HomeMy WebLinkAboutContract 53440-A3Permit Number: PN21-00044 Date Received: Mar 30, 2021 City Secretary Time Received: 12:31 pm Number: 53440-A3 TAIltD AMENDMENT TO CITY SECRETARY CONTRACT NO. 53440, EASEMENT ENCROACHMENT LICENSE AGREEMENT This THIItD AMENDMENT TO CITY SECRETARY CONTRACT NO. 53440, EASEMENT ENCROACHMENT LICENSE AGREEMENT is made and entered into by and between the CITY OF FORT WORTH, a home rule municipal corporation of Tarrant County, Texas ("City"), acting herein by and through its duly authorized City Manager, Assistant City Manager, or Development Services Department Director, and Village homes, LP., a(n) Limited Partnership ("Licensee"), acting herein by and through its duly authorized President. RECITALS WHEREAS, City and Licensee made and entered into City Secretary Contract No. 53440 on January 22, 2020 (the "Agreement"), to authorize the use of the City's easement for the purposes of Installing balcony overhangs; and WHEREAS, City and Licensee made and entered into City Secretary Contract No. 53440- Al on June 1, 2020 (the "Agreement"), to authorize the use of the City's easement for the purposas of installing Cantilevers, awnings, roof eaves and balconies; and WHEREAS, City and Licensee made and entered into City Secretary Contract No. 53440- A2 on August 17, 2020 (the "Agreement"), to relocate and redesign previously approved cantilevers, awnings, roof eaves and balconies; WHEREAS, the parties wish to amend the Agreement to reflect redesign of building plan - 138 sq ft to 166 sq ft.; and WHEREAS, it is the mutual desire of City and Licensee to execute this Amendment to the Agreement to revise `Bxhibit A" in the Agreement to depict the revised encroachment area. WORTH, TX NOW, THEREFORE, City and Licensee, acting herein by and through their duly authorized representatives, enter into the following that amends the Agreement: 1. "E�chibit A" in the Agreement is hereby replaced with the attached revised description of the encroachment area, labeled as "Revised Exhibit A." 2. The effective date of this Amendment shall be the date of its execution by the City. 3. All other provisions of the Agreement which are not expressly amended herein shall remain in full force and effect.
