AMENDMENT No . 1 SEC `'ETAW CORM RACY r} o � TO CITY SECRETARY CONTRACT No. 43427 WHEREAS, the City of Fort Worth (CITY) and KiL ey-Horn and Associates, Inc., (ENGINEER) made and entered into City Secretary Contract No. 43427, (the CONTRACT) which was authorized City Council by M&C C-25728 on the 24th day of July, 2012 in the amount of $ 453,700,. and WHEREAS, the CONTRACT involves engineering services for the following project. Old Decatur- McLeroy Blvd. to Longhorn Road; and WHEREAS, it has become necessary to execute Amendment No. 1 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated March 5, 2013, a copy of which is attached hereto and incorporated herein. The cost to City for. the additional design services to be performed by Engineer totals $320,500. (See Attached Funding Breakdown Sheet, Page -3-) 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $774,200. 3. All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. No. 01807 Old Decatur Road - McLeroy Boulevard to Longhorn Road Dear Mr. Bennett: Kimley-Horn and Associates, Inc. (Engineer) is pleased to submit this Letter Agreement to the City of Fort Worth (City) to provide professional services to prepare additional design services for the Old Decatur Road (McLeroy Boulevard to Longhorn Road) project. Our scope of services, schedule and fee are below. Scone of Services Task 1-Roundabout Design The Engineer will perform the following services for the design of two (2) roundabouts. The roundabouts will be located at the Marine Creek Parkway and Cromwell Marine Creek Road intersection and the Marine Creek Parkway and Longhorn Road intersection. A. Intersection Evaluation and Operational Analysis The Engineer will analyze intersection traffic data at each intersection location, including daily and peak hour volumes for both the current year (2013) and a projected 20-year design year (2033). Engineer will analyze current year and design year conditions for up to two (2) scenarios: 1) A dual -lane roundabout; and 2) A dual -lane roundabout with bypass lane options. As part of the intersection evaluation Engineer will prepare a level of service analysis for the current year and 20-year output for both a roundabout design and a traffic signal. Engineer will also provide a technical memorandum that will include level of service comparisons for each scenario, average delay per vehicle for each leg of the intersection, and total delay for the intersection for each condition studied. ■ TEI. 817 335 6511 FAX 817 335 5070 ■ Suite 950 801 Cherry Street, Unit#11 Fort Worth, Texas 76102-6811 F _„Kimley-Horn Mr. Mike Bennett, P.E., March 5, 2013, Page 3 and Associates, Inc. • Evaluate drainage design considerations and proposed inlet locations. • Layout proposed street light locations and conduit. • Develop signing and striping layouts • Finalize lane markings and lane assignments • Prepare future conditions layout — signing, marking and paving layout (if necessary). • Finalize the typical sections • Develop a traffic control sequencing plan and identify potential staging conflicts with the roundabout design at each intersection. D. Final Roundabout Design — 90% and Final Upon City approval of the 60% design Engineer will develop the roundabout design for each intersection to a 90% and final level of completion. During this stage the following services will be provided: 1. Roundabout General Sheets Engineer shall prepare associated sheets for the development of the 100% plan set, including: • AutoTURN® Turn Movement Sheets for each roundabout • Standard Details (splitter island, central island with truck apron, etc.) • Geometric Control Sheet for each roundabout 2. Pavin Pg_lans Engineer shall prepare associated paving sheets for each intersection: • Roundabout Plan Sheet • Profile Sheet • Jointing Sheet • Grading Plan Sheet • Future Conditions paving sheet (if necessary) 3. Pavement Markinor Plans Engineer shall prepare permanent pavement marking design of each roundabout and connecting legs to show center, edge and lane line striping, yield lines, crosswalks, arrows, legends, and symbols, pavement markers, delineation or other markings in conformance to the requirements of the latest version of the Manual on Uniform Traffic Control Devices (MUTCD). The Engineer shall confer with the City to determine which types of marking or delineation materials are appropriate for the project. 