and authorizations for the acquisition of the
parcel. Upon City Council approval Staff will proceed with acquiring the easement interest in the
property except for the mineral estate. The owner of the mineral interest, however, will not have the
right of ingress and egress to or from the surface of the parcel to explore beneath the acquired
parcel. Deeds conveying a fee interest to the City will contain a surface waiver for the exploration of
the mineral estate.

authorize condemnation by eminent domain should say:
I move that the Fort Worth City Council authorize the use of the power of eminent domain for the
Alliance Airport Runway Extension Project to acquire from Redus Texas Land L.L.C., for the
Burlington Northern Santa Fe Main Line Track relocation a 64,273-square-feet parcel of land for a
variable width access easement. The land is legally described as a portion out of a 188.651-acre
tract of land owned by Redus Texas Land, L.L.C. and located at the northwest corner of the
intersection of State Highway 114 and the Burlington Northern Santa Fe Road track in Denton
County, Texas. The access easement is described by a metes -and -bounds survey and depicted by
survey plat attached to this Mayor &Council Communication.
The parcel is located in COUNCIL DISTRICT 2, Mapsco 641 M.

The Financial Management Services Director certifies that the funds are available in the current
capital budget as appropriated, of the Airports Grant Fund.
