The cnunty owns an electronic voting sysCem, the HAR7 InterCivic Verity dU0 Voting Systerr� (Version
2.3.1j, which has been duly appro�ed by the 5ecretary of 5tate pursuant to Texas �lectian Code Chapter �22 as
amendeci, and is compliant with the accessifaility requirements for persons with disabilities set #ortf� by Texas
Election Code 5ection 51.012. The contracting political su�divisions desire to use the Coun�s electronic vating
system and compensate th� County forsuch use and to share in certain other expenses connected with join�
elections in aecvrdance with the applicable pra�isians of Chap�ers 31 and 271 of the Texas Election Code, as
amended.
NOW THERFOR�, in consideration of the mutual, agreements, and benefits to the par�ies, IT IS AGREED as
follows:
[: AbMINlS"fRATEON
The parties agree to hold a"Joint e[ection" with Parker Cvunty and eaeh ather in accordance with chapter
271 of tf�e Texas Election Code and this agreement. TE�e Parker County electians Administrator shal! coordinate,
supervise, and handle afI aspects of administering the jainfi Election as pro�ided in this agreernent. Each
participating authority agrees to pay the Par[cer County Elections Administrafior far equipment, st�pplies, services
and administrative costs as pro�ided in this agreement. 7he Aarker County Eiectivns Adminis#rator sha[I serve as
the administrator for the Joint Election; howe�er, each parCicipating authority shall remain responsi�le for the
decisions and attians of its offcers necessary for the lawfu] conduct of its electivn. The Elections AdministraCor
shall prov9de advisory services in connectinn with decisions to be made and actions to l�e tak�n 6y the o�Ficers nf
each participating authnrity as necessary.
]t is understood that other politieal su�divisions may wish to participa#e in the use of the County's �
elettranic voting system and po4ling places, and it is agreed thatthe �lections Adrninistrator may enter into other
contracts for electior� services for those purposes on ierms and conditions generally similarto those set forth in
tts€s contrac#. fn such cases, costs shaEl be prn-rated among ihe participants a�carding to 5ectian X� of ihis
con�ract.
At each polling location, joint participants shall share voting equipment and suppiies to ihe extent
possil�le. ihe participating parties shal[ share a rr�utual ballot in those polling locations where jurisdictions overlap.
However; in no instance sf�ap a �oter he p�rEnitted to.receive a ballot containing an ofFice ar propvsit'son stating a
measure on which the voter is ineligible ta vote. Mu[tip[e ba]Eot styies shal] �e availa6le in those shared pollmg
locations where jurisdictior�s do not overlap.
Il: LEGAL D�CUMENTS
Each participating authority shall be res}�onsibfe for the preparation, adoption, and publication of all
required eEectian arders, resolutions, and ather periinent documents required 6y the iexas Eledion Code and%or
the participating authority's governing bady, charter or ardinances, except that tha Elections Administrator shall
k�e responsi6le forthe preparation and publication of all �oting system testing notices and election notice's that
are required by the Texas �lection Code.
Preparation of the necessary materiais for the notices and the official ba[lot shaff be the responsi6ility of
each �articipating authariYy, including trans[ation to language Spanish. Each participating a�thority shall provide a
copy of their respecti�e e�ectior� orders and nn�Ecas to Parker County Elettions Administrator.
The Elections Adrrsinistratar sha�l prepare a subrnission, on behalf of all par�icipating authorities, ta the
United Staies Department of Justice for predearance of the joini electinn procedures and polling Eocations,
pursuant to the Voting rights AcC of 1965, as amended. 7he Electians Adrr�inistrator will provide to each
participating authority a photncopy of the joi�t submission and correspvndence frvrn #he €}epartment of]ustice.

The joint submission prepareci by the �lecti�ns Administrator wilE NOT include submissions o#
information for any special electivns F�eld by Che participating authorities. Participating authorities are hereby
notified and encouraged to prepare tF�eir own su6missions to the United 5tates Department of Jusiice far speciaf
electian procedure, or any changes that are specifEc to their own political subdi�ision.
By signing this agreement eacir participating autharity certifies thQt it has no unresolved preclearance or
vating rights issues known to it that wauld preclude or delay appraval by the department of lustice far the joint
election.
