HomeMy WebLinkAboutContract 54169-A1CSC No. 54169-Al AMENDMENT No.1 TO CITY SECRETARY CONTRACT No.54169 WHEREAS, the City of Fort Worth (CITY) and McCarthy Building Companies, Inc., (CMAR) made and entered into City Secretary Contract No. 54169, (the CONTRACT) which was aut horized by M&C 20-0334 on the 19 th day of May, 2020 for preconstruction services in the amount of $95,000.00 and construction services in the estimated amount of $22,000,000.00, inclusive of the CMAR's construction phase fee of 6.5% of the Cost of Work; and WHEREAS, the CONTRACT calls for pre-construction and construction services for the following project: Harmon Road US 287/81 to Golden Triangle Boulevard (CPN 100459); and WHEREAS, pursuant to Article 4 of the Contract, the parties desire to execute Amendment No. 1 to the CONTRACT to establish the Guaranteed Maximum Price (GMP) for the construction phase of the Project; NOW THEREFORE, CITY and CMAR, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. The Guaranteed Maximum Price for the Project shall be the amount not to exceed $25,216,386.00, inclusive of the CMAR's 6.5% fee, as specified in a proposal letter attached hereto. The GMP is within the project budget and Staff finds that the fees and costs are fair and reasonable for the work proposed. The CONTRACT is amended to provide for an increase in the amount to be paid to CMAR for construction phase work and services performed under the Contract, as amended, so that the total cost to the City for all work and services shall be an amount not to exceed $25,311,386.00. 2. All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. Our price proposal is inclusive of the work included within the following documents as well as the subsequent clarifications contained within this proposal; McCarthy Front End Documents Advertised 11/19/2020 Addendum #1, #2, and #3 Post Bid Subcontractor Clarifications Contract Drawings: "Issued for Bid" from Kimley-Horn dated 11/19/2020 McCarthy's total not to exceed proposal for GMP is $25,216,386. This price proposal is predicated upon utilizing all subcontractors and suppliers as recommended by McCarthy, including the use of McCarthy as a self-perform subcontractor on multiple work packages, for the lump sum pricing as indicated in the attached GMP Recap Sheet. Attached for your review is a GMP Recap Sheet with detailed breakdown of general conditions, project clarifications concerning our pricing proposal, bid evaluation ratings, MBE Utilization Plan, selection of Prequalified City Contractors, breakout of Sanitary Sewer and Water costs, and a project schedule. This proposal is based on a Harmon Road Improvements work package scope of work published within the McCarthy Front Ends advertised on November 19, 2020. The project duration will be 24 months, with an assumed March 22, 2021 Notice to Proceed, and a Final Completion date of March 23, 2023. 2. Bids received on December 17, 2020 are valid for only 120 days from that date. We anticipate a February 24, 2021 council approval which allows subcontracts to be issued within the 120-day bid period. We have not included any measures for rebidding or for cost increases if the 120-day bid period is exceeded prior to Owner authorization. 3. We have assumed a maximum two-week (14 calendar days) turnaround for critical path submittals from the City. 4. We have assumed a maximum two-week (14 calendar days) turnaround for critical path submittals from the Engineer of Record. 5. We assume electronic versions of the contract plans/documents will be made available to assist in building the project. 6. We have assumed a maximum one-week (7 calendar days) turnaround times of all RFI's. 7. Subcontractor pricing is for the advertised work packages as detailed within the front end documents. Deductive bid items must be agreed to prior to contract execution. Any deductions from the scope after the contract is executed is subject to re-evaluation and pricing due to the fact that the subcontractor may have locked in pricing for materials based upon specific quantities, or may have released permanent materials for production. 8. Scope/Price and/or time related deductions within subcontracted work packages or project contingencies shall be transferred to alternate applicable contingency line items with 50% shared savings to McCarthy. 9. McCarthy has included a contingency for Work Category #6 Landscaping due to receiving no complete bids on the work package. This scope will be rebid. Exclusions: The following items have been excluded from our Guaranteed Maximum Price: 1. Permits and Fees (beyond the construction trailer and street use permit fees) 2. Third Party Inspection, IE testing of dirt, compaction densities, concrete, etc. McCarthy will coordinate testing, but all costs of testing are to be borne by the Owner 3. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to authorize execution of Amendment No. 1 to City Secretary Contract No. 54169, the Construction Manager at Risk (CMAR) Agreement with McCarthy Building Companies, Inc., establishing the guaranteed maximum price (GMP) in the amount not to exceed $25,216,386.00 for the construction of the Harmon Road project, from United States Highway (US) 287/81 to Golden Triangle Boulevard. The total overall project budget is $36,748,450.00 which includes planning, design, land acquisition, project administration, construction, inspection, testing, utility relocations, and contingencies. The project scope includes the construction of a four-lane arterial street from US 287/81 to Golden Triangle Boulevard, with roundabouts at Presidio Vista Drive, Heritage Trace Parkway and Golden Triangle Boulevard. The project is being funded through the City's 2018 Bond Program and developer contribution. On May 19, 2020 (M&C 20-0334), the City Council authorized a CMAR Agreement with McCarthy Building Companies, Inc., with a construction phase fee of six and one-half percent (6.5%) of the cost of work within a project construction budget of $22,000,000.00 to provide CMAR services for the construction of Harmon Road from US 287/81 to Golden Triangle Boulevard. This Amendment No. 1 will establish the GMP in the amount not to exceed $25,216,386.00 for the construction of the Harmon Road project. The GMP is inclusive of the Cost of Work and the Construction Phase Fee (as defined in the Agreement). Staff considers this increased cost to be fair and reasonable for the full scope of work proposed and recommends increasing the project construction budget to $25,216,386.00. The overall project budget can absorb this increase to the construction budget. The original $22,000,000.00 project construction budget was an estimate of direct construction costs and did not include any construction contingency, CMAR fees or general conditions costs as reflected in the proposed GMP. The GMP consists of eight work categories: WC1 Earthwork and Walls, WC2 Underground Drainage, WC3 Water/Sanitary Sewer, WC4 Electrical, WC5 Paving, WC6 Landscaping, WC7 Integral Colored Concrete, and WC8 TrafFic Control to complete the project. On November 19 and November 26, 2020, McCarthy advertised the work categories seeking best value proposals in the Fort Worth Star- Telegram, as well as employed enhanced measures to alert the North Texas contracting community of this bidding opportunity. McCarthy conducted a pre-construction conference on November 30, 2020 and hosted a minority business enterprise outreach event on December 1, 2020. On December 17, 2020 proposals with bids were received and evaluated by McCarthy based on published factors such as ability to start and complete the project within the project schedule, construction techniques, ability to perform the work and other specific criteria including but not limited to the following: • Cost • Safety and accidents rates • Schedule and work planning • Financial strength • Business diversity ordinance compliance • Qualifications, experience, and references Contractors have been recommended by McCarthy to staff as offering the best value to McCarthy and the City, with which staff concurs. Where McCarthy Building Companies, Inc. is the recommended contractor for certain work categories (self-performance), the Director of Transportation and Public Works has determined that McCarthy Building Companies, Inc., provides the best value for the City. This project is included in the 2018 Bond Program. Available resources within the General Fund will be used to provide interim financing until debt is issued.
