HomeMy WebLinkAboutContract 28006-A10 CSC No.28006-A10 AMENDMENT No.10 TO CITY SECRETARY CONTRACT WHEREAS, the City of Fort Worth (CITY) and Dannenbaum Engineering Corporation, (ENGINEER) made and entered into City Secretary Contract No. 28006, (the CONTRACT) which was authorized by M&C C-19172 on the 30th day of July, 2002 in the amount of $721,899.76; and WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 1 in the amount of $111,800.52 which was authorized by M&C C- 19936 on January 20, 2004, Amendment No.2 in the amount of $329,406.00 which was authorized by M&C C-22535 on November 27, 2007, Amendment No. 3 in the amount of $96,825 .00 which was authorized by M&C C-23578 on June 9, 2009, Amendment No. 4 in the amount of $60,835.00 which was authorized by M&C C-24794 on March 22, 2011, Amendment No. 5 in the amount of $149,012.00 which was authorized by M&C C -28110 on February 14, 2017, Amendment No. 6 in the amount of $63,751.00 which was administratively authorized on October 11, 2017, Amendment No. 7 .in the amount of $21,860.00 which was administratively authorized on August 9, 2018, Amendment No. 8 in the amount of $11, 670.00 which was administratively authorized on November 20, 2018 and Amendment No. 9 in the amount of $242,055.00 which was authorized by M&C 19-0204 on September 24, 2019; and WHEREAS, the CONTRACT involves engineering services for the following project: Sanitary Sewer Main 257 and 325 Middle and Upper Village Creek Parallel Relief Alignment Study and Design; and AREAS, it has become necessary to execute Amendment No. 10 to the CONTRACT to include an increased scope of work and revised fee. NOWTHEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $29,400.00. 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall bean amount of $1,838,514.28 . Dannenbaum Engineering was required to perform additional construction phase services under this contract that include: 1) Existing Bethesda Water Supply Corporation (BWSC) 8-inch Water Main Adjustment — Adjusting approximately 30 LF of an existing 8-inch water main crossing proposed Main 325 Relief Sewer at Sta. 34+53+/-and Deer Creek just east of S. Oak Grove Rd. to avoid a conflict with the Main 325 Relief Sewer profile alignment (Reference attached Exhibit A). This item will include design of required Deer Creek erosion protection for both the 8-inch water main adjustment and the Main 325 creek crossing. 2) Additional Month of Construction Phase Services - One additional month of: construction progress schedule reviews, submittal and RFl reviews/responses and weekly site observation visits/reports with site photos. These services are necessary because: 1) The existence of the 8-inch BWSC water main was not identified during the utility research/investigation portion of the design phase of the PROJECT. In August 2020, the Main 325, Phase 2 construction contractor, McKee Utility Contractors (McKee) encountered the BWSC water main during construction and determined it conflicted with the proposed M-325 alignment. After additional investigation and research, Dannenbaum Engineering (DEC)tracked down record drawings of the water main from BWSC. These record drawings provided minimal information regarding the actual horizontal and vertical location of the existing water main. 2) DEC then coordinated with McKee to obtain actual depth and location information for the existing water main, prepared preliminary construction documents for the adjustment and transmitted to BWSC to review/approve the concept. These documents were then transmitted to McKee to review and cost out the adjustment construction work and to prepare/submit an associated change order request to the CITY. After McKee's review, DEC made some design adjustments and resubmitted to McKee for use in their change order request. 3) In addition, to reduce PROJECT costs, the City requested that DEC modify the Main 325 Relief Sewer installation method at this location from open-cut vs. by-other-than-open-cut (BOTOC). This installation modification along with unexpected BWSC 8-inch water main crossing necessitated additional erosion protection along the entire length of the Main 325-Deer Creek crossing. Sanitary Sewer Main 257&325 Middle and Upper Village Creek Parallel Relief Alignment Study and Design-Amendment No.10 DEC No.3642-32 Page 2 of 4 4) The current Scope of the project has increased with the addition of the BWSC water main adjustment, changed Main 325 installation method and associated additional erosion protection design services required at the referenced location. 5) The construction contractor's schedule was extended to install the additional erosion protection referenced in preceding item 3)necessitating additional construction progress schedule review,submittal and RFI reviews/responses and weekly site observation visits/reports with site photos. The additional services required are as follows: 1) Existing BWSC 8-inch Water Main Adjustment—Additional design for adjustment of approximately 30 LF of the existing BWSC 8-inch water main located in Deer Creek to avoid conflict with the Main 325 Relief Sewer profile at approximately Sta. 34+53. The approximate limits of the water main adjustment are shown in Exhibit A.This item includes: a. Research, investigation and coordination with BWSC, McKee and the CITY, b. Design of the water main adjustment and erosion protection for Deer Creek along the adjusted BWSC water main alignment.This item also includes additions/modifications to the Plans. 2) Deer Creek Erosion Protection Modifications for Main 325 Relief Sewer — Additional design for modifications to approximately 150 LF of erosion protection for Deer Creek along the proposed Main 325 Sewer Relief, Phase 2 alignment between Stas. 33+30 and 34+80. This item also includes additions/modifications to the Plans. Design Services Fee=$20,550(Lump Sum) 3) Additional Month of Construction Phase Services - One additional month of: construction progress schedule reviews, submittal and RFI reviews/responses and weekly site observation visits/reports with site photos. Construction Support Services Fee=$8,850(Lump Sum) Total Fee=$29,4000(Lump Sum) Dannenbaum will perform/manage the work described in the items above for this Amendment in accordance with the original Contract.
