Pursua��t to the foregoing 'Notice Yo Bidders', the undeisigned Bidder, having thoroughly
examined the Conhact Documents, including plans, special contract docume��ts, the Technical
Specifications listed in this conh•act, the site of the project and undecstanding tlie amoiiut of work
to be done, and the prevailing conditions, hereby proposes to do all the work, furnish all labor,
equipment and material whieh is necessaiy ro fully complete the work as provided in the Plans
and Contract Documents and subjeof to the inspection and approval of the Directoc of the
Department of Transportation & Public Wor]<s of the City of Port Worth, Texas; and Uinds
himself upon acceptance of this Proposal to execute a conh�act and fucnish an approved
Performauce Bond, Payment Bond, Maintenance Bond, and such other bonds, if any, as may be
required by tl�e Contract Doeuments for the perPorming and completing of the said work.

the property of the Developer.
Tl�e successfiil bidder shall be required to }�erform H�e worlc in accord with these aontraot
documents and the techuical specificatious availa6le in the Ciry of ForC Worth's Buzzsaw site
and incorporated herein and made a part hereof for all purposes.
The undersigned �ssures that its employees aud applicants for employment and those of any
labor orga��ization, subcoutractors, or employment agency in either fiirnishing or referring
employee applicants to the undersigned are not discriminated against as prohibited by the terms
of City Ordinance No. 7278 as amended by City Ordinance No. 7400.

Contractor recognizes that time is of the essence of this Agreement and that Developer
will suffer financial loss if the Work is not completed within the times specified in
Paragraph 3.2 above, plus any extension thereof allowed in accordance with Article 10 of
the Standard City Conditions of thc Construction Contract for Developer Awarded
Projects. The Conhactor also recognizes the delays, expense and difficalties involved in
prov�ng in a legal proceeding the actual (oss suffered Uy the Developer if the Work is not
wmpleted on time. Accordingly, instead of requiring any such peoof, Contractor agrees
that as liquidated damages Cor delay (but not as a penalty), Contractor shail pay
Developer One Thousand Doliars ($I.000.00) for each day that expires after the time
specified in Paragrapli 3.2 for Final Acceptance unti( the City issues the Final Letter of
Acceptance.

dimensions, and materials
c. Approving depai�tures from details furnished Uy the City, except as otherwise
