HomeMy WebLinkAboutContract 45483 (2)CITY SECREN±l___ CONTRACT NO, STATE OF TEXAS § COUNTY OF TARRANT § FY 2014 INTERLOCAL AGREEMENT BETWEEN TARRANT COUNTY AND CITY OF FORT WORTH BACKGROUND The Tarrant County, Texas ("COUNTY") recognizes a need to reduce the number of driving while intoxicated cases countywide; The COUNTY desires to pay for laboratory testing of blood sample taken in conjunction with the Tarrant County No Refusal Program; the City of Fort Worth ("CITY") Crime Laboratory -desires to perform the laboratory testing of blood samples taken in conjunction with the Tarrant County No Refusal Program; This Interlocal Agreement ("Agreement") is by and between the COUNTY and the CITY and in aid of the Texas Department of Transportation Grant Agreement No. 2014- TarrantC-G-1YG-0056, titled: Tarrant County No Refusal Program the ("Grant Agreement"); and The COUNTY and the CITY find that this Agreement serves a public purpose; find that the consideration is adequate; find that this Agreement allows for the efficient provision of such services by the CITY; and find that this undertaking is necessary for the benefit of the public. The COUNTY and the CITY mutually agree to the following: 1. The term of this agreement is effective from October 1, 2013 through September 30, 2014 ("Term") with blood draws taken during the dates and times listed below. Thanksgiving —Wednesday 9:30 p.m. through Sunday 5:30a.m 11/27-12/02/2013 Christmas — Tuesday 9:30p.m. through Monday 5:30a.m. 12/24-30/2013 New Year's Eve — Tuesday 9:30.m. through Wednesday 5:30a.m. 12/31 / 13 -01 /01 /2014 Super Bowl — Sunday 9:30p.m. through Monday 5:30a.m. 02/02-03/2014 Memorial Day Week -end — Friday 9:30p.m. through Monday 5:30a.m. 05/23-26/2014 Independence Day — Friday 9:30p.m. through Monday 5:30a.m. 07/04-07/2014 Labor Day Week -end — Friday 9:30p.m. through Monday 5:30a.m. 8/29/14-09/01/2014 2. The CITY will perform laboratory testing for alcohol of blood samples obtained and submitted in accordance with the Tarrant County No Refusal Program. 3. The COUNTY will pay the CITY within 30 days of receipt of the billing for services performed pursuant to this Agreement. The billing and reporting must be received by the Business Office of the District Attorney's Office within 30 days of performance of service during the Agreement Term. Billings will be for actual expenses only at a rate of $90.00 per test. COUNTY shall make payments for the performance of services under this Agreement from current revenues legally available to COUNTY. The CITY will maintain accurate programmatic and fiscal records regarding the testing services provided and funds expended, if any, and will render to the COUNTY and the Business Office of the District Attorney s Office, a detailed report within 30 days after the end of the month following the pei formance of the service. Furthermore, the COUNTY and the CITY reserve the right to audit the records of the other party related to expenditures and services under this Agreement to determine compliance herewith. 5. Either party may terminate this agreement upon 30 days written notice to the other party, with or without cause, and at no penalty or expense to the other party. CITY will be reimbursed for any services rendered up to the final date of termination of the Agreement. 6. The CITY and its sub -contractors, if any, agree to comply with all local, state and federal laws, rules and regulations to include all standard assurances stated in the Grant Agreement to the extent applicable through the COUNTY as sub -grantee to the CITY as a sub -contractor. Said compliance includes certification that: A. The CITY and its sub -contractors, if any, shall not discriminate on the basis of race, color, national origin or sex in the performance of this Agreement. The parties shall carry out applicable requirements of 49 CFR Part 26 in the award and administration of USDOT-assisted contracts. Failure to carry out these requirements is a material breach of this Agreement, which may result in the termination of this Agreement or such other remedy as the recipient deems appropriate. B. The CITY and its sub -contractors, if any, are not currently debarred, suspended, or otherwise excluded from or ineligible for participation in Federal Assistance Programs under Executive Order 12549. C. The CITY and its sub -contractors, if any, certify to the best of the signatory's knowledge and belief that: No federally appropriated funds have been paid or will be paid by or on behalf of the CITY or its sub -contractors, if any, to any person for influencing or attempting to influence an officer or employee of any fedei al agency, a Member of Congress, an officer or employee of Congress, or an employee of a Member of Congress in connection with the awarding of any federal contract, the making of any federal contract, the making of any federal loan, the entering into of any cooperative agreement and the extension, continuation, renewal, amendment, or modification of any federal contract, grant, loan, or cooperative agreement. 2. If any funds other than federal appropriated funds have been paid or will be paid to any person for influencing or attempting to influence an officer or employee of any federal agency, a Member of Congress an officer or employee of Congress or an employee of a Member of Congress in connection of the Grant Agreement grant, loan, or cooperative agreement, the party to this Agreement shall complete Execution Copy Issue Date 2.4.2014 FY 2014: Interlocal Agreement Between Tarrant County and the City of Fort Worth Page 2 of 3 and submit Standard Form - LLL, "Disclosure Form to Report Lobbying," in accordance with its instructions. 7. Authorize execution of an Interlocal Agreement with Tarrant County to perform blood analysis in conjunction with the Tarrant County No Refusal Program in the amount of $27,000.00; and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund in the amount of $27,000.00. DISCUSSION: Tarrant County was awarded grant funds from the Texas Department of Transportation (TxDOT) for the Tarrant County No Refusal Program. The goal of the No Refusal Program is to reduce the number of alcohol impaired, driving under the influence of alcohol, and other drug -related crashes, fatalities and injuries. This Interlocal Agreement allows the City of Fort Worth to provide laboratory testing of blood samples obtained during the No Refusal Program weekends which are Thanksgivinc Christmas, New Year's Eve Super Bowl, Memorial Day Independence Day and Labor Day Chapter 791 of the Texas Government Code provides authority for local governments to enter into Interlocal Agreements. FISCAL INFORMATION/CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations, execution of the Agreement, and adoption of the attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the Grants Fund.
