City Code Section 35-60 "Uses Outside Citv" as applicable; and 2. Citv Code Section 35-20 "Provisions Incorporated into Consumer Contracts" as applicable; and "All of the provisions of this Chapter [35] shall be deemed to be incorporated in every contract between the city and its water or sanitary sewerage service customers, and each customer or consumer shall be charged with knowledge of the provisions of this chapter and, by applying for and accepting water or sanitary sewerage service from the city, to have assented to the provisions of this chapter." This shall include any and all ordinances adopted and amending Chapter 35 such as ARTICLE VI. LAWN AND LANDSCAPE IRRIGATION CONSERVATION. 3. Citv Code Section 35, Article III "Charqes" as applicable; and The owner understands that he/she is responsible for any related impact fees, tap fees, meter deposits, front foot charge, per acre charge, water main capacity charge and extension under CFA or miscellaneous project. Please obtain the amount to these charges from the Fort Worth Water Development Section. 4. City Code Section 26-2 A 01.2 as applicable; and The owner needs to apply for a plumbing permit with the Fort Worth Planning & Development Department to connect to the City of Fort Worth water and/or sanitary sewer lines despite the property is in the county. 5. Citv Code Section 12.5, Article V"Public Drinkinq Water" and Chapter 35, Article VII "Installation & Maintenance of Irriaation Svstem" as applicable. The owner is responsible for the installation of backflow devices, obtaining permit through the Fort Worth Planning and Development Department and test the devices annually according to this section of the city code for both domestic and irrigation systems. Authorize the Water Department to provide water service at 1.25 times the retail rate to property located at 11150 SH 114 in Denton County, pursuant to City Code Section 35-60B, Uses Outside City; and 2. Authorize the execution of an Agreement for such services. DISCUSSION: Mr. Emad A. Mehdir, the owner of the property located at 11150 SH 114 has submitted a request to receive water service from the City of Fort Worth. The legal description of the property is: G. Cardenas Survey A 0214A, Tract 11 (pt), located in the extraterritorial jurisdiction of Fort Worth, inside Denton County and within the Fort Worth Water Certificate of Convenience and Necessity (CCN). The CCN transfer from Aqua Texas to the City of Fort Worth was approved on March 29, 2013. Mr. Emad A. Mehdir has agreed to pay all fees and charges associated with the connection. The applicant also understands that the fees and the monthly bill will be 1.25 times the rate for customers inside the City of Fort Worth. This property is located adjacent to COUNCIL DISTRICT 2.