The Eleetions Administrator will fi�e an amended submission to the United States Aepartment of Justice ir�
tf�e e�ent that any polling locatiian is changed after the ariginal submission is filed, incfuding changes resuiting
from the withdrawal of one or more participating authorities pursuant to 5ection XI[ af this cantract.
i11: POLLING LOCATIONS
The Elections Administrator sha[I select and arrange forthe use of and payme�t for all Election Day
polling fvcatiQns. Polling lacations wilt be whenever possit�le; the usual polling focation for each electian precinct
in electio�s conducted by tF�e county, and shail be compliant with the accessibility requirements establisF�ed by
electian Code 5ection 43.Q34 and the Americans with Disabilities act {A�A}, ihe proposed EARLY V017N6 paliing
locations are listed in Attachment A of this Agreement. In tF�e evar�t tF�at a�olling locatian is nat available or
appropriate, the Elections Adrnini5tratorw[EI arrange for use of an alternate location with #he approval of the
affected participating authorities. ihe Elections Administrator shali nntify the participating authorities af any
c�anges from ihe pof(ing locations fisted in Attachment A.
If palling foca�ions for the MAY 1, 2D21jaint election are different from ihe polling locations used hy a
participa#ing autharity in its most recent election, t�e Elections Administrat4r agrees to post a notice na laterthan
ARRiL 29, 2021 at the en#rance to any pre�ious pol[ing places in the jurisdiction stating that the palling locatian has
changed and stating the palitical subdivisians polling location name and address in affect for khe MAY 1, 2021.
This notice shall be written in bdth English arsd Spanis� languages.
IV: ___ ELECTIQN JUDGES, C�ERKS, AND OTMER PER50NNEL
Parker County shaff be responsible forthe appointmen� af tF�e presiding judge and afierrtate judge fior
each polling locatian. The Elections Administrator shall make emergency appointments of the election ofFicials if
necessary.
Upon request by the Electivns Administrator, eaeh participat'sng a�athority agrees ta assist in recruiting
polfing location ofFicials wha are bilingual {fluent in both English and 5panish). [n compliance with the Federal
Voting Rights Act of 1965, as amended, each palling locat'son contain more Yhan 5% Hispanic populations as
determined by the 2D1Q Census shall i�ave one or rnore election official wf�o is fluent in Eaoth English arsd Spanis�
languages. lf a presidingjudge is nat biling�aE, and is unable tn appoint a bilingual clerk, the Elections
Aciministratar may recommend a bilingual worker for the polling loca�ion, If the Elections Administrator is unable
to recommend or recruit a bilingual worker, the participating authority or authorities served by the polling Iocatian
shall k�e responsibfe for recruiting a bilinguai woricer for transfation services at thaf polling focation.
The Elec�inns Rdrr�inistrator shall noti#y aEi election judges of #he e�igibility reGuiremen#s o#Subchapter C
o€ Cf�apter 32 of the Texas �fection Cade, and will take the necessary steps to ensurethat all �udges appainted for
the Joint Efection are eligible to ser�e.
The Elections Administrator shall arrange for the training and compensatian of all e[ettion judges and
c[erks. The Eleciions Administrator sha!! arrar�ge for the da#e, time, and place #or presiding judges ta pick up their
election supplies. �ach presiding election judge urill be sent a leiter form the Elect4ons Administrator notifying him
of his/her appointment, ihe time and location of training and distribution oF e�ectinn supplies, and the number af
e�ection clerfes tF�ai the presiding judge may appoint.
EacF� election judge and clerk will receive campensation at the hourly rate established by Parker County
pursuant to Texes Electian Code Section 32.091. ihe efection judge will receive an addit'sonal surn of $15.0� €or
picking up the eieciion supp[ies prior fio the Eiection Day and for returning the supplies and equipment to the
centrai counting station after the polls close.
Efection judges and clerks who attend voting equipmer�t training and /or procedures training shaff be
com�ensated aCfhe same hourEy rate that they are to be paid on efeztion Day.
The �lection Administrator may employ other personne! necessary for the praper admir�istration of the
eiectionr inc{uding such part time �el� as is necessary to prepare for the e�ectinn to ensure the timely �elivery af
supp]ies dur[ng early �oting and an Eiection Day, a�d for the e�cient tabulativn of ballots at tE�e central counting
station. Part 7ime persannel workin� as members of the Eariy Voting E3allot Baard and/or central counting station
on e�ection night will he com�ensated atthe hour3y rate set by Parker County in accordance with eletCion Code
SetYions $7.Qp5, 127.004, and 1Z7AD6.
