30, 2021 (the"Expiration Date"). Pursuant to the Contract, contract renewals must be mutually
agreed upon by both parties. This notice is to inform you that the City wishes to renew the Contract
for an additional five(5)year period,which will begin immediately after the Expiration Date. The
duration of the renewal shall begin on October 1, 2021 and ending on September 30, 2026. All

MUTUAL CONSENT TO EXTEND
CONTRACT FOR FIRE SERVICES
The City of Fort Worth and the Town of Westover Hills hereby mutually consent to a five-
year extension of the City of Fort Worth City Secretary Contract No. 27956, Fire Services
Contract, under the current terms and conditions of said Contract. The duration of this
extension is for five(5)years,beginning October 1,2016 and ending September 30,2021.

I am writing in regards to the contract amount for the fiscal year 2016-2017 for fire services
provided to the Town of Westover Hills by the City of Fort Worth Fire Department.
Last year the contract amount was$166,865.00 and this year the amount is S169,680.00. The
billing and payment procedures have changed;you will be invoiced from the Fire Administration
Revenue Department. The invoice for October is enclosed.

SUBJECT AMENDMENT OF CONTRACT FOR THE PROVISION OF FIRE SERVICES TO THE
CITY OF WESTOVER HILLS
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to amend the contract for the
provision of fire services to the City of Westover Hills, changing the language for Section 6: Liability.
DISCUSSION:
On October 2, 2001 (M&C C-18762), the City Council authorized a multi-year contract for the provision
of fire services to the City of Westover Hills. The contract was not fully executed due to concerns from
Westover Hills regarding language of the liability section.
The original liability section included language specifying that Westover Hills would be liable for any
damage to Fort Worth equipment, and for personnel and employee benefits for Fort Worth personnel
providing services under the agreement, including workers' compensation, pension, and retirement
benefits.
After discussions with Westover Hills this section was changed, and it now specifies that any civil
liability shall be determined pursuant to the terms of Texas Government Code 791.006.
It is the opinion of the City Attorney that the change provides sufficient protection to the City of Fort
Worth.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that this action will have no material effect on City funds.

SUBJECT FIRE SERVICES CONTRACT WITH THE CITY OF WESTOVER HILLS
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute a multi-year contract to
provide fire services to the City of Westover Hills (Westover Hills) for a first year amount of
$128,262.30.
DISCUSSION:
On October 2, 1990 (M&C C-12548), the City Council executed a five-year contract to provide fire
service to certain areas of Westover Hills. The original agreement provided services for a five-year
period, with an option to renew for an additional five years. Westover Hills requested, and the Fort
Worth City Council approved renewal of the contract for the final five-year term on October 3, 1995
(M&C C-15053).
On September 5, 2000 (M&C C-18217), the City Council approved a one-year contract with Westover
Hills to continue the provision of fire services during the period that a new contract arrangement was
developed.
The attached contract extends the relationship with Westover Hills for five years, with five-year renewal
options. Under the terms of the contract, Westover Hills will pay the City of Fort Worth $128,262.30 for
the first year of the contract, with cost adjustments each year based on Fort Worth's per capita cost of
fire protection.
The formula utilized to arrive at the charges for fire service provided by the Fort Worth Fire Department
to other cities is based on four variables: Fort Worth's per capita cost of fire protection, the population of
the city receiving fire protection services, a hazard potential factor, and the service level selected by the
city receiving the services. The per capita cost is calculated based on the Fire Department's adopted
budget, indirect costs, debt service attributed to the Fire Department, and Fort Worth's population.
The population of the area to be covered is determined using either the most recent North Texas
Council of Governments population estimates when an entire city is to be covered, or the most recent
U.S. Census Bureau Census Block Date and Census Bureau total average household size when only a
portion of a city is covered. This former method is utilized in the Westover Hills calculation.
The hazard potential factor is a tool to determine whether the area to be covered by the contract has a
greater, lesser, or like fire protection as Fort Worth. The factor is based on an assessment of the types
of properties in the area, transportation routes, open land, other fire protection factors including water
supply, sprinklers, etc., and special factors which are unique to the protection area. All ratings are
based on the relationship of each factor to the `norm' of Fort Worth. A rating of 1.0 means a factor is
the same as is common to like factors in Fort Worth; a greater hazard would receive a higher rating
while a lesser hazard would receive a lower rating.

SUBJECT FIRE SERVICES CONTRACT WITH THE CITY OF WESTOVER HILLS
Four levels of service are available to a contracting city:
• Level 1 - Provides full fire service and all ancillary services such as building inspections and fire
safety education programs; and
• Level 2 - Full fire suppression service, emergency medical services, inspection of water
hydrants, and hazardous materials response provided; and
• Level 3 - Fire suppression provided through the nearest one-alarm assignment consisting, on
average, of two engine companies, one truck company, and one battalion chief. No other
services are provided; and
• Level 4 - Fort Worth Fire Department responds with a one-alarm assignment consisting, on
average, of two engine companies, one truck company, and one battalion chief. Under Level 4,
the contracting city is obligated to supplement the fire ground resources with all of its available
fire personnel and apparatus at the request of the Fort Worth Fire Department incident
commander.
The Westover Hills contract is based on Level 2 service.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that the Revenue Division of the Finance Department is responsible for
the collection of funds due to the City under this agreement.
