G151-Z J . • , ,:1 BETWEEN EDUCATION SERVICE CENTER REGION 11 AND THE CITY OF FORT WORTH ON BEHALF OF THE FORT WORTH PUBLIC LIBRARY THIS INTERLOCAL AGREEMENT (hereinafter referred to as "Agreement") is made and entered into by and between the City of Fort Worth on behalf of the Fort Worth Public Library (hereinafter referred to as "the City" or "Consortium Member") and Education Service Center Region 11, (hereinafter referred to as "ESC Region 11" or "Applicant Organization"), pursuant to the authority granted in compliance with section 29.908 of the Texas Education Code, WHEREAS, the Texas Government Code, Chapter 791, the "Interlocal Cooperation Act," authorizes local government entities to enter into interlocal contracts for governmental purposes; WHEREAS, the parties to this Agreement desire to establish a Distance Learning Program that allows the City to deliver share curriculum, offer professional development, and to enrich the learning experience for all project participants; WHEREAS, under this Agreement, the parties agree to follow the agreed upon guidelines of City and ESC Region 11 in providing the Distance Learning Program specifically to enhance student learning and prepare students for future educational and career opportunities; WHEREAS, this initiative will help prepare students for successful career and educational futures through sharing of curriculum and professional development to help improve student awareness and experiences; and WHEREAS, each party, in performing governmental functions or in funding the performance of governmental functions, shall make that performance or those payments from current revenues legally available to that party; and WHEREAS, each party finds that the performance of this Agreement is in the common interest of the parties, that the undertaking will benefit the public interest and that the division of costs fairly compensates the performing party for the services or functions under this Agreement. WORTHS TX The purpose of this Memorandum of Understanding is to formalize the working agreements between the Applicant Organization and the Consortium Member in order to apply for the USDA Rural Utilities Distance Learning and Telemedicine (RUS-DLT) Grant. The primary objective of the grant is to bring the benefits of video technology to the students and teachers, MOU between ESC Region 11 and City of Fort Worth Distance Learning Page 1 of 4 RECEIVED JUL 02 1 to share curriculum, offer professional development, and to enrich the learning experience for all project participants. As a participating member in the consortium, the Applicant Organization and Consortium Member will significantly contribute to the project and have a clear understanding of the defined roles and responsibilities, as identified below: A. The Applicant Organization's responsibilities include, but are not limited to: 1. Take the lead role in working with all project partners in identifying the needs for the proj ect; 2. Be the Applicant Organization and fiscal agent for the grant; 3. Provide all necessary legal documents as required by the grant program; 4. Provide the grant writing support for the grant program; 5. Support the partner sites with all aspects of developing the grant proposal; 6. Manage the procurement process for all federally funded budget items associated with this project; 7 Employ staff and supervise the Region Eleven Telecommunications Network (REIN) and Connect2Texas activities; 8. Provide end -user technical support through the RETN/Connect2Texas helpdesk; 9. Conduct all bids for equipment, process all purchase orders, order equipment, arrange for deliveries and installations in accordance with the agreed upon configurations; 10. Organize and participate in various user meetings in order to provide members with information and to solicit user input related to changes; 11. Receive and disburse funds related to the operation of the grant and ensure that funds are used in accordance with applicable provisions and laws; 12. Respond to the member's equipment and software application questions in a timely manner; 13. Provide the member with training related to the use and operation of the equipment and instructional design issues; 14. Coordinate the grant evaluations and make required reports based on the grant requirements 15. Monitor compliance with this agreement and with grant requirements; 16. Update and maintain a web -based application to be used to schedule and promote programs; 17. Provide technical support before, during and after programs, 18. Provide onsite technical assistance (Platinum members only; Gold members receive unlimited phone support) for the three year grant period and thereafter as long as the Platinum membership level is maintained, and 19. Provide bridging services for the member to entities that connect through the Connect2Texas network. B. The Consortium Member's responsibilities include, but are not limited to: 1. Demonstrate a strong and measurable commitment to the proposed project and its objectives by participating in the planning and implementation of the project; 2. Provide personnel, space, and other resources towards the proposed project, as agreed upon with hSC Region 11; MOU between ESC Region 11 and City of Fort Worth Distance Learning Page 2 of 4 3. Provide data specific to the member organization that will be required for the grant submission; 4. Designate a primary contact person for the grant to work with the 1-i SC Region XI 11 in developing the grant proposal and, if successful, in implementing the project; 5. Provide a complete set of signed Certifications as required by the grant. 