V: PREPARA710N OF 5UpPLIES Ai�D VOITNG EQUIPMENT
The E[eetians Administrator shal[ arrange far all eiec#ion sli�pli2s and vvting equipment ir�ciuding, but not
iimited to, ofFicial ballots, sample 6aflots, vater registra#ion lists, and afl forms, signs, maps and other materials
used by the electinn judge ai the �oling locations. 7he Elections Administrator shall ensure availability of tables,
and �hairs at each polling pface and shall procure rented ta6les and chairs far thase polling ]oeations thai dv not
ha�e tables or chairs.
At each polJing lacation, joint participants shall share �oting equipment and supplies ta the extent
possible. 'The participating parties shal! s?�ere a mutual hallot in those precincts wherejurisdiction o�erlap.
Hourever, in no instance shail a voter be perm€tted to receive a ballot containing an o#fice ar proposiYion stating a
measure on whEch the voter is ineligi6le to voie. Multiple ballot styles shall 6e available in those shared po]ling
locations wherejurisdiciian do not averlap. The Elections Administratorshall pra�ide the necessary voter
registration ir�formaiion, instructions, and other infarmation needed to enable the election j�dges in the polfing
locations that have more tF�an one ba[fat styfe to conduct �roper election.
Eacf� participatin� auihnrity shalf furnEsh the Elections Admir�istrator a list of eandidates and/or
grvpositio�s showing the order and the exact manner in which the candidate name and/or p�opositians are to
appear on tt�e official ballot (including titles and text in each lar�guage in which the authority's l�allot is tv he
printed]. Each participating autf�ority shall be responsible far proofreading and approving the balfot insofar as it
perYains to that euthoriry's candidates and/or propositions.
The elections ArJministrator shall be responsible for the pre�aration, #esting and de[ivery of the voting
equipment for the election as requirecf by election Code.
The eiectionsAdministratar shall conduct criminal background checks on relevant employees upon hiring
as required by election Code 5ection 129.05].(g).
IV: EARLY VOTING
Tt�e participating authorities agree to conduct jaint eariy �oting and to appoint the Elettion Administrator
as the Early Voting cierk in accordance with 5ections 31.037 and 271.006 of tihe Texas ElecCian Cade. Each
participating authority agrees to ap�oint ti�e Eleetions Administrator`s permanent caunty employees as deputy
early voting cEerks. The participating authorities further agree that the Elections Administrator may appoint other
dep�ty eariy �oting clerks ta assist in the conducY of eariy vo�'sng necessary, and that these additiona[ deputy early
�oYing clerks shall he compensateci at an hourly ra#e set by Parker County pursuant to 5ection 83A52 of the Texas
Election Code. Deputy ear[y �oting clerks who are permar�ent ernp[oyees of the Parker County �iect�ons
Administratar or any participating authority shall serve in that capacity without additiona] compensation.

GENERALfSP�ClRL EI.ECTION to be held an MAY 1, �Q21. Any quafified voter of theloir�t Electioro may vote early
�ry persanal appearance at any of the joir�t early voting lacations.
As Ear1y Voting Gerk, the �lections Administrator shall recei�e applications for eariy �ating ballots to be
�ated �y mail 'sn accordanee with Chapter3l and 85 of the Texas Election Code. Any requests for early vnting
ballots to be �nted by mail received by the pariicipating authorities s�tai{ be forwarded immediately by fax or
courier to the Electiorss Administratnr far processing.
The Elections Administratar shalf provide each participating authority a capy of the ear�y voting report on
a daily basis and a curr�ulati�e final ear[y voting repor� fallowing the electia�. In accordance with Section 87.121
(g) of the Texas Election code, the daily reports showing the pre�ious da�fs early �oting acti�itywill be distributed
to each authnrity no later than 5pm each business day if requested in writing.
VII: EARLY VO�ING BALLOT BOARD
Aarker County shall appoin� an Early Voting 8allot Board (EVBB) to process ear[y voting results from the
�oint Election. ihe Presiding judge, with ti�e assistance of the Elections Administrator, shail appoint tt�vo ar rnore

additional memEaers to constitute tf�e EVBB. The ElecEivns Administrator shall determine the number of EVBB
members req�ire[f to efficient[y process �he early �ot'sng ballots.
Vllf: CENTRAL C�UNTING STATION AND ELECTION RETURNS
The elections Administrator shall be responsible for estabfishing ar�d operating the central courtting
station to receive and tabulate the voted ballats in accordance with the prQv€sions vf the 7exas Election Cade and
ofthis agreement.