4. .Signing P_I, Kimley-Horn hh� = and Associates, Inc. A. Design Management Mr. Mike Bennett, P.E., March 5, 2013, Page 5 • Project Management. Engineer will develop a project workplan including manweek schedule and milestones and conduct internal design team meetings. • Communication and Reporting. Prepare invoices and submit monthly, prepare and submit monthly progress reports, submit project schedule updates, and complete monthly Mf"E Report form. B. Conceptual Design • Prepare typical section of the 4 lane divided arterial (M4D) with bike lanes. • Determine right -of --way and easements necessary for roadway and drainage. • Prepare preliminary roadway plan and profile for the 2,2001inear feet of Marine Creek Parkway included in this amendment. Items to include the items listed in the original design contract Attachment "A" Scope of Services Task 2.3 • Prepare preliminary drainage design. Engineer will perform the tasks listed in the original design contract Attachment "A" Scope of Services Task 2.3 — Conceptual Design Package. • Conceptual iSWM Checklist in accordance with the current iSWM Criteria Manual for Site Development and Construction. Include documentation that the proposed storm water project will not impact upstream and downstream properties. • Prepare plans for minor City utility adjustments. • Identify utility conflicts with proposed roadway and storm drain design. • Develop preliminary traffic control plan narrative and suggested sequence of construction including paving and storm drain construction phasing. • Prepare an opinion of probable construction cost. • Provide one (1) hard copy (I" = 100' horizontal scale) of the conceptual design submittal and upload a PDF and .DWF to buzzsaw. C. Preliminary Design Preliminary plans (60%) shall be submitted to the City per the approved project schedule. Develop preliminary design drawings (22"x34" plan sheets at a scale of 1 "=20' horizontal and 1 "=4' vertical) shall include the following: • Cover and Index • Project Control • Right -of -Way Strip Map and Easement Layout IIIF'�Kimley-Horn \=I, and Associates, Inc. F. Right of Way and Easement Services Mr. Mike Bennett, P.E., March 5, 2013, Page 7 Prepare up to four (4) individual parcel exhibits. Individual parcel exhibits shall be on 8'/z"xl1" or 8%2"xl4" paper, shall be sealed, dated, and signed by a Registered Professional Land Surveyor and shall contain the following: • Parcel number. • Area required. • Legal description of the property. • Current owner. • Any existing easements provided by utility companies. • All physical features. • Metes and bounds description of parcel to be acquired. The description shall be provided on a separate sheet from the exhibit. Each type of easement shall be described separately. The above items are necessary for the acquisition ofright-of--way required to construct Project. Said information shall be required prior to acceptance of fmal construction plans. Upon written notification by City of acceptance of the right -of --way strip map, exhibits and instruments, and as directed by City, Engineer's surveyor shall set all corners and points of curvature and tangency for the proposed right -of --way and submit final sealed plans and exhibits, including location of the control points and their coordinates. Right -of -Way Research The Engineer shall determine rights -of --way and easement needs for construction of the project. Required temporary and permanent easements will be identified based on available information and recommendations will be made for approval by the City. Right-of-Way/Easement Preparation and Submittal The Engineer shall prepare documents to be used to obtain right -of --way and permanent and/or temporary easements required to construct the improvements. The documentation shall be provided in conformance with the checklists and templates available on the City's Buzzsaw site. Preliminary and Final Plat The Engineer will prepare a preliminary plat for the property per City criteria. The Engineer will meet with City staff to coordinate the submittal rPr� =„ Kimley-Horn `= and Associates, Inc. Mr. Mike Bennett, P.E., March 5, 2013, Page 9 o Prior to entering property, the Engineer shall prepare, mail and obtain Temporary Right of Entry from landowners. o The documentation shall be provided in conformance with the checklists and templates available on the City's Buzzsaw site. Subsurface Utility Engineering Provide Subsurface Utility Engineering (SUE) to Quality Level D,C,B,&A, as described in the original contract Exhibit A Scope of Services. The SUE shall be performed in accordance with CUASCE 38m02. Expose and locate utilities at specific locations for up to five (5) specific locations for Level A SUE. Task 3 —Cromwell Marine Creek Road Preliminary Design The Engineer will perform the following services for the design of 4,000 linear feet of roadway along Cromwell Marine Creek Road from approximately 400 feet east of Crystal Lake Drive east to Longhorn Road. The alignment of Cromwell Marine Creek Road will shift south at Stonewater Bend Trail and connect to Marine Creek Parkway at the Longhorn Road and Marine Creek Parkway intersection. The alignment will follow the City of Fort Worth's Master Thoroughfare Plan and the conceptual alignment developed in the original contract. The project will also