HomeMy WebLinkAboutContract 44865-A1 (2)•? ��f � �1\ � `� KI C �i �� � - FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO. 44865 WHEREAS the City of Fort Worth ("City") and Tarrant County Samaritan Housing, Inc., ("Agency") made and entered into City Secretaiy Contract No. 44865 ("Contract"); WHEREAS, the Contract provides funding to Agency pursuant to a grant received by City from the United States Department of Housing and Urban Development ("HUD") through the Housing Opportunities for Persons with AIDS ("HOPWA") grant program; WHEREAS, the Agency provides supportive services including case management and housing counseling to HOPWA Eligible Clients and has requested additional HOPWA Funds due to the expiration of another funding source; and WHEREAS, it is the mutual desire of City and Agency to amend the Contract to add an additional $216,714.00 of HOPWA Funds for a total award of $478,325.35 to complete the Program and meet Contract objectives. NOW, THEREFORE, City and Agency hereby agree to amend the Contract as follows: I. a. The first sentence of Section 4.1 Provide HOPWA Funds is amended to read as follows: "City shall pay up to Four Hundred Seventy Eight Thousand Three Hundred Twenty Five and 35/100 Dollars ($478,325.35) of HOPWA Funds on a reimbursement of expenses basis, under the tei�ns and conditions herein." b. The first sentence of Section 17 INSURANCE AND BONDING is amended to read as follows: "Agency will maintain blanket fiduciary coverage in the form of insurance or bond in the amount of $478,325.35 to reimburse City for any and all loss of HOPWA Funds." c. EXHIBIT "A" -PROGRAM SUMIVIARY attached to the Contract is replaced with the attached EXHIBIT A- PROGRAM SUMMARY REVISED 04/2014. d. EXHIBIT "B" — BUDGET attached to the Contract is hereby revised and replaced with the attached EXHIBIT "S" —SUDGET Revised 04/2014. e. EXHIBIT "A" Samaritan House Supportive Services PROGRAM SUMMARY Revised 04/2014 PROGRAM SZJNIIVIARY Housing Opportunities for Persons with AIDS (HOPWA) October 1, 2013 to September 30, 2014 PERIOD $478,325.35 AMOUNT PROGRAM: The program will provide each HOPWA-eligible client with supportive services including case management and housing counseling. Program services may also include social work case management; congregate meals; medical case management; substance abuse counseling; medical transportation; recreation and social programs; education programs; and, life and job skills programs. HOPWA Funds will be used to provide each HOPWA-eligible client with supportive services including case management and housing counseling. No more than 7% of the HOPWA Funds will be used to pay for administrative costs, including salaries, insurance, taxes, and legal and accounting fees associated with the Program. Program services will be available at 929 Hemphill Street, Fort Worth, Texas 76104 from 9:00 a.m. to 5:00 p.m., Monday through Friday. Program services may also be provided at clients' homes. Authorize a Substantial Amendment to the City's 2012-2013 Action Plan; 2. Authorize a change in use and expenditure in the amount of $195,929.71 and expenditure of $20,784.29 for a total amount of $216,714.00 in additional Housing Opportunities for Persons with AIDS grant funds to Tarrant County Samaritan Housing, Inc.; and 3. Authorize the City Manager or his designee to execute a contract amendment with Tarrant County Samaritan Housing, Inc., for a total contract amount of $478,325.35. DISCUSSION: On August 6, 2013, (M&C C-26369, CSC No. 44865) the City Council approved the City's 2013-2014 Action Plan, including the execution of a contract with Tarrant County Samaritan Housing, Inc. (Samaritan House), for Housing Opportunities for Persons with Aids (HOPWA) grant funds from the United States Department of Housing and Urban Development (HUD) in the amount of $261,611.35 to serve low-income persons living with HIV/AIDS. The funds are used for administration and supportive services including case management and housing counseling as well as congregate meals, medical and social work case management, substance abuse counseling, medical transportation, recreation and social programs, education programs, and life and jobs skills programs. Samaritan House has requested $216,714.00 in additional funding due to the expiration of another funding source. Staff has reviewed Samaritan House's request and determined that there are available HOPWA funds from Program Year 2012-2013 and that the proposed use and expenditure is eligible. Approval of the Action Plan included authorization to amend the various contracts if necessary to achieve program goals provided that any amendment is within the scope of the program in and in compliance with City policies and all applicable regulations governing the use of HUD grant funds. Staff recommends an amendment to the current HOPWA contract with Samaritan House to increase the contract amount by $216,714.00 for a total contract amount of $478,325.35. The recommended increase consists of $195,929.71 of unspent HOPWA funds from the City's 2012-2013 Action Plan and $20,784.29 unspent from Samaritan House's 2012-2013 HOPWA contract (City Secretary Contract No. 43742). Any comments are maintained by the Housing and Economic Development Department, in accordance with federal regulations. Action Plan funding years selected may vary and be substituted based on the Principle of First In, First Out (FIFO) in order to expend oldest grant funds first. Samaritan House program services are available in ALL COUNCIL DISTRICTS.
