AMENDMENT No . 1
TO CITY SECRETARY CONTRACT
WHEREAS, the City of Fort Worth (CITY) and Teague Nall and Perkins,
Inc., (ENGINEER) made and entered into City Secretary Contract No. 43893,
(the CONTRACT) which was authorized by the City Council on the 23rd day
of October, 2012 in the amount of $563,730.92; and
WHEREAS, the CONTRACT involves engineering services for the following
project:
Chapel Creek Bridge over Interstate Highway 30
WHEREAS, it has become necessary to execute Amendment No. 1 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:
1.
Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated June 24, 2013, a copy
of which is attached hereto and incorporated herein. The cost to City
for the additional design services to be performed by Engineer totals
$226,205.00.
2.
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $789,935,92,
3.
All other provisions of the Contract, which are not expressly
amended herein, shall remain in full force and effect.

I. Feasibility study, Operations Analysis and Geometric Design for additional U-Turn Bridge:
Teague, Nall and Perkins (TNP) performed due diligence during contract scoping phase to identify
the need to include a U-Turn bridge. Records from TxDOT and City of Fort Worth staff discussions
indicated that a U-Turn was not to be included. Upon notice to proceed, a Design Concept
Conference was held and TxDOT requested that a U-Turn feasibility analysis be conducted and
contingent upon results, U-Turn be added to the project. Feasibility was determined and
Preliminary design was performed.
A travel demand forecast study was performed to determine validity of a dated TxDOT-TPP
travel demand forecast by comparison to NCTCOG node map volumes at the request of TXDOT.
Results were used to prepare a detailed traffic operation analysis. This work is excluded in the
scope of services. TNP requested that TxDOT perform this service by TPP staff and were
instructed to perform the analysis.
Fee: $38,575
II. U-Turn Structure Final Design:
The additional U-Turn bridge will require bridge layout, foundation design, and framing detail
design services for construction bidding according to TxDOT/FHWA requirements. Turning radius
analysis for interstate truck vehicles indicate that special construction methods be employed to
provide for turning radii at the bridge ends, thus requiring the use of curved steel beam framing
and many other details to provide an aesthetically pleasing and functional structure.

III. Extend Construction Limits:
The original scope of service and fee assumptions state that the construction limits at the
approaches would stay within 200 feet of the bridge due to no significant changes to the bridge

elevation or U-Turn bridge. It has since been established that the bridge needs to be elevated to
provide additional IH 30 main lane clearance. Additional frontage road approach lane
improvements are necessary to accommodate the U-Turn. TNP has mitigated the effects of
clearance requirement by use of low profile beams, but there still remains a need to increase the
Chapel Creek Blvd profile over IH 30 that results in extended construction limits. Additional need
to extend the construction limits is presented by traffic operations need to store queuing traffic at
signal approaches. The proposed fee is to provide for additional design sheets, cross section
design, and driveway profiles.
Fee: $13,200
IV. Additional Retaining Walls:
During the course Geometric Design development, the need for two (2) additional retaining walls
has been identified. One located along the proposed Chapel Creek Boulevard ROW at the
Exxon Station that reduces encroachment on a storm water detention basin. The other wall is
required along Leonard Golf Links property. Both walls will limit encroachment into vital business
improvements; therefore the use of retaining wall translates into lowered damages to the
businesses. Additional geotechnical investigations are included in the proposed fee.
Design Fee: $12,000

V. Additional ROW Fee Take Parcels and Easements:
During the course of Geometric Design development and ROW surveying, it was noted that a
parcel was sub -divided into many smaller lots. Therefore, the anticipated numbers of ROW fee
take parcels will increase by twelve (12) parcels from four (4) to sixteen (16) ROW fee take
exhibits.
The project will also require four (4) temporary construction easements for driveways that TxDOT
will require exhibits.
Survey Fee (DBE): $45,440+$6,000= $51,440

TNP proposes a revised project schedule that accounts for public involvement delay associated
with U-Turn services and associated TxDOT approvals. The changes are not anticipated to
affect letting schedule.

RECOMMENDATION:
It is recommended that the City Council authorize the execution of Amendment No. 1 to City
Secretary Contract No. 43893, an Engineering Services Agreement with Teague Nall and Perkins,
Inc., in the amount of $226,205.00 for the Design of Chapel Creek Bridge over Interstate Highway 30,
thereby establishing a revised total contract cost in the amount of $789,935.92.
DISCUSSION:
This Professional Services Agreement provides for the design of a new six -lane bridge across
Interstate Highway 30 (IH-30) to serve Chapel Creek Boulevard. The Texas Department of
Transportation has asked that the City expand the scope of the design to include the addition of a
second turnaround at the bridge that will serve the eastbound traffic on IH-30. The proposed design
amendment will provide the services necessary to accomplish the modification in scope. Funding for
this Agreement includes the amount of $309,016.00 of 2008 Capital Improvement Program (CIP)
funds (or 19 percent of the total). The balance is being provided by Federal and State Funds. There
are sufficient funds remaining from these original amounts to pay for the additional design work.
On May 8, 2012, (M&C C-25607) the City Council authorized the execution of a Local Project
Advance Funding Agreement with the Texas Department of Transportation (TxDOT) in the amount of
$1,650,059.00 for the design of the Chapel Creek Bridge over IH-30.
On October 23, 2012, (M&C C-25937) the City Council authorized the execution of Engineering
Services Contract No. 43893 with Teague Nall and Perkins, Inc., for the design of Chapel Creek
Bridge over IH-30.

The proposed amendment will provide for a feasibility study, traffic operations analysis, geometric
and final design of the additional U-turn bridge, extend the design limits along the IH-30 frontage
roads and Chapel Creek Boulevard due to the higher required elevation of the new bridge, design two
additional retaining walls, and to prepare additional right-of-way easements and exhibits.
Teague Nall and Perkins, Inc., proposes to complete Amendment No. 1 for a lump sum fee not to
exceed $226,205.00, for a revised total contract amount not to exceed $769,935,92, Staff considers
this fee to be fair and reasonable for the scope of services to be performed.
M/WBE Office - Teague Nall and Perkins, Inc., is in compliance with the City's DBE Ordinance by
committing to an additional 25 percent DBE participation on this Amendment No. 1. The City's DBE
goal on this Amendment is 22 percent.
This project is located in COUNCIL DISTRICT 3, Mapsco 72K.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that funds are available in the current capital
budget, as appropriated, of the Grant Capital Projects Fund.
