R�= � � a� . ��, �, - - � �t. .p'p , ' , i � �-. � STATE OF TEXAS COUNTY OF TARR_ANT § § § KNOWN ALL BY THESE PRESENTS: SECOND AMENDMENT TO CITY SECRETARY CONTRACT NO. 44819 �'�,, �/C/ �J � THIS SECOND AMENDMENT to City Secretary Contract No. 44819 is entered into by and betwePn the City of Fort Worth, a home-rule municipal coiparation situated in Tai7�ant County, Texas ("Fort Worth"), acting through Fernando Costa, its duly authorized Assistant City Manager, and The City of Lake Worth, located in Tai�ant County, Texas ("Participant"), acting through Brett E. McGuire, its duly authorized City Manager. WHEREAS, Fort Worth and the Participant have entered into that certain agreement identified as City Secretary Contract No. 44819 (also the "Agreement") for fiscal year 2014 (October 1, 2013 tl�u•ough September 30, 2014) whereby Fort Worth will purchase the services of a waste disposal/recycling fiim or fiims and will administer a household hazardous waste collection pi•ogram as authorized by Mayor and Council Communication G26421; and WHEREAS, that Agreement was for an initial teim of one year and that Agreement provides for the a�tension of the term for up to three additional pei•iods of one year each; and WHEREAS, City Seci•etai•y Contract No. 44819 A-1 extended the contract teim from Octobei• 1, 2014 through September 30, 2015; and WHEREAS, the parties wish to extend the term of the initial Agreement for an additional year coinmencing on October 1, 2015 through September 30, 2016; and WHEREAS, the parties agree that all other conditions, tei7ns, and pi•icing shall reinain the same as stated in City Secretary Contract No. 44819; NOW, THEREFORE, for• and in consideration of the mutual covenants contained herein, and othei� good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged and confessed, the parties hereto agree as follows: 1. Antici�ated Holiday Closures: During the extended term of the agY•eeinent, the Environtnental Collection Center (ECC) will be closed on the following holidays that are observed on days the ECC would otherwise be open to the public: Thanksgiving holiday, Thursday and Friday, November 26-27, 2015 Christmas holiday, Friday, December 25, 2015 New Year's Day holiday, Friday, Januaiy 1, 2016 3 Miscellaneous: All definitions, terms, conditions, and prices, as well as the rights and obligations of the parties as set forth in City Secretary Contract number 44819 shall retnain unchanged except as expressly set forth hei•ein. DISCUSSION: The City's Environmental Collection Center is now in its 16th year of operation collecting household hazardous waste from the residents of Fort Worth and surrounding communities on a year round basis. In order for non-Fort Worth residents to participate at the center, each entity is required to enter into an Interlocal Agreement with the City of Fort Worth. The term for these Agreements will be for Fiscal Year 2014 (October 1, 2013 through September 30, 2014) with three one-year options to renew (through Fiscal Year 2017). Renewal may be effected by written notification by the City Manager or his designated representative to the participating entity within 30 days of the expiration of the prior term and does not require specific City Council approval. The rate per household for the period covered by these Agreements is $47.00 per household. It is anticipated that approximately $760,000.00 will be collected annually under these Agreements. During Fiscal Year 2013, 46 entities signed participation Agreements with the City of Fort Worth. For the upcoming year, it is expected that all of these entities will participate. This Agreement outlines the responsibilities of each party, establishes the rate for participation, details procedures for loan of mobile collection unit, and delineates the usage of service marked public education materials. The City of Fort Worth is responsible for overall operation of the center including contracting with a hazardous waste disposal company for transportation and disposal of materials collected.
