HomeMy WebLinkAboutOrdinance 17815-10-2007Ordinance No. 17815-10-2007 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL TRUST FUND IN THE AMOUNT OF $5,000 FROM THE U.S. FISH AND WILDLIFE SERVICE FOR THE PURPOSE OF FUNDING FOR NATIVE GRASSLAND AND RIPARIAN HABITAT RESTORATION FROM ROCKWOOD GOLF COURSE TO THE FORT WORTH NATURE CENTER AND REFUGE; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2006- 2007 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Trust Fund in the amount of $5,000 from the U.S. Fish and Wildlife Service for the purpose of funding for native grassland and riparian habitat restoration from Rockwood Golf Course to the Fort Worth Nature Center and Refuge. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17142 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. To amend Contract Number 29864 between the U.S. Fish and Wildlife Service and the City of Fort Worth to transfer the project site and grant funding from Rockwood Golf Course to the Fort Worth Nature Center and Refuge (FWNCR); 2. Accept from the U.S. Fish and Wildlife Service up to $5,000 contribution to reimburse this project; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Special Trust Fund by $5,000. DISCUSSION: On March 11, 2004, City Council authorized the City Manager to enter into a contract between the U.S. Fish and Wildlife Service and the City of Fort Worth Parks and Community Services Department to implement a cost-sharing agreement for wildlife habitat enhancements at Rockwood Golf Course. (City Secretary Contract Number 29864). The original work plan called for the restoration and enhancement of approximately 50 acres of native grassland and riparian habitats to benefit resident and migratory wildlife at Rockwood Golf Course. Subsequent to approval, The First Tee of Fort Worth approached Fort Worth Golf regarding a collaboration on a driving range and teaching facility at Rockwood Golf Course. Negotiations resulted in agreement to construct the facility on the land that was originally slated for native area restoration. The U.S. Fish and Wildlife Service and Fort Worth Golf recognized that the planned work could no longer occur on the golf course and agreed to transfer the work location and cost-share funding to the Fort Worth Nature Center and Refuge (FWNCR). The FWNCR will use the funding to enhance and restore approximately 50 acres of grassland wildlife habitat. The U.S. Fish and Wildlife Service will annually inspect and evaluate the program and will provide management guidelines as necessary to insure its success. The U.S. Fish and Wildlife Service contribution to this project is funding reimbursement up to $5;000. Funding for the City of Fort Worth's share of the project will come from the FWNCR FY 2007-08 operating budget to purchase native grasses and wildflower seed, herbicides to remove non-native vegetation and in-kind labor. All work will be completed within one year from the date of the transfer. The Parks and Community Services Advisory Board endorsed the transfer of the project site and grant funding from Rockwood Golf Course to the Fort Worth Nature Center and Refuge at their meeting on August 22, 2007. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that, upon execution of the above recommendations, funds for the cost sharing match will be available in the current operating budget of the Special Trust Fund.