Parker County hereby in accordan�e with Section 127.002, 127.003 and 127.�05 of the Texas Election Cade,

The eounting station manager rrr his/her representative shail deli�er �imely eumulati�e reparts oft�e
electian results as precincts repore to the cer€tral count station. The manager shall be responsible for refeasing
unofficial cumulative to#als and �recinct returns frorn the e[ection to tF�e joint participants, candidates, press and
general public on the Parker County E[ections Website (wvvvv.parkertountybc.corn/482JElection-Results). To
ensure the accuracy of reported election returns, resufts printed on the tapes produced by Parker County's voting
equipment will not he released ta the participating autharities at the rerr�ote coflection sites or by phone from
indi�idual polling locations.
The E[ections Administrator will pre�are O�F4CEAL canvass reports that are necessary for ti�e compliante
w€th Election Code 5ectian 57.�04 after all precincts have been counted and will deliver a capy of these QF�1C]AL
canvass reports to each participating authnrity as soon as possible after all returns have been tabulaCed. Each
participating authority shall be responsibfe far the af#icial canuass af its respective election(s).
Fhe Electior�s Administrator will prepare the electronic precinct by preeinct results for uploading to the
Secretary of 5tate as required �y sectian 67.017 of the Texas Election Code.
The Efections Actministrator shall be responsible for conducting the post-election manuaE recount
requirec! by Section 127.2�1 of tF�e 7exas Election Code unless a waiv�r is grar�ted by the 5ecretary of State.
Notification and copies of the recount, if waiver is denied, wiEl be �rovided to each participating authority and the
Secretary ofi 5tate's Of�iee.
]X: PARTICIPA7iNG AllTHORITiES WITH TERR[TflRY 4fJT51DE PARKER CQUN7Y
Participa#ing authorities will provicle a list of registered voters within the area that is locater! outside af
Parker Co�rnty that are eligible to vote in the participating authorities May electian. lf the participating authorities
ehoose ta contract with the additio�al county ihey will let the Parker County �lections Administrator know hy fihe
MARCH 1, 2021,
During November Eiections each participating authority must coniract with every county t�eir territary
falls w€thin ac�ording to the Texas �lection Code.
X: RU�I-OFF ELECTiDNS
Each participating authority sha[f have the aptian of extending the terms of #his agreement through its
run-o�f election, if applicabls. En the e�ent of s€�c� run-off election, the terms of the agreement shafl auiomatically

extend unfess the participat9ng authority notif[as the Elections administrator in writing within 3 business days of
the origfnal election.
Each partic{paiing autharity shall reserve the rigi�t to reduce the number of early voting and /or Eiection
Day polling locations in a run-aFf election. [f necsssary any voting changes made k�y a participating authnrity
between the origina] election and the run-ofF election shal! ae submitted by the authority making the char�ge to
the United States department of Justice forthe preclearance required by the Federal Vating Righ�.s Act of 1465, as
amended. (I# necessary)
Each participating authority agrees ta order any run-off election(s) at or before its meeting for canvassing
the votes from the MAY 1, 2Q21 electian and to conduct its drawing for iaaElot positions at or immediateiy
fiollowing such meeting in order to expedite preparations for its run-off �lection.
Each participating authority eligible to hold run-off elections agrees that the date of the run-off electinn, if
necessary, shall be determined jointly by tF�e participating authority {ies) and the Elections Adrnir�istrator.
XI: ELECTION EXFENSE AND ALLOCATlON OF CQSTS
The participating autharities agree ta share tF�e costs af administering theloint electian. Allocation of
casts wi]] be estimated and where multip[e participants are utilizing poEling location costs will be shared. Costs for
Early Vating by Personal appearance, Early Voting by mail, and ba[lot programming sha[f be allocated based upor�
the fees agreed to by the participating authorities.
Costs for Early Voting �y Mail shall be allocated according ta tf�e actual number of ballots mailed to each
participating authorities voters.
Each partici�ating auti�ority agrees to pay the Parlcer County Elections Administrator as administrative fee
equal to ten percent (10%) of its total billahle costs in accordance with Section 31.1Q0(d) of thse Texas Election
Code.
7he Parker County Elections Administrator shall deposit all funds payable under this cantract into the
appropriate fund(s) within the county treasurer in aavrdance with e[ec�ion Code Section 3�..100.
