A RESOLUTION AUTHORIZING EXECUTION OF AN ADVANCED
FUNDING AGREEMENT WITH THE TEXAS DEPARTMENT OF
TRANSPORTATION IN THE AMOUNT OF $644,761.00, OF WHICH
LOCAL PARTICIPATION IS $66,000.00, FOR THE NORTH MAIN STREET
AND 28TH STREET INTERSECTION IMPROVEMENTS PROJECT
WHEREAS, federal law establishes federally funded programs for transportation
improvements to implement its public purpose; and
WHEREAS, the Texas Transportation Code , Section 201.103 establishes that the
State shall design , construct and operate a system of highways and roads in cooperation
with local governments , and Section 222.052 authorizes the Texas Department of
Transportation Commission to accept contributions from political subdivisions for
development and construction of public roads within political subdivisions ; and
WHEREAS , a Master Agreement between the City of Fort Worth ("Local
Government") and the State of Texas acting through the Texas Department of Transportation
("State") has been approved which states the general terms and conditions for Advance
Funding Agreements (AFA) for transportation projects and other projects; and
WHEREAS , the City of Fort Worth desires to enter into an Advance Funding
Agreement with the Texas Department of Transportation in the amount of $644,761.00, of
which $278 ,538.00 is federal participation , $300 ,223.00 is state participation and
$66 ,000.00 is local participation for the purpose of constructing the North Main Street and
28th Street Intersection Improvements Project.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH, THAT:
The City Manager is authorized to execute an Advance Funding Agreement with the
Texas Department of Transportation in the total estimated amount of $644,761.00 with City
participation in the estimated amount of $66,000.00 for the purpose of constructing the
North Main Street and 28th Street Intersection Improvements Project.
Adopted this 6th day of April 2021 .

RECOMMENDATION:
It is recommended that the City Council :
1. Adopt the attached resolution authorizi ng execution of an advance funding agreement with the Texas Department of Transportation in the
amount of $644,761.00 with federal participation in the amount not to exceed $278,538.00, state participation in the amount of$300 ,223 .00
and local participation in the amount of $66,000.00 for the North Main Street-Business 287 and 28th Street-State Highway 183 project
(Control Section Job No . 0014-01-025 , 0014-01-027);
2 . Accept federal funding via the Texas Department of Transportation in the amount not to exceed $278,538.00;
3. Adopt the attached Appropriation Ordinance increasing estimated receipts and appropriations in the Grants Capital Projects Federal Fund ,
subject to receipt of the grant, in the amount not to exceed $278,538.00 for the North Main Street-Business 287 and 28th Street-State
Highway 183 project (City Project No. 103211 ); and
4. Amend the FY2021-2025 Capital Improvement Program.
DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) is to adopt a resolution authorizing the execution of an advance funding agreement
(AFA) (Control Section Job No . 0014-01-025 , 0014-01-027) for this Highway Safety Improvement Program (HSIP) project with the Texas
Department of Transportation (TxDOT) and accept the federal grant funds for the construction in the amount not to exceed $278,538.00. After
submitting this intersection for HSIP consideration, it was selected to receive federal funds .
The project includes pedestrian safety and traffic signal improvements as well as pavement reconstruction of left-turn lanes to increase capacity .
The intersection improvements will provide orderly movement of traffic through the intersection while increasing safety for pedestrians and
vehicles.
Since this is an HSIP project , Tx DOT will be leading the construction. They will absorb the indirect cost for providing statewide support services to
this federally funded project in the amount of $300 ,223 .00 . For th is AFA, no local match is required. Consequently , the federal participation of the
grant component is $278 ,538 .00 . The City will provide $66 ,000 .0 0 (available from M&C G-19306 2018 Bond Program) towards the AFA for
engineering, environmental , and right of way as well as to cover additional City scope items identified during the preliminary engineering phase of
this project.

This project is included in the 2018 Bond Program . Available resources within the General Fund will be used to provide interim financing until debt
is issued . Once debt associated with the project is sold , bond proceeds will reimburse the General Fund in accordance with the statement
expressing official intent to reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance No . 23209-05-2018)
and subsequent actions ta ke n by the Mayor and Counci l.

FISCAL INFORMATION/ CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds
will be available in the current capital budget , as appropriated , in the Grants Cap Projects Federal Fund and previously appropriated 2018 Bond
Program Fund for the HSIP N Main and 28th St project. The Transportation and Public Works Department (and Financial Management Services)
will be responsible for the collection and deposit of funds due to the City. Prior to expenditure being incurred, the Transportation and Public Works
Department has the responsibility to validate the availability of funds .
