RECITALS WHEREAS, City and made and entered into an Encroachment Agreement, City Secretary Contract No. 45469 (the "Encroachment Agreement") with Licensee, to authorize the use of a portion of City's water easement and sewer easement for the purpose of constructing and maintaining a wrought iron fence with sliding gates; and WHEREAS, Licensee wishes to amend the location of the proposed fence; and WHEREAS, it is the mutual desire of City and Grantee to amend the Encroachment Agreement to revise and amend Exhibit "A" to accurately depict the location of the proposed fence after the changes. NOW THEREFORE, City and Licensee hereby agree to amend the Encroachment Agreement as follows: 1. Exhibit A-1 is hereby attached hereto and incorporated herein to the Agreement, consisting of a revised description of the encroaching improvements. 2. All other provisions of the Agreement which are not expressly amended herein shall remain in full force and effect. 3.
