HomeMy WebLinkAboutContract 45095 (2)ChIV2ECRET CO\3 , T Rio45t)95 First Responder and Provider Agreement This agreement Is made and entered into the 22` d day of October. 2013 the city of Fort Worth. by and through the Fort Worth Police Department, hereinafter referred to as "FRO," the Area Metropolitan Ambulance Authority, dba MedStar hereinafter referred to as "Provider," and the Emergency Physicians Advisory Board hereinafter referred to as "EPAB." RECITALS WHEREAS, the relationship between the Provider, EPAB, and the FRO is established by the Uniform EMS Ordinance and the Restated EMS Interlocal Cooperative Agreement; WHEREAS, member jurisdictions must provide first responder services within their jurisdiction; WHEREAS, each Jurisdiction adopts the Uniform EMS Ordinance giving the EPAB responsibility for providing Medical Direction for that jurisdiction's first responder FRO; WHEREAS, EPAB publishes its protocols, procedures, and policies in a document entitled the EPAB Protocols, Procedures, and Policies; WHEREAS, EPAB is responsible for, but not limited to, certification of personnel; establishing equipment requirements for first responder vehicles; and for monitoring the quality of patient care provided within the system; and WHEREAS, the Provider, EPAB, and FRO desire to formalize an agreement to comply with the Texas Department of Health rule number 157.14 entitled "Requirements for First Responder Organization Registration," section (c), paragraph (1). NOW, THEREFORE, the Provider, EPAB, and the FRO agree with the terms and conditions delineated herein. Level of Certification. a. EPAB recognizes the FRO as a Basic Life Support First Responder Oraanization. As such, the FRO is to meet all requirements listed in the EPAB policy entitled 104 First Responder Permit Levels and is to provide Advanced Life Support Services as described in that policy. b. When deemed necessary by a MedStar Ambulance Primary Paramedic to aid with patient care at a scene or during patient transport, any of the FRO's members or employees who are certified paramedics may provide ALS level care under the direct supervision of a MedStar Ambulance Primary Paramedic. In such cases, equipment, supplies, and medications from a MedStar Ambulance may be used as needed. Il_ Protocols and Medical Equipment. a. The FRO is required to adhere, when reasonable, to the EPAB Protocols, Policies, and Procedures b. The FRO must equip first response apparatus with the approved supplies and equipment as referenced in EPAB policy entitled 120 Supplies and Equipment. An inventory list is provided in Attachment A. c. Agencies recognized by EPAB as ALS level first responders must provide all medications approved in the Drug List contained in the EPAB Protocols, Policies, and Procedures. d. The FRO must also provide protective gear as required by the EPAB policy entitled 121 Protective Gear. Days and Hours of FRO Operation. a. The FRO must provide EMS first responder services 24 hours per day and seven days per week, b. In the event that such services would be interrupted, the FRO must notify the EPAB Medical Director and Provider as soon as possible. IV. Patient Care Reporting. a. The Provider, EPAB, and FRO recognize documentation of patient care is essential for effective communication and continuity of care. The FRO must adopt or develop a patient care documentation form and submit it to the EPAB Medical Director for approval. b. Attachmont B contains a copy of the FRO Patient Care Report that has been approved by the EPAB Medical Director. It is agreed that the original copy (copy 1) will be retained by the FRO and the second copy (copy 2) will be given to the Provider before the patient is transported to the hospital. EPAB has established a process to permit personnel to provide patient care within the MedStar system. FRO personnel must meet the requirements of the EPAB policies entitled 103 First Responder Personnel Permitting Process and 104 First Responder Permit Levels. b. EPAB requires ongoing testing of personnel within the MedStar system. FRO Personnel must meet the requirements of EPAB Policy entitled 107 Exams and Subscales. At any time, EPAB policy entitled 151 Demotion, Suspension, and/or Revocation of an EPAB Permit may be imposed if deemed necessary. VI. Assessment of Care Provided by the FRO. a. EPAB requires members of the MedStar system to participate in CQi reporting and meetings. The FRO must meet the requirements of the EPAB policy entitled 100 Performance improvement Program which includes but is not limited to: i. Participation in assigned committees; ii. Monthly reporting of QA findings; and Ili. Submission of data into EPAB registries such as the early defibrillation registry. VII. FRO Response Code Policies, a. The FRO agrees to respond to requests for service when deemed necessary by the MedStar Emergency Medical Dispatch protocols and policies approved by the EPAB Medical Director. b. The FRO may adopt other response policies that may be necessary to assure the safety and well being of their personnel and community. When such additional policies affect responses to medical situations, approval from the EPAB Medical Director is required. VIiI. On -scene Chain of Command Policies. a. In addition to the FRO's standard operating procedures related to the chain of command, FRO must recognize the MedStar Ambulance Primary Paramedic as the highest ranking medically trained EMS person on scene. b. The FRO shall comply with EPAB policy entitled 130 Incident Command System, including training of supervisory personnel. While a first responder FRO may be responsible for incident command, the MedStar Ambulance Primary Paramedics and are responsible for patient care and transport decisions in accordance with EPAB policies entitled 130 Incident Command System, 131 Patient Transportation and 132 Helicopter Utilization and Safety. IX. Cancollation of Ambulances. a. The FRO may cancel ambulance responses in accordance with EPAB policy entitled 134 Cancellation of Ambulances by First Responders. X. First Responder Personnel Accompanying Patients on Amahulances. a. When deemed necessary by the MedStar Ambulance Primary Paramedic, the FRO agrees to allow at least one EMS certified person to assist with patient care on -board an ambulance during transport. XI.
