HomeMy WebLinkAboutContract 44676-A1-- -� ,�,;` ; ; �," i i�' � ANFLNDMENT No . 1 WHEREAS, the Associates, Inc., Contract No. 44676, the 23rd day of July, WHEREAS, the following project: TO CITY SECRETARY CONTRACT No City of Fort Worth (ENGINEER) made and (the CONTRACT) which 2013 in the amount of 44676 (CITY) and Kimley-Horn ana entered into City Secretary as authorized M&C #C-26358 on $ 422,850.00; and CONTRACT involves engineering services for the Caylor 5 Million Gallon Ground Storage Tank; and WHEREAS, it has become necessary to execute Amendment No. 1 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: I� Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated July 30, 2014, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $143,200.00. (See Attached Funding Breakdown Sheet, Page -3-) �� . :� � — . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $566,050.00. 3. Subsequently, this site was purchased by the City. This change from the original design intent of the project has required additional services that were not included as part of aur Original Confract, These services have been related to property acquisition and platting associated with the purchased site, as well as off-site drainage design required to convey the overflow runoff from both the proposed and existing tank sites. These services are further described below. Propertv Acquisition � The original scope of services assumed that ihe GST would be placed within the existing City � property and stated that Propeity Acquisition would be considered Additional Services. Due to the City's decision to acquire the additional site, Kimley-Horn performed services including meeting with and coordinating with the property owners, determining site layout requirements to size the site and performing preliminary grading analysis. In addition, Kimfey-Horn subcontracted surveying services to Gorrondona & Associates, lnc. for preparation of the boundary and topographical survey needed to appraise and finalize purchase of the property. The additional amount requested for these services is $15,800. (SBEFee: $7,000) Plafiinp, Zoninq, and Gradinq Permit Since the City purchased additional property which subsequently subdivided the adjacent property, platting of fhe remainder tract and re-platting fhe acquired property to become part of the existing Caylor Addition piat was required. The original scope of services stated that platting services would be considered Additional Services. Urban Forestry requirements include preparation of a Pai� I(existing) and Part 2 (proposed) si�e plan and canopy calculations to deiermine tree coverage in accordance with fhe City's Tree Ordinance. In addition to the proposed site, the remainder site was required to be included in the Conceptual a�id Preliminary iSWM checldisi applicafion for i�eview. Coordination is also required to prepare an application for a Zoning Special Exception to present to the Zoning Board or Adjustments for consideration. The additional amount requested ior these services is $36,3�0. (SBE Fee: $6,000) �ff-Site Stormwaker �esiqn, �iddincl, and Construction Phas� Service� The original contract did not include services associated with preparing Construction documents for off-site stormwater improvements. During conceptual design for the GST, the City decided that due to the proximity of development within the vicinify of the GST, not only ihe site drainage, but also the pofential overFlow runoff should be conveyed through a storm drainage system. As part of the conceptual design submittal, Kimley-Horn evaluated storm drainage altematives and projected construction costs associated with each alternative. Upon review of these alternatives with the City, it was dete��inined that approximately 3,000 linear feet of 30 to 36-inch storm drain should be designed to oufflow to an existing drainage channel in a downstream development. It is anticipated that these contract documents will consist oP 15 total plan sheets (5 plan and profile) and specifications. These services will be performed in accordance with Tasks 3(Preliminary Design) and 4(Final Design) of the Atfachment "A" Scope for Engineering Design Related Services for Storm Water Improvements Projects as located on the City's Buzzsaw sife. � Additional Bid Phase services will be p�rformed to incorp�rate bidding th� storm drainage improvements fogether with fhe GST plans and specifications as one project. These services will require development of additional Division 01 General Requiremenfs, Division 33 Specifications, as well as a Unit Price Bid Form for the storrnwater portion of the project, These services will be performed in accordance with the terms described in TasK 5 of the Original Contract. Amendment No. 1 will cover additional design engineering items requued for the completion of the project documents. During the site evaluation, it was determined that the purchase of an adjacent site will be the cost effective option for the proposed second tanlc. Also, the Fort Worth Water Department decided that due to the proximity of existing residential development within the vicinity of the GST, the site drainage as well as the potential overflow runoff needs to be conveyed through an appropriate storm drainage system. This change from the original design intent required additional services including property acquisition, platting, off—site drainage design to convey the overflow from both the proposed and existing tanlc sites, as well as additional survey and associated minor design improvements. M/WBE Office — Kimley—Horn and Associates, Inc., agrees to maintain its initial SBE commitment of 25 percent that it made on the original Agreement and extend and maintain that same SBE commitment of 25 percent to this Amendment No. 1. Therefore, Kimley—Horn and Associates, Inc., remains in compliance with the City's BDE Ordinance and attests to its commitment by its signature on the Acceptance of Previous SBE Commitment form executed by an authorized representative of its company. This project serves the entire City and is located in COUNCIL DISTRICT 7, Mapsco 234 B-1. FISCAL INFORMATION: The Financial Management Services Director certifies that funds are available in the current capital budget, as appropriated, of the Water Capital Projects Fund.
