HomeMy WebLinkAboutContract 44220-A3STATE OF TEXAS § COUNTY OF TARRANT § KNOWN ALL BY THESE PRESENTS: THIRD AMENDMENT TO CITY SECRETARY CONTRACT NO. 44220 THIS THIRD AMENDMENT to City Secretary Contract No. 44220 is entered into by and between the City of Fort Worth ("City"), a home -rule municipality in the State of Texas, acting through Fernando Costa, its duly authorized Assistant City Manager, and Lindamood Demolition, Inc. ("Contractor"), acting through Kayla Lindamood, its duly authorized President. WHEREAS, the City and Lindamood Demolition, Inc. have entered into that certain agreement identified as City Secretary Contract No. 44220 (also the "Contract") commencing on February 27, 2013 for services involving structural demolition and removal, transportation, and disposal of asbestos containing materials as authorized by Mayor and Council Communication C-26017; and WHEREAS, Mayor and Council Communication C-26017 provides for the extension of the term of the agreement for up to three additional periods of one year each; and WHEREAS, the parties wish to extend the term of the contract for an additional year (final year) and sufficient funds have been appropriated; and WHEREAS, Mayor and Council Communication C-27107 authorized an increase in the aggregate annual maximum amount for all contracts issued under authority of Mayor and Council Communication C-26017 from $650,000 to $812,500; and WHEREAS, the parties agree that all other conditions, terms, and pricing shall remain the same as stated in City Secretary Contract No. 44220 as amended by City Secretary Contract No. 44220-A2; NOW, THEREFORE, for and in consideration of the mutual covenants contained herein, and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged and confessed, the parties hereto agree as follows: 1. Extended term of contract: City Secretary Contract number 44220 as amended by City Secretary Contract number 44220-A2 is extended to include the term beginning February 27, 2016 and ending February 26, 2017. DISCUSSION: Mayor and Council Communication (M&C C-26017, approved on December 18, 2012) authorized the execution of non-exclusive annual contracts with Garrett Demolition, Inc., (City Secretary Contract No. 44188), Intercon Environmental, Inc., (City Secretary Contract No. 44189) and Lindamood Demolition, Inc., (City Secretary Contract No. 44220) for structural demolition and asbestos abatement services for all City departments with a combined not to exceed a total expenditure of $650,000.00 across all three contracts during any one-year term. Total expenditures during the original one-year contract term were $455,715.19. However, during the current (first renewal) term, total expenditures have reached approximately $611,000.00 with three months remaining in the annual term. The amount of work expected for the remainder of the term will exceed the $650,000.00 combined annual limit. A similar volume of work is anticipated for at least the next two years mainly due to an increase in the number of substandard structures being demolished by the Code Compliance Department. The increased aggregate not to exceed amount recommended by this Mayor and Council Communication will allow for continued uninterrupted asbestos abatement and demolition services on an as -needed basis to all City departments. The project will serve in ALL COUNCIL DISTRICTS. DISCUSSION: A Request for Qualifications (RFQ) for the provision of structural demolition and removal, transportation, and disposal of asbestos containing materials on an annual contract basis was advertised in the Fort Worth Star -Telegram on June 7, 2012 and June 14, 2012. On July 26, 2012, seven firms submitted qualifications. Submittals from each of the seven firms were reviewed and rated based on the published weighted selection criteria. The six criteria and their respective weightings are: (1) the firm's past experience and references (50 percent), (2) the prime contractor's proposed project team members and their experience (10 percent), (3) the qualifications of the provider's subcontractors (15 percent), (4) the proposed M/WBE participation and plan (15 percent), (5) the contractor's legal history (five percent), and (6) the contractor's work history with the City (five percent). The seven firms and their resultant weightings were: Intercon Environmental, Inc. 91 points Garrett Demolition, Inc. 90 points Lindamood Demolition, Inc. 86 points Cactus Abatement and Demolition, LLC 77 points RNDI Companies, Inc. 76 points Midwest Wrecking Co. of Texas, Inc. 66 points Lloyd D. Nabors Demolition, LLC 61 points Based on these reviews, the top three rated firms are Garrett Demolition, Inc., Intercon Environmental, Inc., and Lindamood Demolition, Inc. A separate contract will be established with each of the three top rated firms. The contract services will be performed on an as -needed basis. Each firm will be asked to submit a cost for each identified project, the lowest cost contractor will be issued a Task Order to complete the project.
