AN ORDINANCE INCREASING RECEIPTS AND APPROPRIATIONS IN THE
TRANSPORTATION IMPACT FEE CAPITAL FUND IN THE AMOUNT OF $1,024,125.18
FOR THE ALEMEDA HROM PROJECT (CITY PROJECT NO. 103054) FROM
AVAILABLE FUNDS IN THE REVENUE-SERVICE AREA T-TRANSPORTATION IMPACT
FEES PROJECT(CITY PROJECT NO. UN9923) BY THE SAME AMOUNT; PROVIDING
FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2020-2021 in the
Budget of the City Manager, there shall also be increased receipts and appropriations in the Transportation
Impact Fee Capital Fund in the amount of$1,024,125.18 for the Alemeda HROM project (City Project No.
103054) from available revenues in the Revenue-Service Area T-Transportation Impact Fees Project (City
Project No. UN9923)by the same amount.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision,opinion or judgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 24446-09-2020 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Adopt Appropriation Ordinances,and Amend the FY2021-2025 Capital Improvement Program
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize execution of an engineering agreement with Harris Kocher Engineering Group, Inc.dba Harris Kocher Smith,for the Alemeda
Street Hazardous Road Overtopping Mitigation and Master Thoroughfare Plan Realignment project in the amount not to exceed
$426,469.00;
2. Adopt the attached appropriation ordinance increasing receipts and appropriations in the Transportation Impact Fee Capital Legacy Fund in
the amount of$475,874.82 for the purpose of funding the Alemeda Street Hazardous Road Overtopping Mitigation and Master Thoroughfare
Plan Realignment project from available funds in the Revenue—Service Area T—Transportation Impact Fees project;
3. Adopt the attached appropriation ordinance increasing receipts and appropriations in the Transportation Impact Fee Capital Fund in the
amount of$1,024,125.18 for the purpose of funding the Alemeda Street Hazardous Road Overtopping Mitigation and Master Thoroughfare
Plan Realignment project(City Project No. 103054)from available funds in the Revenue—Service Area T—Transportation Impact Fees
project(City Project No.UN9923);and
4. Amend the FY2021-2025 Capital Improvement Program.
DISCUSSION:
The engineering agreement recommended by this Mayor and Council Communication(MSC)will provide for engineering and design services
related to the Alemeda Street Hazardous Road Overtopping Mitigation and Master Thoroughfare Plan Realignment project.The project is needed
to reconstruct/realign the roadway in accordance with the Master Thoroughfare Plan(MTP)and mitigate the risk of hazardous road overtopping
during intense storm events.
In May 2018,the Transportation and Public Works Department,Stormwater Management Division published a Request for Qualifications(RFQ)
for engineering consulting services.Based on the results of the RFQ,Harris Kocher Engineering Group,Inc.dba Harris Kocher Smith was
selected as the most qualified consultant to design this project and proposes to perform design and engineering services for a fee not to exceed
$426,469.00.The services provided will include designing the realignment of Alemeda Street to match the City's MTP and providing an analysis
and design of culverts and channel improvements so the 100-year storm does not overtop the roadway.The estimated fee for the roadway design
is$306,164.00,and the estimated fee for the culvert and channel design is$120,305.00.The engineer will also prepare plans and specifications
and provide services during bidding and construction.Staff considers the fee to be fair and reasonable for the scope of services proposed.
The section of Alemeda Street included in this design is identified as a Transportation Impact Fee eligible project in the Transportation
Improvements Plan for Service Area T of the adopted 2017 Transportation Impact Fee study.Transportation Impact Fee funds moved into this
project will be used to design and construct the road to the MTP requirements.Any residual Transportation Impact Fee funds left after the
completion and acceptance of the project will be returned to the Service Area T revenues.

The 2020 Stormwater Revenue Bond Program included$4,100,000.00 for this project.Because of the addition of impact fees to the project
budget,$1,500,000.00 of Stormwater bonds funds currently appropriated will be reallocated to the Stormwater Hazardous Road Overtopping(City
Project No. P00120)programmable project.Funding for this project was included in the FY2021-2025 Stormwater Capital Improvement Program,
however,the Transportation Impact Fee funding was not included as its availability for project use was unknown at the time the project was
identified.This action in this M&C will amend the 2021-2025 Capital Improvement Program as approved in connection with Ordinance 24446-09-
2020.
Office of Business Equity—Harris Kocher Engineering Group, Inc.dba Harris Kocher Smith is in compliance with the City's BDE Ordinance by
committing to 7%SBE participation on this project.The City's SBE goal on this project is 7%.
This project is location in COUNCIL DISTRICT 3.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that funds are available in the Revenue-SA T-Transp Imp Fees project within the Trans Impact Fee Cap Legacy
Fund and the Transportation Impact Fee Cap Fund and upon approval of the above recommendations and adoption of the attached appropriation
ordinances,funds will be available in the Trans Impact Fee Cap Legacy Fund,the Transportation Impact Fee Cap Fund,and the Storm Water Rev
Ref Bonds 2020 for the Alemeda HROM/MTP Realignment project to support the approval of the above recommendations and execution of the
engineering agreement. Prior to an expenditure being incurred,the Transportation&Public Works Department has the responsibility of verifying
the availability of funds.
