AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE SPECIAL ASSESSMENTS FUND IN THE AMOUNT
OF $444,000 FROM AVAILABLE FUNDS FOR THE PURPOSE OF
TRANSFERRING SAID FUNDS TO THE 2004 STREET IMPROVEMENTS
FUND; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1
That in addition to those amounts allocated to the various City departments for Fiscal Year 2007-
2008 in the Budget of the City Manager, there shall also be increased estimated receipts and
appropriations in the Special Assessments Fund in the amount of $444,000 from available funds for
the purpose of transferring said funds to the 2004 Street Improvements Fund.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid,
inoperative or void for any reason. by a court of competent jurisdiction, such decision, opinion or
judgment shall in no way impair the remaining portions, sections, or parts of sections of this
ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 17749 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance
are in direct conflict with such other ordinances and appropriations, in which instance said
conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
ADOPTED AND EFFECTIVE: October 9, 2007
This ordinance shall take effect upon adoption.

RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Special Assessments Fund in the amount of $444,000.00 from available funds;
2. Authorize the transfer of $444,000.00 from the Special assessments Fund to the 2004 Street
Improvements Fund;
3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the 2004
Street Improvements Fund in the amount of $444,000.00 from available funds; and
4. Authorize the City Manager to execute Amendment No. 1 to city Secretary Contract No. 34445, an
Engineering Services Agreement with Freese & Nichols, Inc., in the amount of $576,320.00 for the design
of Precinct Line Road from Hurst Boulevard to Concho Trail thereby increasing the total amount to
$839,666.00.
DISCUSSION:
The 2004 Capital Improvement Program (CIP) contains $635,000 for design and construction of this four-
lane divided roadway 1,000 feet north and south of Trinity Boulevard, and $1,650,000 for the reconstruction
of the bridge over Walkers Branch. In addition, $444,000 was set aside in the Special Assessments Fund
for the project. Subsequently the 2006 Tarrant County Bond Program approved $2,729,000 to supplement
City of Fort Worth funding for Precinct Line Road with extended limits on the north to SH-10; and $800,000
additional Federal transportation funding has been earmarked for Precinct Line Road with extended limits
on the south to Trammel Davis Road.
On December 12, 2006, (M&C C-21884) the City Council adopted Ordinance No. 17315 finding that a
material change had occurred for the 2004 Capital Improvement Program street reconstruction project,
Precinct Line Road from 1,000' North of Trinity Blvd to 1,000' South of Trinity Boulevard, to extend the limits
from Hurst Boulevard (SH 10) to Trammel Davis Road; and authorized the City Manager to execute an
Engineering Services Agreement with Freese & Nichols, Inc. in the amount of $263,346.00 for the
schematic design of Precinct Line Road from Hurst Boulevard to Trammel Davis Road (City Secretary
Contract No. 34445).

This engineering services amendment is needed for the preparation of surveys, environmental documents,
final construction plans and specifications for the reconstruction of Precinct Line Road from Hurst Boulevard
to Concho Trail. During the schematic design phase, it was determined that the southern project limit
needed to be shortened from Trammel Davis Road to Concho Trail because of additional expenses
required for environmental mitigation, right-of--way acquisition, and roadway construction. The existing two-
lane rural roadway will be improved to a four-lane divided roadway with curb and gutter. The initial scope of
work was for initial planning and schematic design services. Freese & Nichols, Inc. did quality work in
preparing the schematic design, and are best qualified to continue with the final engineering services.
Freese & Nichols, Inc., has proposed to perform the necessary surveys, environmental documents, final
plans and specifications for a lump sum fee of $576,320.00. City Staff considers this fee to be fair and
reasonable for the scope of services to be performed.
Freese & Nichols, Inc., is in compliance with the City's MM/BE Ordinance by committing to 32 percent
M/UVBE participation on this amendment. The City's goal on this amendment is 32 percent.
This project is located in COUNCIL DISTRICTS 4 and 5, MAPSCO 52Z, 66D, and 67A.
FISCAL. INFORMATION/CERTIFICATION:
The Finance Director certifies that upon approval of the above recommendations, and adoption of the
attached appropriation ordinances ,funds will be available in the current capital budget, as appropriated, of
the 2004 Street Improvements Fund.
