HomeMy WebLinkAboutContract 38135-A1 AMENDMENT NO. 1 STATE OF TEXAS S CITY SECRETARY CONTRACT NO. 38135- (No M&C Needed) COUNTY OF TARRANT S WHEREAS, the City of Fort Worth (City) and URS Corporation, (Engineer) made and entered into City Secretary Contract No. 38135, (the Contract) which was authorized by the City Council by M&C C-23157 on the 11t' day of November 2008; and WHEREAS, the Contract involves engineering services for the following project: Storm Water Utility Project - Forest Park Parkview Storm Drain, Project No. 00674; DOE No. 5666 WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1 . Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated August 7, 2009, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $9,306.00. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $643,313.00. 1 of 2 OFFICIAL RECORD CITY'SECRETARY r 3. Senior Professional Engineer Transportation & Public Works Department City of Fort Worth 1000 Throckmorton Street Fort Worth, Texas 76102 Re: Request for Amendment No. 1—Additional Services for Archaeological Survey and Testing FOREST PARK—PARKVIEW STORM DRAINAGE IMPROVEMENTS City Project No. 00674 URS Project No, 25337785.00106 Dear Mr. Owen: This letter is written in response to a request from the Texas Historical Commission (THC) for an archeological survey and testing for the Forest Park—Parkview project site. A copy of the coordination letter submitted to THC is attached for reference. On the third sheet of the letter, the State Historic Preservation Officer (SHPO) has placed a stamp stating that the THC concurs with the recommendations in the coordination letter(the provisions that THC concurs with are highlighted in yellow). The additional services are as described below. A detailed breakdown of the proposed fee for these additional services is also attached. URS—ADDITIONAL SERVICES 1. The URS Cultural Resources Department will prepare a Research Design showing a survey with shovel testing and backhoe trenching. 2. URS will attach another Coordination Letter reminding THC of the project and referring back to the previous letter and their concurrence. 3. URS will prepare and sign an Antiquities Permit. URS will either submit the permit directly to THC or provide the Permit to the City of Fort Worth for submittal to THC, whichever the City prefers. 4. After URS receives the Permit from THC, we will conduct the field work. This should take 1-2 days to complete. Field work can not begin until URS receives the permit from THC. 5. After URS completes the field work, we will prepare a Draft Report of the findings and any recommendations, and submit it to the THC and the City for review and comments. After URS receives the comments, the comments will be addressed and then a Final Report of Findings will be submitted to THC and the City. The City will receive two bound copies of the report. THC will receive twenty (20) bound copies of the report and one electronic copy, as well as any relevant field notes, photographs (electronic), photo logs, etc., as necessary. The proposed fee for the services as described above is based on the following assumptions: 1. No archaeological sites will be observed, and no site reports or artifacts will need to be collected and curated. 2. The basic project design will not change from what was used to submit the coordination letter to the Texas Historical Commission. 3. There is no TxDOT involvement in the project, and the governing agency is the City of Fort Worth. 4. The City of Fort Worth will provide all rights-of-entry to the property. 5. Field work could be delayed by inclement weather. We therefore request a contract amendment to increase the lump sum fee amount by $9,306.00. Lawerence Oaks Executive Director THC-ADMIN Texas Historical Commission 1511 Colorado Street Austin,Texas 78701 Re: Initial cultural resources coordination under the Antiquities Code of Texas and Section 106 (16 U.S.C. 470 et seq.) of the National Historic Preservation Act (NHPA) of 1966, for Fort Worth City Project No. 00674, Forest Park — Parkview Storm Drainage Improvements from the Trinity River to the West Freeway (IH 30), Tarrant County (URS Project Number 25337785.00106), Dear Mr.Oaks, URS Corporation (URS), on behalf of the City of Forth Worth, Texas, requests Section 106 coordination from the Texas Historical Commission (THC) on the above referenced project. The project consists of the replacement of two structurally failing 2.4 meter[m] (8 foot(ft)by 2.1 m (7 ft)box storm drains with new box storm drains the same size, and the addition of two 2.4 m by 2.1 in (8 ft by 7 ft)box storm drains parallel to the existing drainage system,running from the