XII: Wl7HDRAWL FRQM CONTRACC DUE TC3 CANCE�.�AT1aN OF ELECTION
Any participating authori#y may witf�draw from this agreement and the Jaint Electian shoufd it cancel its
eiection in accordance with Sections 2.051-2.053 nf the Texas Elsction Code. ihe withdrawing authority is #u!!y
liable for any expenses incurred by the Parker Gounty Electior�s Administrator on behalf of the autharity pius an
administrative fee of ten perceni (10%} of such expenses. The minimum fee shall be $75.Op, Any monies over the
$75.Op minirrtum fee will b� due within thi�-ty days of the wit�drawal fram Ehe contract.
X11: RECOR�50FTHEELECT]Q�{
ihe Elettions Administrator is hereby appointed general custodian af the voied ba[{ots and all records of
the Joint Election as authorized by Section 271.01Q of the Texas Election Cade.
Access to the election records shali be available to each parCicipating authority as wel! as to ihe public in
accordance with applicabfe provisions of the Texas Election Code and the Texas Put�[ic lnformation Act. The
e�ection records shall be stored at the offices of the Elections Administrator or at an alternate facility used fvr
storage of county records. The Electians Administrator shall ensure that the records are r�aintained in an arderly
manner so that the recards are c[earfy identifiabfe and retrieva6le.
Reeords of the election shall be retained and disposed af in accardance with the prov4sions of 5ection
66.058 of tF�e Texas Election Cade. !f records of the election are involved in any pending eEection contest,
investigation, litigation, or npen records requesY, the Ele�tions administretnr shali maintain the recards u�til final
resalution or unti! final judgem2nt, whichever is applicable. It is the respansibifity of eaeh participating authority
to l�ring to the attention of Yhe Efections Administrator any notEce o� pending election contest, investigation,
litigatian or opers records request which may be filed with the participating autharity,
XfV: RECaUNTS
A retount may be obtained as protic�ed by Title 13 of Ehe Texas Election Code. By signing this documenC,
the presiding a�Ficer af the contracting participating authority agrees that any recount shall take place at the
o�ces of the Elections Administratar, and tha� fi�e �leetians Administrator shali serve as recount Supervisor and

Code sha[I serve as Reeount Caardinator.
TF�e �fections Administrator agrees to provide advisary se€vices to each participating authority as
necessary fo condutt a proper recount.
XV; MI5CELLA�VEpiJS PROV1510�i5
1. Each partiCipating entity shall be sofely responsible for providing the Elections Admir�istrator with
street index along with the ranges for the MAY 1, 2D21 by FEgRUARY 12, 2021.
2. It is understood that tn the extent space is available, vther districts and political subdivisions may
wish to participaie in �he use of tF�e county's election equipment and polling facations, ancf it agreed
that the Elections Administrator may tontract with such other districts or pofitica! subdivisions for
such purpases and that in s�ch event there may be an adjustment of the pra-rata share to be paid to
the County by the participating autFtorities.
3. 7he Elections Administratar st�all fi�e copies of th'ss document within the Parker County Elections
Adminis�rator Office, Par[cer County Auditor end tf�e Parker Caunty Treasurer in accordance with
Sectiar� 31.099 of the Texas Election Cade.
4. Nott�ing in this cantract prevents any party from taking apprapriate legal acYian agains� any other
parry and/or other election personnel for a breach ot tF�is contract or a �iolatio�of the Texas Electiors
Cade.
5. This agreement shall be constrr�cted under and in accordance wit[� the laws ofthe 5tate ofTexas, and
al! obligations af the parties created hereunder and performable in Par[cer Cour�iy, Texas.
6. In the event that one or more o#the pra�isions cantained in this agreement sha[I fo� a�y reason be
held to be invalid, illegal, ar unenforceabte in any respect, such inva[idity, illegality or un-
enforceabifity shall not affect any other pravision hereof and this agreement shall be constructed as if
such invaEid, illegal, or unforce ab[e pravision f�ad never beer� contained herein.
7. All parties shall comply with af[ applicable laws, ordinances, and codes of the State ofTexas, a!I local
governments, and other eniities with Eoca! jurisdiction.
8. The wai�er by any party o� a breach of any provision af this agreement shall not operate as or be
construed as a waiver of any subsequent breach.
9. Any amendments of this agreement s�all be of no efifect unless in writing and signed by all parties
hereto.

Each par�icipating authority agrees to pay the Parker Couniy Elections Administrator 75% due with the
si�ned contract. The exact ar-r�ount of each participating authorities obligation under the terrr�s oit�is agreement
shall be calculated a�ter the MAY 1, Za2i election (or run-afF election, if applitable}, and the authority shall pay to
the Efections Administraior the balance due within 30 days after ti�e receipt of the invoice from the Parfcer County
i"reasurer's OfFice.
