HomeMy WebLinkAboutOrdinance 20427-09-2012ORDINANCE NO. 20427-09-2012 AN ORDINANCE AMENDING THE FORT WORTH BUILDING CODE, FORT WORTH RESIDENTIAL CODE, FORT WORTH MECHANICAL CODE, FORT WORTH PLUMBING CODE, FORT WORTH ELECTRICAL CODE, FORT WORTH SIGN CODE, BY PROVIDING FOR CONTRACTOR REGISTRATION AND RELATED FEES; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY CLAUSE; PROVIDING FOR PUBLICATION IN PAMPHLET FORM; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City Council of Fort Worth has determined that it is appropriate to amend the City of Fort Worth's Building Code, Residential Code, Mechanical Code, Plumbing Code, Flectrical Code and Sign Codes to provide for contractor registration and related fees; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, AS FOLLOWS: SECTION 1. Section 7-47 "Amendments" of Article III "International Building Code" of the Code of the City of Fort Worth (1986) is amended to read as follows: SECTION 118 CONTRACTOR REGISTRATION. 118.1 General. Any firm, business, individual or organization obtaining a permit related to the building, mechanical, Plumbing or electrical provisions of the City of Fort Worth's Codes shall have on file in the Department of Planning and Development a valid Contractor Registration signed by an official of the business hereafter to be known as Registered Official. Exception: The property owners of single family residences when performinc, the work on their homestead property. 118.1.1 Plumbin; Contractor Registration. Applicants for a Fort Worth plumbing Contractor Registration shall hold a valid State of Texas Master Plumber License or Texas Board of Irrigator License when required by the State of Texas or the City of Fort Worth Plumbing Code. Ordinance No. 20427 -09 -2012 Page I of 18 1.18.1-2 Mechanical Contractor Registration. Applicants for a Fort Worth mechanical Contractor Registration shall hold a valid Fort Worth mechanical refrigeration and air conditioning contractor's license or a State of Texas air conditioning and refrigeration license with proper endorsements. 118.1.3 Electrical Contractor Registration. Applicants for a Fort Worth electrical Contractor Registration shall hold a valid Fort Worth electrical contractor's license or a State of Texas electrical contractor's license or State of Texas electrical sign contractor's license. 118.2 Application requirements. Contractors registering with the City of Fort Worth shall meet the insurance requirements listed within this section, provide a copy of any applicable State of Texas license, and complete an application containing the following information: 1. Business Name 2. Name and contact information of the Registered Official 3. Address of business 4. Type of Contractor Registration 5. Insurance information Upon approval of the Contractor's Registration application, applicants shall pay the appropriate registration fees. 118.2.1 Fees. All individuals or businesses registering under this code shall pay fees as prescribed in this section. Annual Fee $120.00 Change of Master or Registered Official $60.00 Renewal Fee $120.00 Exception: State Licensed Plumbing Contractors or their qualifying individuals are exempt from paying registration fees. 118.2.2 Insurance requirements. All individuals or businesses registering with the City of Fort Worth as a contractor shall provide evidence of insurance as listed herein: 1. Policy listing the Cornpany name and name of the qualifying Registered I Official. 2. Liability limits of not less than $300,000 per occurrence for bodily injury. 3. Liability limits of not less than $100,000 per occurrence for property damage. Ordinance No. 20427-09-2012 Page 2 of 18 4. Commercial General Liability policy shall have no exclusions by endorsements that Would alter of nullify premises /operations, products/completed operations, contractual, personal injury, or advertising injury, which are normally contained with the policy, unless the CITY approves such exclusions in writing. 5. The certificate of insurance shall document the City of Fort Worth, its' Officers, Fmployees and Volunteers as an "Additional Insured" on all liability policies. Exception: State Licensed Plumbing, Mechanical or Electrical Contractors or their qualifying personnel need not provide proof of insurance. 118.3 Expiration and renewal of Contractor Registration. The Contractor 0 Registration, unless revoked or suspended, shall expire one year from the date of issuance. Contractor Registrations which have expired shall be charged a renewal. fee. The term of the renewed Contractor Registration shall be one year from the date of reissuance. 118.5 Revocation of registration. A Contractor Registration may be suspended, repealed or revoked by the Code Official by reason of the occurrence of one or more of the following: 1. Adjudication of insanity; 2. Fraud or misrepresentation in obtaining any City of Fort Worth license, Contractor Registration, or permit; 3. Violation of a provision of the, Building, Residential, Energy, Plumbing, Mechanical, Sign, or Electrical Code of the City of Fort Worth 4. A conviction or judicial judgment related to the defrauding of a person for whom the contractor has rendered or contracted to render service; 5. Failure to obtain a permit or the attempted assignment of a perinit', 6. Failure to pay fees or the voluntary or involuntary filing of bankruptcy proceedings by or against the firm, partnership, association, or corporation with a Contractor's Registration with the City; 7. The sending of six (6) notifications within a six (6) month period that the registered contractor is in violation of this code; and, 8. When a state license related to the Contractor Registration qualification is expired or suspended for any reason. Ordinance No. 20427 -09 -2012 Page 3 of 18 118.5.1 Registration appeal. The Construction and Fire Prevention Board of Appeals shall hear all appeals for reinstatement of Contractor Registrations suspended or revoked under section 118.5.1 (2) and (3). All other Contractor Registrations suspended or revoked under section 118.5 shall not be appealable. SECTION 2. Section 7-62 "Amendments" of Article IIIA "International Residential Code" of the Code of the City of Fort Worth (1986) is amended to read as follows: R105.3.3 Group R, Division 3 and accessory structures. Permits for the remodel or addition to Group R, Division 3 Occupancies or their accessory structures, shall only be issued to individuals or contractors registered in accordance with Section R 1.1.7 of this code. Exception: The property owner, where the work that requires a permit is being performed by the owner only, need not be registered. SECTION R117 CONTRACTOR REGISTRATION 8117.1 General. Any firm, business, individual or organization obtaining a permit related to the building, mechanical, plumbing or electrical provisions of the City of Fort Worth's Codes shall have on file in the Department of Planning and Development a valid Contractor Registration signed by an official of the business hereafter to be known as the Registered Official. Exception: The property owners of single family residences when performing the work on their homestead property. 