MEMORANDUM OF UNDERSTANDING
BETWEEN THE CITIES OF FORT WORTH, ARLINGTON,
BEDFORD, HURST, NORTH RICHLAND HILLS,
AND COUNTY OF TARRANT, TEXAS
2011 BYRNE JUSTICE ASSISTANCE GRANT (JAG) FORMULA PROGRAM AWARD
This Agreement is made and entered into this ZL day of 17ece �n�e,r 2011, by and between the
COUNTY of TARRANT, acting by and through its duly authorized representative, hereinafter
referred to as COUNTY, the CITY of FORT WORTH, acting by and through its duly authorized
representative, hereinafter referred to as CITY, and the Cities of Arlington, Bedford, Hurst, North
Richland Hills, acting by and through their duly authorized representatives, and hereinafter
collectively referred to as SUBRECIPIENT or individually by name, located entirely within the State of
Texas, witnesseth:
WHEREAS, each governing body finds that the performance of this Agreement is in the best
interests of all parties, that the undertaking will benefit the public, and that the division of costs fairly
compensates the performing party for the services or functions under this Agreement; and
WHEREAS, under the 2011 Byrne Justice Assistance Grant (JAG), the Department of Justice
(DOJ) has awarded a total of $697,332 to be distributed to the parties to this Agreement, hereafter
referred to as JAG award; and
WHEREAS, the CITY has agreed to serve as the fiscal agent for the JAG award, and distribute all
such funds between the cooperating parties; and
WHEREAS, the CITY, COUNTY and SUBRECIPIENTS believe it to be in their best interests to
reallocate the JAG award as set forth herein.
NOW THEREFORE, the CITY, COUNTY, and SUBRECIPIENTS agree as follows:
Section 1.
CITY agrees to provide the COUNTY $65,055 from the JAG award.
ARLINGTON agrees to provide the COUNTY $35,025 from the JAG award.
BEDFORD agrees to provide the COUNTY $3,390 from the JAG award.
HURST agrees to provide the COUNTY $2,864 from the JAG award.
NORTH RICHLAND HILLS agrees to provide the COUNTY $3,493 from the JAG award.
Section 2.
CITY agrees to reimburse the COUNTY a total of $120,742 from the JAG award.
CITY agrees to reimburse SUBRECIPIENT ARLINGTON a total of $183,882 from the JAG award.
CITY agrees to reimburse SUBRECIPIENT BEDFORD a total of $17,799 from the JAG award.
CITY agrees to reimburse SUBRECIPIENT HURST a total of $15,033 from the JAG award.
CITY agrees to reimburse SUBRECIPIENT NORTH RICHLAND HILLS a total of $18,337 from the
JAG award.

Section 3.
The above parties agree to utilize their jurisdiction's individual award as outlined in a separate
Memorandum of Understanding between CITY and the individual SUBRECIPIENTS or COUNTY.
Section 4.
It is expressly understood and agreed that, in the execution of this Agreement, no party waives, nor
shall be deemed hereby to waive, any immunity or defense that would otherwise be available to it
against claims arising in the exercise of governmental powers and functions.
Section 5.
Each party to this Agreement will be responsible for its own actions in providing services under this
Agreement and shall not be liable for any civil liability that may arise from the furnishing of the services
by any other party.
Section 6.
This Agreement creates no rights in any third party.
Section 7.
As to each individual party, this Agreement incorporates by reference the terms and conditions
contained in the following three additional documents, as if set forth at length herein: (1) the
Memorandum of Understanding between CITY and the individual SUBRECIPIENTS or COUNTY; (2)
the applicable Grant Award Agreement; and (3) the individual SUBRECIPIENT'S budget submitted in
connection with this grant award. With the exception of those aforementioned agreements and/or
documents, this Agreement contains all commitments and agreements of the parties, and no oral or
written commitments have any force or effect to alter any term or condition of this Agreement, unless in
writing and signed by authorized representatives of all parties.

Conduct a Public Hearing and Ratify Application for and Authorize Acceptance of a $697,332.00 Grant
from the Fiscal Year 2011 Edward Byrne Memorial Justice Assistance Grant Formula Program from the
United States Department of Justice, Office of Justice Programs and Bureau of Justice Assistance,
Authorize Execution of Grant Agreement and Related Memoranda of Understanding with Tarrant County
and Cities Located in Tarrant County, Authorize Use of Anticipated Interest in the Amount of $10,000.00
and Adopt Appropriation Ordinance (ALL COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council:
1. Ratify the application for and authorize acceptance of a grant from the Fiscal Year 2011 Edward Byrne
Memorial Justice Assistance Grant Formula Program from the United States Department of Justice, Office
of Justice Programs and Bureau of Justice Assistance in an amount not to exceed $697,332.00;
2. Authorize the acceptance of grant funds, if awarded, in an amount not to exceed $697,332.00;
3. Authorize the execution of Memoranda of Understanding with Tarrant County and other cities located
within Tarrant County to designate the City of Fort Worth as the cognizant fiscal agency for the purpose of
administrating this grant and the manner in which the grant money will be disbursed and utilized;
4. Authorize the use of anticipated interest in the amount of $10,000.00 in accordance with the grant;
and
5. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Grants Fund in the amount of $707,332.00, subject to receipt of the grant.
DISCUSSION:
The Fiscal Year 2011 Edward Byrne Memorial Justice Assistance Grant (JAG) Formula Program allows
local governments to support a broad range of activities to prevent crime and to improve the criminal
justice system. The City of Fort Worth, along with the cities of Arlington, Bedford, Hurst and North
Richland Hills are required to negotiate with Tarrant County to develop a program budget and
strategy. The cities included in this Application have worked on collaborative projects for the past 20
years including intelligence sharing, crime analysis, juvenile and adult drug treatment and the 2005-2010
Justice Assistance Grant (JAG) Formula and Recovery Act JAG Programs. Following the announcement
of the Fiscal Year 2011 JAG, representatives from the below listed agencies agreed that the City of Fort
Worth should again serve as the cognizant agency for the Fiscal Year 2011 JAG Formula Program.
A total of $697,332.00 is available to be shared among the below listed jurisdictions and will be distributed
in the following manner:

No matching funds are required. Fort Worth was responsible for submitting the full grant application and
will, upon receipt of the grant funds, distribute funding to the other jurisdictions, as agreed among the
above entities.
The City of Fort Worth's funding will provide eight new marked vehicles and the equipment to outfit these
vehicles for the Criminal Highway Interdiction (CHI) Unit that is being created. The establishment of this
Unit is a top priority for the Department, but with budget constraints, funding has not been available. The
Police Department does not have within its organizational structure a Domestic Highway Enforcement
Unit. The CHI Unit will consist of seven police officers and one police sergeant. The purpose of the CHI
Unit will be to conduct highway enforcement of existing traffic laws and subsequent roadside
investigations in an overt effort to detect, disrupt, thwart, gain intelligence within and to arrest those
persons and/or entities involved in the illegal transportation of the following items of concern:
• Illicit narcotics,
• Illicit currency related to the proceeds (or funding) of narcotics trafficking and/or terrorism,
• Human trafficking of deportable aliens,
• Human trafficking of those individuals related to known or unknown terrorist cells, and
• Transportation of weapons of mass destruction.
FISCAL INFORMATION /CERTIFICATION:
The Financial Management Services Director certifies that upon approval of the above recommendations,
receipt of the grant, and adoption of the attached appropriation ordinance, funds will be available in the
current operating budget, as appropriated, of the Grants Fund.
