Home My WebLink AboutContract 44847� s.l , 1 •' S INTERLOCAL AGREEMENT BETWEEN THE TARRANT REGIONAL WATER DISTRICT AND THE CITY OF FORT WORTH This Agreement is entered into by between the Tarrant Regional Water District, acting by and through Jim Oliver, its duly authorized General Manager (hereinafter referred to as the "District"), and the City of Fort Worth, acting by and through Susan Alanis, its duly authorized Assistant City Manager (hereinafter referi•ed to as "City"), both of Tarrant County, State of Texas. The District and City may be referred to individually as a"Party" and collectively as the "Parties" WHEREAS, THIS Agreement is made under the authority of Sections 791.001 — 791.029, Texas Government Code; and WHEREAS, each governing body, in performing for the performance of governmental functions hereunder, governmental fiinctions or in paying shall make that performance or those payments from current revenues legally available to that party; and WHEREAS, each governing body finds that the performance of this Agreement is in the common interest of both parties, that the undertaking will benefit the public and that the diversion of costs fairly compensates the performing party for the services or functions under this agreement; and WHEREAS, the Transportation Enhancement Program, administered by the Texas Department of Transportation, provides funding for the purpose of expanding transportation choices and enhancing the transportation experience; and WHEREAS, on December 11, 2009 the City of Fort Worth applied for, and was awarded funding for the Neighborhood Transportation Connections for Pedestrians and Bicycles Project (the "Project") through the Transportation Enhancement Program; and WHEREAS, on May3, 2011, the Fort Worth City Council adopted Resolution 3984-OS- 2011, a copy of which is attached hereto as Exhibit "A", including the exhibits thereto, which outlines the City's execution of a local project advance funding agreement with the Texas Department of Transportation for Design and Construction of the Neighborhood Transportation Connections for Pedestrians and Bicycles Project; and WHEREAS, a portion of the required local matching funds will be provided by Streams and Valleys, Inc.; and WHEREAS, the District has agreed to provide additional local funding to implement the Project. ,� �,. � _ r� � � P E C E I\� E D 5��' � 4�i1'iJ 1 I FT. WORTH, YX NOW THEREFORE, the District and City agree as follows: The District shall provide fiinding to the City in the amount of $14,000.00 to complete the local match funding of the Project. TRWD will provide this amount as advanced funding. The City will continue with the design and construction components of the Project pursuant to its agreement with TXDOT. This Agreement shall become effective upon its approval by each Party's governing body and dated execution by each Party's authorized signatory. DISCUSSION: The purpose of this Mayor and Council Communication is to authorize the City Manager to execute an Interlocal Agreement with the Tarrant Regional Water District for additional local funding of the Neighborhood Transportation Connections for Pedestrians and Bicycles Project. The Transportation Enhancement Program, administered by the Texas Department of Transportation (TxDOT), provides funding for the purpose of expanding transportation choices and enhancing the transportation experience. The City of Fort Worth applied for and was awarded funding in the amount of $4,416,000.00 for the Neighborhood Transportation Connections for Pedestrians and Bicycles Project. On the May 3, 2011, City Council adopted Resolution 3984-05-2011, which authorized the execution of a Local Project Advance Funding Agreement with TxDOT for Design and Construction of the Neighborhood Transportation Connections for Pedestrians and Bicycles Project. The required local matching funds in the amount of $1,104,025.00 will be provided by Streams and Valleys, Inc., the City and the Tarrant Regional Water District (TRWD). TRWD's share is in the amount of $14,000.00. The project is located in COUNCIL DISTRICTS 3, 4, 8 and 9. FISCAL INFORMATION / CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendation and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of the Grant Capital Projects Fund.