include designing an approximately 250 foot three. span prestressed slab beam bridge that will accommodate the northern half of the roadway crossing Cromwell Marine Creek - 38 foot wide roadway and sidewalk width. The southern half of the bridge spanning Cromwell Marine Creek was designed and constructed with City Project No. 00478 — Marine Creek Bridge and will remain in place. The project will also include: sidewalks, storm drain, two culvert crossings, retaining walls, pavement markings and signage, street lighting, traffic control, right-of-way and easement determination and construction contract administration. A. Design Management • Project Management. Engineer will develop a project workplan including manweek schedule and milestones and conduct internal design team meetings. • Communication and Reporting. Prepare invoices and submit monthly, prepare and submit monthly progress reports, submit project schedule updates, and complete monthly M/WBE Report form. Kimley-Horn and Associates, Inc. Mr. Mike Bennett, P.E., March 5, 2013, Page 11 alignment of Cromwell Marine Creek Road will shift south at Stonewater Bend Trail and connect to Marine Creek Parkway at the Longhorn Road and Marine Creek Parkway intersection. The survey will include the proposed 110 foot right -of --way plus an additional 40' outside of right-of-way. • Ground survey shall consist of all visible existing features above ground level. These features shall include, but are not limited to, telephone poles, power poles, utilities, utility markers, fences, retaining walls, water meters, detector check valves, manholes, vaults, sprinkler heads, structures, culvert pipes, buildings, trees (6" caliper and up) and any other facilities in close proximity to the construction. • Coordinate with franchise utility companies to locate and mark their utilities prior to performing the field survey. • Prepare digital terrain model (DTM). • Tie all public improvements to existing City of Fort Worth monument system. • Prepare a final topographic drawing in digital format (including contours and breaklines) showing the features located in the field as well as right -of --way strip map information, an ASCII coordinate file of the points located in the field, and a hard copy of the coordinates and feature descriptions. • Temporary Right of Entry Preparation and Submittal o Prior to entering property, the Engineer shall prepare, mail and obtain Temporary Right of Entry from landowners. o The documentation shall be provided in conformance with the checklists and templates available on the City's Buzzsaw site. Additional Services Any services not specifically provided for in the above scope will be considered additional services and can be performed at our then current hourly rates. Schedule Engineer will provide our services within a reasonable length of time as expeditiously as practical. Upon receiving a work request from the City with a request for a schedule, Engineer will prepare a schedule outlining the time required to complete the work requested. Payment of all fees will be due within 30 days of your receipt of the invoice. The Engineer will subcontract a portion of these services to Gorrondona & Associates, Inc. and Rios Group. The amount we anticipate subcontracting is $56,325. This represents an M/WBE participation percentage of 17.6% for these additional services. With these additional services, our revised contract amount will be $774,200. This will revise our total contract M/WBE participation from $919100 (20.1%) to $147,425 (19.0%). Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Transportation Impact Fund in the amount of $320,500.00 from available funds; and 2. Authorize the execution of Amendment No. 1 to City Secretary Contract No. 43427, an Engineering Agreement, with Kimley—Horn Associates, Inc., in the amount of $320,500.00 for the design of Old Decatur Road from McLeroy Boulevard to Longhorn Road, thereby increasing the total contract in the amount of $774,200.00. DISCUSSION: This Agreement is for design services associated with expanding Old Decatur Road from a three —lane undivided roadway to a four —lane divided arterial from McLeroy Boulevard to Longhorn Road in accordance with the City's Master Thoroughfare Plan. The 2008 Bond Program included funds for the project design. This contract amendment is for additional engineering services required to modify the existing engineering design from signalized intersections to roundabout intersections at Old Decatur Road and Longhorn Road and at Old Decatur Road and Cromwell Marine Creek Road, to extend Old Decatur Road from Longhorn Road to 300 feet north of Grayson Ridge Drive, and for preliminary design of Cromwell Marine Creek Road from Longhorn Road to 350 feet east of Crystal Lake Drive. Funds for this amendment will be provided from Transportation Impact Fee revenues.
