HomeMy WebLinkAboutOrdinance 24700-02-2021 ORDINANCE NO.24700-02-2021 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS OPERATING FEDERAL FUND, (1) BY $148,518.00 SUBJECT TO AWARD AND RECEIPT OF THE GRANT FUNDS,AND (2) BY $37,130.00, AS A TRANSFER FROM THE FY2022 GENERAL FUND TO SATISFY THE CITY'S MATCH REQUIREMENT,FOR A TOTAL OF$185,648.00, FOR THE PURPOSE OF FUNDING THE FY2022 VICTIMS OF CRIME ACT FORMULA GRANT PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES;REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2020-2021 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Grants Operating Federal Fund, (1) by $148,518.00 subject to the award and receipt of grant funds, and (2) by $37,130.00, as a transfer from the FY2022 General Fund to satisfy the City's match requirement, for a total of$185,648.00,for the purpose of funding the FY2022 Victims of Crime Act Formula Grant. SECTION 2. That should any portion,section or part of a section of this ordinance be declared invalid,inoperative or void for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair the remaining portions,sections,or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 24446-09-2020 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations,in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize application for,and authorize acceptance of,if awarded,the Fiscal Year 2022 Victims of Crime Act Formula Grant from the Office of the Governor, Criminal Justice Division,in an amount of$185,648.00; 2. Authorize the execution of a grant agreement with the Office of the Governor,Criminal Justice Division for the Fiscal Year 2022 grant; 3. Adopt the attached resolution to make assurances as required by the State of Texas,Office of the Governor,Criminal Justice Division;and 4. Adopt the attached appropriation ordinance increasing receipts and appropriations in the Grants Operating Federal Fund in an amount of $185,648.00. DISCUSSION: The purpose,of the Office of the Governor(OOG),Criminal Justice Division(CJD),Victims of Crime Act(VOCA)Formula Grant, Fiscal Year 2022,is to provide services and assistance directly to victims of crime to speed their recovery and provide aid through the criminal justice process. If awarded,grant will continue to fund two positions in the Fort Worth Police Department's Victim Assistance Unit(Victim Assistance Specialist and High Risk Family Violence Specialist).The grant period for this award is from 10/01/2021 to 09/30/2022. The overall goal,of the COG,CJD,VOCA Formula Grants,is to reduce the trauma experienced by crime victims.This is achieved by providing efficient and comprehensive advocacy and services for all victims of violent crime and conduct outreach and education to victims of family violence exhibiting high risk factors.Through these services,the likelihood of repeat victimization and intimate partner homicide is reduced. There is a match requirement of 20%of the total budget.A portion of the Victim Assistant Coordinator's time will fulfill this requirement.The Fiscal Year 2022 General Fund budget will be used to meet this match requirement. The attached resolution affirms that 1)the City Council has ratified the grant project;2)designates the City Manager,through the Deputy City Manager,to apply for,accept,reject,alter,or terminate the grant on behalf of the City;and 3)in the event of loss or misuse of CJD grant funds,the City assures that the funds will be returned to the CJD in full. A portion of the awarded funds will be used to cover indirect costs at the Police Department's approved rate(currently 4.89%). A Form 1295 is not required because:This contract will be with a governmental entity,state agency or public institution of higher education:Office of the Governor,Criminal Justice Division FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance,funds will be available in the current operating budget,as appropriated, in the Grants Operating Federal Fund and the match requirement will be budgeted for in the Fiscal Year 2022 Police Department General Fund budget.The Police Department(and Financial Management Services)will be responsible for the collection and deposit of funds due to the City. Prior to an expenditure being incurred,the Police Department has the responsibility to validate the availability of funds.This is a reimbursement grant.