8117.1.1 Plumbing Contractor Registration. All work performed tinder a permit to a registered individual or contractor must be performed by persons in their direct employ. Individuals or Contractors using their registration to permit jobs for other non- registered individuals will be considered, as well as those non - registered individuals, to be in violation of this code. R1.17.5 Revocation of registration. A Contractor Registration may be suspended, repealed or revoked by the Code Official by reason of the occurrence of one or more of the following: 1. Adjudication of insanity; 2. Fraud or misrepresentation in obtaining any City of Fort Worth license, Contractor Registration, or permit; 3. Violation of a provision of the, Building, Residential, Energy, Plumbing, Mechanical, Sign, or Electrical Code of the City of Fort Worth 4. A conviction or judicial judgment related to the defrauding of a person for whom the contractor has rendered or contracted to render service; 5. Failure to obtain a permit or the attempted assignment of a permit; 6. Failure to pay fees or the voluntary or involuntary filing of bankruptcy proceedings by or against the firm, partnership, association, or corporation with a Contractor's Registration with the City; 7. Exception: The property owners of single family residences when performing the work on their homestead property. 112.1.1 Mechanical Contractor Registration Applicants for a Fort Worth mechanical Contractor Registration shall hold a valid City of Fort Worth mechanical refrigeration and air conditioning contractor's license or a State of Texas air conditioning and refrigeration license with proper endorsements, 112.2 Application requirements. Contractors registering with the City of Fort Worth shall meet the insurance requirements listed within this section, provide a copy of any applicable State of Texas license, and complete an application containing the following information: 1. The Conti-actor Registration, unless revoked or suspended, shall expire one year from the date of issuance. Contractor Registrations which have expired shall be charged a renewal fee. The term of the renewed Contractor Registration shall be one year from the date of reissuance. 112.5 Registration suspended, repealed, or revoked. A Contractor Registration may be suspended, repealed or revoked by the Code Official by reason of the occurrence of one or more of the following: I. Adjudication of insanity; 2. SECTION 8. It shall be unlawful for any person to erect, construct, enlarge, alter, repair, move, improve, remove, convert, demolish, equip, use, occupy, or maintain any building or structure in the City or cause the same to be done contrary to or in violation of any of the provisions of this Code. Any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine not to exceed Two Thousand Dollars ($2,000.00) for all violations involving fire safety, or public health and sanitation and shall be fined not more than Five Hundred Dollars ($500.00) for all other violations of this ordinance. Each day or any portion thereof which any violation of this ordinance occurs or continues shall be deemed a separate offense and upon conviction thereof shall be punishable as herein provided. SECTION 9. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared void, ineffective, or unconstitutional by the valid judgment or final decree of any court of competent jurisdiction, such voidness, ineffectiveness, or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this ordinance, since the same would have been enacted by the City Council without the Ordinance No. 20427 -09 -2012 Page 17 of 18 incorporation in this ordinance of any such void, ineffective, or unconstitutional phrase, clause, sentence, paragraph, or section. SECTION 10. This ordinance constitutes a digest and revision of the Building Code of the City of Fort Worth, as provided in Section 2, Chapter XXV and Section 9, Chapter XXVII, of the Charter of the City of Fort Worth. The Planning and Development Department of the City of Fort Worth, Texas, is hereby authorized to publish this ordinance in pamphlet form for general distribution among the public, and the operative provisions of this ordinance, as so published, shall be admissible in evidence in all courts without further proof than the production thereof, as provided in Chapter XXV, Section 3, of the Charter of the City of Fort Worth, Texas. The last major fee adjustment within the Planning and Development Department occurred on September 36.2UO6(K4&CG-15417 and M@CG'15418). The fees increased 1U percent across the board. Since that time, the City engaged the Willclan Group and surveyed other cities to determine market fee levels. These efforts indicated that most ofthe City's development fees have room for adjustment b] remain within the targeted 50 to 60 percentile of surveyed cities. In April of 2012, the Planning and Development Department began implementation of Automation, a new oih/-wide permitting software system. AddihonaUy, it is expected that the Planning and Development Department will purchase and implement a new electronic plan review software system by October 2013. Combined, the now software improvements will cost the City more than $1,000,000.00 for implementation and increase the annual operating budget by more than $150,000.00 for maintenance costs. These technology and other process improvements are a result ofon interdepartmental effort aimed atimproving the City's development processes. Staff has posed adjustments in service categories that are either currently unfunded Orunderfunded, market adjustments for fees that are generally below regional or national medians' and minor rounding of zoning and platting fees.