Trinity River to a junction point upstream for a total of 91.44 nt(300 ft).The project also calls for stabilization of the fill material underneath the existing boxes by the use of cement slurry from the bottom of the drainage boxes to the limestone bedrock 7.6 m(25 ft)below the ground surface. The location of the project area is shown on Exhibit 1, which coordinates with the Haltom, Tex. [3297-431] and Fort Worth,Tex. [3297-424] 7.5-minute USGS topographic quadrangles. URS requests concurrence that an intensive archaeological survey with deep prospecting by backhoe be conducted in coordination with this project, and if the THC concurs, then an additional coordination letter, research design, and permit application will be submitted to the THC. Description of Undertaking The current drainage system is considered beyond rehabilitation possibilities and therefore, the project calls for the replacement of two structurally failing 8 ft(2.4 m) by 7 ft(2.1 m) box storm drains with new box storm drains the same size. In addition to the box drain replacement, two 8 ft by 7 ft (2.4 in by 2.1 m) box drains are proposed to be placed parallel to the existing drainage system. Both the replacement storm boxes and the parallel boxes will run from the Trinity River to a junction point upstream for a distance of 91.44 in (300 ft). The entire project Area of Potential Effect (APE) is 15.24 in (50 ft) wide, 91.44 m(300 ft) long, and 7.6 m (25 ft) deep. At the junction point,the four boxes will connect to a four-section 8 ft by 7 ft(2.4 m by 2.1 m) box storm drain system that will be constructed by the Texas Department of Transportation(TxDOT) and the North Texas Tollway Authority (NTTA) as part of the planned improvements for the interchange of State Highway 121 Tollway (SH-121) and Interstate Highway 30 (IH-30). The four-section junction connection is not in the scope of this coordination and will be addressed by those agencies at a later date.The project also calls for stabilization of the fill material underneath the current boxes by the use of cement slurry, applied by hydraulic pressure,in order to fill voids. The stabilization will extend from the bottom of the drainage boxes to the limestone bedrock 7.6 in(25 ft)below the ground surface. The total APE is 0.03 hectares(0.07 acres). 1 URS Background Information The project APE is in an urban area of Forth Worth, Tarrant County, Texas. It is located along the floodplain of the Clear Fork of the Trinity River, in the Forest Park and Parkview subdivisions. Geology and Soils The project area is within the boundaries of the undivided Lower Cretaceous Fort Worth Limestone and Duck Creek Geological Formation, and the Quaternary Alluvium, Qal, low terrace flood-plain deposits of undivided gravel, sand, silt, silty clay, and organic matter found in the Trinity River streambed(Barnes, 1988). The soils in the project area are part of the Frio-Trinity series of nearly level, deep, clayey soils, located on floodplains, and the Aledo-Bolar-Sanger series of gently sloping to moderately steep, very shallow to deep, loamy to clayey soils, which are usually found in uplands. The Frio- Trinity soils can usually reach 2 m(80 inches)in depth, while the Aledo-Bolan-Sanger soils vary in depth, but can also reach up to 2 m(80 inches) deep (Ressel 1981). The area of the project is marked as an"Urban Land"soil due to the historic and modern development in the area. The soil is obscured and is not classifiable(Ressel 1981). Archaeological Resources A review of the Texas Archeological Sites Atlas (TASA 2009) indicates only one previously conducted archaeological survey within 1,000 m of the project area.A United States Army survey was conducted across the river from the project area in 1998, with no sites being reported (Exhibit 1). There are four Texas Historical Markers located within 1,000 m of the project APE (Exhibit 1 and Table 2), and one National Register of Historic Places (NRHP) property located within a 1,000 m radius of the APE (Table 3). Neighborhood surveys within 1,000 m of the project area show the Mistletoe Boulevard neighborhood to date to circa early 1920s (TASA 2009). Table 1. While the soil in the project area is labeled "Urban Land"on the soil survey(Ressel 1981),the soils along the Trinity River are usually deep with a possibility of deeply buried sites. There is a reasonable possibility of these soils being intact. While part of the project area was disturbed previously by the original drainage system installation, the portion of the drainage system that is planned to run parallel to the original system will be in an area that is assumed to have undisturbed deep sediments.
