WHEREAS, The City of Fort Worth and Elements of Architecture, Inc. (Consultant)
made and entered into City Secretary Contract No. 52547 (The Contract) which was
authorized administratively, the 151h day of July, 2019, for Facility Assessment of the
existing facility; and
WHEREAS, further amendment is necessary to reimburse the Consultant as part of the
design services agreement for additional architectural design services for Programming
Phase, Schematic Design/Design Development Phase, Construction Document Phase,
and Construction Administration Phase.
NOW THEREFORE, City and Consultant, acting herein by and through their duly
authorized representatives, enter into the following agreement which amends the
Contract:

Article I — Scope of Services, Paragraph (3) shall be added to read as follows:
(3) Provide additional design services for the design and detailing of the Sycamore
Community Center Renovation project. The cost of this additional service is
$196,592.00 plus $6,500.00 in reimbursable expenses. The scope of services is
described more fully in Elements of Architecture, Inc.' s Letter dated September
9th, 2020 and updated on January 15th, 2021, subject: "Proposal for A/E
Services — Sycamore Community Center, SD, DD, CD and CA Phase Services,
Updated to include Programming Phase.

Article II — Compensation, first paragraph, is amended as follows:
"Consultant shall be compensated in accordance with the Fee Schedule shown
in Attachment "B". Payment shall be considered full compensation for all labor,
materials, supplies, and equipment necessary to complete the services
described in Attachment "B". However the total fee paid by the City shall not
exceed a total of $234,592.00 unless the City and the Consultant mutually agree
upon a fee amount for additional services and amend this Agreement
accordingly."

Updated to include Programming Phase
Dear Alfonso;
Elements is pleased to provide to you this proposal for services associated with the renovations to the existing
facility as determined from the programming phase of this project. The scope of the project is based on the results
of the Programming and Assessment Phase and the direction by the City for project renovations estimated at
$1,905,946. The scope for the project is as determined to align with this budget and based on a construction
delivery method of Construction Manager at Risk. We anticipate the scope of services for this project is as
follows:
SCOPE OF SERVICES
Programming Phase
Services performed after completion of the assessment and to evaluate the project scope to determine
budget that aligned with the bond funding. This effort was required to approve the funding and the scope
and to implementtbe CMAR process. We met with Parks and Property Management several times to align
and set the project scope. This was a line item on the original assessment and programming proposal dated
May17,2019 but was not accepted at that time.
Schematic Design/Design Development Phase
1. CMAR interviews, coordination and recommendations
2. From programming done previously, develop proposed layout illustrating main building elements.
Provide narrative for building systems.
3. Review with the CMAR for project direction and update project costs.
Construction Documents Phase
1. From approval of the SD/DD Phase, develop construction documents.
2. Coordinate with CMAR for project scope and costs.
3. Submit construction documents for review only.
A. Modify documents as required per City review.
5. Final Construction Documents and provide to the city for distribution.
6. Submit documents for TDLR review.

7. Submit documents for permitting to the city and coordinate this effort through receipt of building permit
for general construction.
Construction Administration Phase
1. Bi-weekly OAC meetings during construction with an assumption of 8 months of construction for a total of
16 meetings. We have assumed that half of these would be virtual meetings and half being actual site
visits held in conjunction with the OAC meetings.
2. Respond to any RFI's for clarification to the documents.
3. Review of testing laboratory reports.
A. Review of Shop drawings and other submittals as stipulated in the construction documents.
5. Punchlist of space to review conditions and generate a list of deficiencies to design intent.
6. Prepare record documents from as-built documents.
Exclusions and Qualifications to This Proposal:
1. We have also assumed that the existing facility is already TAS compliant and no modifications outside of
our defined area of work is included or anticipated.
2. Proposals for each consultant are attached with the information included as if provided within this
proposal.
3. Documents will be prepared using AutoCAD.
A. We have only included one set of documents with no early release packages planned or phasing of the
project is included.

Expenses
Reimbursable expenses are in addition to the labor fees listed above and include costs incurred as required for
the project such as TDLR submittal, Permit application, printing costs, etc. Expenses are estimated at$6,500.
These will be invoiced based on costs incurred with a 10%markup for processing.

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize execution of Amendment 1 to the Architectural Services Agreement with Elements of Architecture, Inc.,in the Amount of
$203,062.00,for a total contract amount of$234,562.00;and
2. Authorize execution of a Construction Manager at Risk Contract with HM&MF,Ltd.,dba Muckleroy&Falls,in the not-to-exceed amount of
$2,150,000.00,and including an owner's construction contingency allowance,to design and build renovations to the Sycamore Community
Center(City Project No. 101655).
DISCUSSION:
The Sycamore Community Center project included in the 2018 Bond Program calls for the renovation and rehabilitation of the existing community
center to accommodate program expansion,enhance lighting, replace gym floor,and address structural issues. Based on the budget and scope
of work,it was determined that the Construction Manager(CMAR)at Risk would be the best delivery method. Following a Request for
Qualifications process and interviews,staff administratively executed a professional services agreement with Elements of Architecture, Inc. Once
a scope of work and initial budget was defined,a Request for Qualifications was advertised in the Fort Worth Star-Telegram on June 25,2020
and July 2,2020.The City of Fort Worth received eleven proposals from CMAR contractors. A selection team composed of members of Park&
Recreation Department, Property Management Department,and the Office of Business Diversity carefully reviewed these submittals and after
scoring and much discussion were able to establish a shortlist of four highly qualified teams. After ranking the proposals and conducting
interviews,the selection team determined that the Muckleroy&Falls'proposal offered the best value to the City.

This project is included in the 2018 Bond Program. Available resources within the General Fund will be used to provide interim financing until debt
is issued. Once debt associated with the project is sold, bond proceeds will reimburse the General Fund in accordance with the statement
expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election(Ordinance No.23209-05-2018)
and subsequent actions taken by the Mayor and Council.
Waiver of Building Permits-In accordance with the City Code of Ordinances, Part II,Chapter 7-1 Fort Worth Building Administrative Code,
Section 109.2.1, Exception 2;"Work by non-City personnel on property under the control of the City of Fort Worth shall be exempt from the permit
fees only if the work is for action under a contract that will be or has been approved by City Council with notes in the contract packages stating the
fee is waived."
Office of Business Diversity-Elements of Architecture,Inc.is in compliance with the City's BDE Ordinance by committing to 35%
SBE participation on this project.The City's SBE goal on this project is 10%.Additionally, Elements of Architecture, Inc.is a certified M/WBE
firm. Muckleroy&Falls is in compliance with the City's BDE Ordinance by committing to 20%MBE participation on this CMAR project.The
City's MBE goal on this CMAR project is 13%.
This project is located in COUNCIL DISTRICT 8.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that funds are available in the current capital budget,as previously appropriated, in the 2018 Bond Program
Fund for the Sycamore Community Center project to support approval of the above recommendations,execution of the amendment to the
agreement and execution of the contract. Prior to any expenditure being incurred,the Park&Recreation Department has the responsibility to
validate the availability of funds.