6. Participate in various informational meetings that are designed to solicit user input; 7. Consult with ESC staff on technical specifications, detenine the best connectivity options, and arrange for the connectivity line to be installed; 8. Provide any modifications at the member site, including network and any hardware necessary for connectivity that is not covered by the grant; 9 Designate staff to be trained and to deliver programs; 10. Develop and deliver programs to schools designated in the grant that meet the criteria for inclusion in the RUS grant; and 11. Sustain the project for the required three years: September 2014 — August 2017. This includes the following ongoing expenses: a. Yearly Connect2Texas membership fee of $4,000 for Platinum, or $3,500 for Gold. Membership fees are for a school calendar (September through August), b. Connectivity costs to RETN (if applicable). Connectivity can be made through one of two options: 1) a dedicated T1 line that would be ordered and maintained by ESC Region 11 or, 2) the member can connect via Internet, pending successful connectivity testing. Approximate cost for either option is $160 per month (billed annually); c. Warranty costs after the three year warranty expires; and d. Insurance costs from the time that equipment is delivered to Fort Worth Library. II. Assets/Ownership. Per RUS-DLT grant guidelines, ESC Region 11 is accountable for all equipment for the grant implementation period (September 1, 2014 — August 31, 2017) and is subject to audits for a three year period afterwards Should Fort Worth Library want or need to withdraw from the cooperative before September 1, 2017, it would surrender any claim to ownership of any piece of equipment to the fiscal agent If Fort Worth Library relinquishes ownership, this MOU will no longer be in effect. III. Uncontrollable costs. Anytime during the three year grant period as well as any period after implementation, all damages that might occur (fire, vandalism, theft, etc.) to equipment once the equipment is at the member's facility, is the responsibility of the member. All damaged equipment must be fixed or replaced in a timely manner. The member must offer proof of insurance covering all grant equipment during the grant period. IV. Basis for Allocation of Cost. In addition to the expenses indicated above, the member will be responsible for the following costs: MOU between ESC Region 11 and City of Fort Worth Distance Learning Page 3 of 4 A. All distance learning room costs including electricity, telephone line, and furnishings; B. Salaries and benefits for member employees that are involved with the grant; C. Travel costs for affected employees; D. Any paper or printing costs; and E. All other items not specifically covered in the grant. Authorize an Interlocal Agreement with Educational Service Center Region 11 for a Distance Learning Program at the Central Library; 2. Authorize the acceptance of donation from The Fort Worth Public Library Foundation in the amount of $14,000.00 to fund the Distance Learning Consortium membership for three years; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Special Gifts Fund in the amount of $14,000.00 for the purpose of funding consortium membership fees in association with an Interlocal Agreement with Education Service Center Region 11 for a distance learning program at the Central Library. DISCUSSION: Educational Services Center Region 11 (ESC) is one of 20 education service centers established by the Texas State Legislature in 1967. It provides professional development, technical assistance and management of educational programs to 77 public school districts and 52 charter campuses in a 10 county area in north central Texas. In 2013, the ESC applied for and received a USDA Rural Utilities Distance Learning and Telemedicine grant to establish a consortium to bring the benefits of video technology to students and teachers, to share curriculum, and to enrich learning experiences. Because of its commitment to offer learning programs for children, the Fort Worth Library (Library) was selected to become a participating consortium member. The consortium membership enables the ESC to provide the Library with distance learning equipment, technical assistance, and training necessary to deliver educational programs to schools. The Library will use the technology provided by the consortium to share its learning programs with schools that meet the grant criteria and to connect children who visit the Youth Center with learning opportunities from across the world. The Library commits to sustaining the program for three years. A membership fee is assessed each year. The Fort Worth Public Library Foundation pledged to underwrite the amount of $14,000.00 required for the three year membership commitment.
